SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated January 11, 2016 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The property is a non-conforming 1.45 acre parcel located in an AC district. The parcel runs 175.53 feet along Sound Avenue, 284.5 feet on the West side, 145.36 feet on the North side, and 347.47 feet on the East side. The parcel is wooded and the terrain is sloped; it is improved with (1) Masonry building, (1) frame cottage, (1) existing concrete foundation, and (4) existing frame sheds. All is shown on a survey by Lisa G. McQuilkin L.L.S. dated November 30, 2012 and last updated February 8, 2016. BASIS OF APPLICATION: Request for Variances from Article III Section 280-15 and the Building Inspector's September 18, 2015, amended December 8, 2015 Notice of Disapproval based on an application for building permit for construction of a new single family dwelling, an in-ground swimming pool, conversion of existing dwelling to pool house and legalize existing accessory garage, at; 1) proposed in-ground swimming pool location other than the code required rear yard, 2) convert existing cottage into proposed pool house and accessory garage location other than the code required rear yard. RELIEF REQUESTED: The applicant requests variances to convert an as built non-conforming dwelling into a pool house in a non-conforming front yard location and to construct a swimming pool in a non-conforming front yard location where code states that accessory buildings and swimming pools are required to be in a rear yard. The proposed construction will result in the as built accessory garage remaining in a non-conforming front yard location instead of the required rear yard. AMENDED APPLICATION: During the hearing, the applicant was asked to bring the plan into more conformity with the code. The applicant on February 10, 2016 submitted a revised survey. The survey shows that the Page 2 of 3—February 18,2016 ZBA#6918—Island Estate Group,LLC SCTM#1000-121-1-3 4 applicant removed the attached garage and workshop from the proposed residential structure. The applicant could build the attached garage and workshop as of right. This scales back the size of the project; however it does not bring the plan into more conformity with the code. ADDITIONAL INFORMATION: The subject parcel has a certificate of occupancy for a non-habitable garage and storage building on an existing foundation which was issued in 1986. At some point since then the storage building was converted into a dwelling. The dwelling is approximately 800 square feet in size where town code requires that dwellings contain at least 850 square feet of livable floor area. The Eastern neighbor's agent attended the meeting and voiced opposition to granting the variance. Another neighbor wrote a letter to the ZBA opposing the variance request. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on February 4, 2016 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law$267-b(3)(b)(1). Grant of the variances will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of larger lots with code conforming single family structures and accessory buildings in code conforming locations. The proposed front yard locations for the pool house and pool are not characteristic of the neighborhood. The existing accessory garage has been in place for almost 30 years and has the benefit of a valid certificate of occupancy. 2. Town Law$267-b(3)(b)(2). The benefit sought by the applicant for the pool and pool house can be achieved by some method, feasible for the applicant to pursue, other than an area variance. There is enough land for the applicant to build the pool in a conforming rear yard location. The applicant could convert the existing cottage into a legal dwelling therefore bringing the plan into more conformity with the code. The accessory garage is in a non- conforming location and any proposed re-development of the property would require the benefit of an area variance for the accessory garage. 3. Town Law $267-b(3)(b)(3). The variances proposed herein are mathematically substantial, representing 100% relief from the code for the proposed front yard location for the as built accessory garage. However, the as-built garage has the benefit of a certificate of occupancy in a non-conforming location. The request for the variances for the pool and pool house in a front yard location are mathematically substantial representing 100% relief from the code. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief for the as-built accessory garage is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory garage while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Grant of the requested relief for the pool and the pool house is not the minimum action necessary and adequate to enable the applicant to build a pool with pool house. The applicant has options to build a pool and accessory pool house in a code conforming location. Page 3 of 3—February 18,2016 ZBA#6918—Island Estate Group,LLC SCTM#1000-121-1-3 4 RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dantes, seconded by Member Schneider, and duly carried, to GRANT,the variance as applied for the accessory garage, and shown on the architectural plans prepared by Nancy Dwyer, Designer and dated December 16, 2015 and DENY as applied for the pool and pool house and shown on the architectural plan by Nancy Dwyer and dated December 1, 2015 and the survey prepared by Lisa G. McQuilkin L.L.S. dated November 30, 2012 and last updated February 8,2016. CONDITIONS: 1)The as built accessory garage must remain a non-habitable garage and may not be enlarged. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1)year terms. No. 4596 — BERYL CAFFREY PARCEL 1000-121-2-4 STREET & LOCALITY: 9395 Sound Avenue, Mattituck DATE OF PUBLIC HEARING: August 13, 1998 FINDINGS OF FACT PROPERTY FACTS/DESCRIPTION: The above-referenced property is located along the northerly side of Sound Avenue, Mattituck. A May 4, 1966 survey submitted under this application shows that the, subject premises contains a total area of 1.913 acres improved with the former accessory garage frame garage building, and existing 2-1/2 story frame dwelling and accessory patio area to the north of the dwelling. The July 7, 1998 survey shows the new accessory frame garage- workshop building built under Building Permit No. 22394 issued 10/17/94. The subject building is 45.2 feet by 24.2 feet in size, and is located 36.1 feet from the northerly rear property line and 17.4 feet from the westerly side property line (LILCO). BASIS OF APPEAL: Building Inspector's July 20, 1998 Notice of Disapproval which reads as follows: "Under Article IIIA, Section 100-30A.4 the lot area of 84,400 sq. ft. + or — in the R40 Zone requires all accessory structures to have a minimum of 20 ft. set back from the side or rear lot lines. Garage is at 17.4 ft. from side lot line." AREA VARIANCE RELIEF REQUESTED BY APPLICANT: The request made by applicant for approval of a small portion of the southwesterly corner of the building, as built at 17.4 feet from the side, instead of the required 20 ft. DESCRIBED BELOW: (1) The granting of the area variance will not produce an undesirable change in character of neighborhood or a detriment to nearby properties because a very minor part of the corner (about 3 sq. ft.) protrudes into the setback area, but does not affect other properties or uses. (2) The benefit sought by the applicant cannot be achieved by some method, feasible for applicant to pursue, other than an area variance because the construction has been completed and inspected, and applicant has filed a request. for a Certificate of Occupancy with the Building Department. (3) The requested area variance is not substantial. (4) The proposed variance will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. (5) The small corner under consideration is built and therefore self-created. In considering this application, the Board deems this action to be the minimum necessary and adequate, and at the same time preserves and protects the character of the neighborhood, and the health, safety, welfare of the community.
