BASIS OF APPLICATION: Building Department's March 7, 2002 Notice of Disapproval for the reason that applicants' proposed location of an accessory swimming pool in an area other than a rear yard. AREA VARIANCE REQUESTED: Applicants are requesting a Variance under Section 100-33 to locate an accessory 24' x 44' in-ground swimming pool to the south of the existing accessory (barn) building and residence. This yard area is defined by the Building Department as the applicant's side yard. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on June 20, 2002, at which time written and oral evidence was presented. Based upon all testimony, documentation, personal inspection of the property and the area, and other evidence, the Zoning Board finds the following facts to be true and relevant. PROPERTY DESCRIPTION: The applicant's property is located on the west side of Alvah's Lane in Cutchogue. The property is improved with a single-family dwelling and several accessory (nonhabitable)buildings. REASONS FOR BOARD:ACTION: In accordance with the review standards set forth in Town Law 267b-3 "area variances," the Board has considered the benefit to the applicant if the variance is granted, as weighed against the detriment to the health, safety and welfare of the neighborhood and community by such grant, and determines that: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties. Applicants own a large 167,967 sq. ft lot that is currently occupied by a two-story, single-family residence, set back approximately 196 feet from Alvah's Lane. There are five existing accessory buildings on this former farm lot, all of which are at the rear of the dwelling. This location is substantially set back from all property lines. The swimming pool is located in the same yard area,southerly near the accessory barn. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than,an area variance. The layout and design of the house has established the limited rear yard available under the zoning regulations. 3. The variance granted herein is not substantial. The variance granted wilt not have an,adverse effector impact on the physical or environmental conditions in the neighborhood or district. No evidence has been submitted to suggest that this minor variance will have an adverse impact on physical or environmental conditions in the neighborhood. 5. Grant of the requested variance is the minimum action necessary and adequate to enable applicant to enjoy the benefit of an in-ground swimming pool, while preserving and protecting the character of the neighborhood and the health, safety, and welfare of the community. BOARD RESOLUTION ACTION OF THE BOARD: In considering all of the above factors, and applying the balancing test under New York Town Law, motion was offered by Member Oliva, seconded by Chairman Goehringer, and duly carried,to GRANT the variance as applied for. This action does not authorize or condone any current or future use, setback or other feature of the subject property that violates the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. No. 5048 — C. & R. BATUELLO 1000-109-1-24.3 STREET & LOCATION: 1725 Alvah's Lane, Cutchogue DATE OF PUBLIC HEARING: January 10, 2002 PROPERTY FACTS: The subject property is a parcel of 167,967 sq. ft., in Cutchogue, with 528 ft. frontage along the west side of Alvah's Lane, Cutchogue. The property is improved with a single-family dwelling and several accessory (nonhabitable) buildings. BASIS OF APPEAL: Article III, Section 100-33, based on the Building Department's Notice of Disapproval dated November 7, 2001, denying a permit for additions and alterations to the existing house because: (1) the proposed construction will result in a side yard designation for the existing accessory buildings; (2) the proposed construction will be less than the code requirement of 75 feet for a minimum rear yard setback. AREA VARIANCE RELIEF REQUESTED: Applicants request variances authorizing setbacks noted in the November 7, 2001 Notice of Disapproval. The setbacks are proposed at 25 feet from the rear property line, and several accessory buildings will be located in a side yard area due to the proposed location of the new additions. FINDINGS OF FACT: The Zoning Board of Appeals held public hearings on this matter on January 10, 2002, at which time written and oral evidence were presented. Based upon all testimony, documentation, person observations of members of the board and other evidence, the Zoning Board finds the following facts to be true and relevant: 1. Applicants own a large 167,967 sq. ft. lot that is currently occupied by a two-story, single family residence, set back approximately 196 feet from Alvah's Lane. There are five existing accessory buildings on this former farm lot, all of which are in a conforming rear yard location. 2. Applicant's problem arises because he wishes to construct a new addition, and the existing residence would connect via a breezeway to the existing accessory barn, which barn is being converted to a habitable "playroom" addition, thereby creating one principal building/single-family dwelling. In proposing this action, other existing accessory structures will no longer 1, Page 3-January 10.2002 ZBA Appl No 5048—C and R Batuello Parcel 1000-109-1-24 3 at Cutchogue variance because the conversion and attachment of the accessory barn to the principal building automatically establishes a new rear yard area. The existing structures, therefore, become nonconforming and no other relief is available except a variance. 3. The requested variance is not substantial because it merely authorizes the existing accessory structures to remain in their current location, and permits an existing barn/future "playroom" to remain its rear yard setback. 4. No evidence was presented to suggest that the proposed changes would be an adverse effect or impact on the physical or environmental conditions in the neighborhood. 5. Grant of the requested variances is the minimum action necessary to enable the applicants to enjoy the benefits of an accessory in- ground swimming pool and accessory shed while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. 6. This action does not authorize or condone any current or future use, setback or other feature of the subject property that violates the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action.
