LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The property is a non-conforming 12,391 square foot parcel located in an R-40 zone. The property runs 140.62 feet along Meadow Lane; 100 feet on the South side; 118.03 feet on the West side; and 102.52 feet on the North Side. North of the property is the North Fork Country Club's golf course. The parcel is improved with an existing 1 story frame house and 1 car attached garage. All is shown on a site plan by Nancy L Steelman, Architect dated December 3, 2015. BASIS OF APPLICATION: Request for Variances from Article XXIII Section 280-124 and the Building Inspector's December 7, 2015 Notice of Disapproval based on an application for building permit to construct additions and alterations to existing single family dwelling, at; 1) less than the code required rear yard setback of 35 feet, 2) more than the maximum code allowable lot coverage of 20%. RELIEF REQUESTED: The applicant requests variances to construct additions and alterations with a rear yard setback of+/- 25 feet where 35 feet is required and a total lot coverage of 22.56 percent where a maximum of 20 percent is permitted. ADDITIONAL INFORMATION: At the hearing a representative from the North Fork Country Club testified that stray golf balls sometimes land on the applicant's property and that the applicant should install high impact glass on the windows on the North side of the house. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on February 4, 2016 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: Page 2 of 3—February 18,2016 ZBA#6915—Hearn SCTM#1000-116-2-20 1. Town Law 4267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of single-family homes and one golf club. The proposed additions are characteristic of other residential properties in the neighborhood in scale, design, and setbacks. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. A portion of the existing residence and deck is within the 35 foot rear yard setback line. By reusing the existing deck, the setback is established for the new screen porch addition. The existing lot coverage of 17.61% would only allow an additional 309 square feet to be added to the existing structures on the property and remain conforming. The additional lot coverage being proposed is minor and cannot be achieved by any other feasible method than a variance. 3. Town Law 4267-b(3)(b)(3). The variances granted herein for the proposed rear yard setback is mathematically substantial, representing 29% relief from the code. However, the ZBA previously granted this property a 25 foot rear yard setback for an open air deck in ZBA file #4207. The variance granted herein for the proposed lot coverage is not mathematically substantial representing 9%. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a covered porch and enlarged attached garage while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dantes , seconded by Member Schneider, and duly carried,to GRANT,the variances as applied for, and shown on the Architectural plans and site plan and prepared by Nancy L. Steelman dated December 3, 2015 and labeled SPI; EX1; 1; and 2. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance. • Rear yard setback: A portion of the existing Residence and Deck is within the 35' rear yard setback line. By reusing the existing deck, the setback is established for the new Screen Porch addition. Lot Coverage: The existing lot coverage of 17.61% would only allow an additional 309 square feet or 2.39% to the site. The additional lot coverage being proposed is 2.56% over the allowable 20%. The variance being sought is minor and cannot be achieved by any other feasible method. 3. The amount of relief requested is not substantial. Rear yard setback: The proposed Screen Porch roof addition will be built over an existing structure which is in a non-conforming location but received a variance in 1994. The additional area being proposed for the Screen Porch in the setback is 91 sf. This a minor request for a variance. Lot Coverage: The proposed increase in lot coverage is not substantial. The Garage addition adds a total of 245 sf or 1.88%. The proposed Screen Porch and Living Room addition adds a total of 396 square feet or 3.07% of lot coverage. These total increases in lot coverageare not substantial. 4. The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. The proposed additions to the existing residence, originally built in 1972, has not been updated other than the existing deck. The proposed Additions and Renovations will be in keeping with the existing neighborhood and will be substantially more modest than several houses that currently exist on Meadow Lane. The proposed setbacks and lot coverage variances, if granted, will not have an adverse effect on the physical or environmental conditions in the neighborhood. 5. The alleged difficulty has not been self-created. The new construction is the result of a pre-existing situation where the existing house and deck was located within the current non-conforming rear yard setbacks. There are no Covenants or Restrictions concerning this land. By this application, appellant has requested approval for the "as built" open deck reduction in the northerly yard for a 10 by 12-foot open deck. The extension which protrudes beyond the existing outer side wall of the existing dwelling is shown to be 5 to 5-1/2 feet, leaving a setback at 24-1/2 to 25 feet. 3. The code requirement for the rear yard setback on a nonconforming parcel in this R-40 Zone District is today (and since January 1989) set at 35 feet. The present rear yard of the dwelling, as built in 1972, is 30 feet (which is today also nonconforming) . 4. It is the position of the Board that the amount of relief requested for the five foot minimal deck area is not substantial. No other variances for insufficient setbacks are required for this property, as submitted. 5. In considering this application, the Board also finds: (a) there is no valid public purpose which outweighs the applicant's difficulties for a five-foot variance, and the size of the deviation is de minimus; (b) a substantial change will not be produced in the character of the neighborhood; (c) the difficulty cannot be obviated by some method feasible for the applicant to pursue other than another variance; (d) in view of the manner in which the difficulty arose and the fact that additional land area is not available, the interest of justice will be served by allowing the three-foot side yard reduction.
