SUPERVISOR RUSSELL: Please rise and join in the Pledge to the Flag. Thank you. Before
we get to the regular business of the agenda, I would like to take a few minutes to recognize
someone who is actually been one of the most critical employees this town, in my 25 years of
service, has seen. He has done everything we have asked of him, he is a dedicated, I mean, I
have never seen anyone so dedicated to their job in my life and that includes me, Phillip. I can't

speak enough on what you have done for this town. It's astounding to me and I have to tell you,
it's a huge loss for me. I am not sure I can be half the Supervisor I can be without you in the
office. But that's, we are going to have to cast to the wind. Please come up. `Whereas the
Town Board of the Town of Southold wishes to recognize Phillip Beltz, a most dedicated
employee as he retires from his position as Special Projects Coordinator after 12 years of service
to Southold Town and whereas Phillip's long list of accomplishments include being in the
forefront of bringing Affordable Housing to the Town, re-establishing the Youth Bureau,
organizing countless beneficial employee trainings and services and whereas Phillip is a fine
example of leadership and in addition to his regular duties he has been appointed to a significant
position of Deputy Supervisor for three terms, Whereas Phillip has generously volunteered his
time on various committee's within the Town including Economic Development, Youth Bureau,
Housing Advisory Commission and Whereas Phillip has provided faithful service to the residents
of Southold Town with his wealth of institutional knowledge, kind-hearted spirt and Whereas
Phillip has become part of the fabric of Southold Town government and his dedication deserves
the sincere gratitude of those with whom and for he has served Now Therefore be it resolved that
the Town Board of the Town of Southold hereby extends their sincere appreciation and wishes
Phillip a healthy, happy and prosperous retirement.' That is on behalf of myself, the entire Town
Board and Elizabeth Neville. Like I said, I don't....

SUPERVISOR RUSSELL: And let me just say quickly, it's not just your commitment to the
job, it's the commitment to the people of this town. A genuine, caring individual. So, we are
going to miss you. Okay, I am going to at this time let anybody that would like to address any
item that's on the agenda to please feel free.

JILL FRANKE: Jill Franke, Southold. On the Forestbrook trail, that's specifically for horses,
correct?
SUPERVISOR RUSSELL: Yes.
MS. FRANKE: Okay, thanks again.
SUPERVISOR RUSSELL: It's actually a pretty large preserve, so we talked today about maybe
creating a separate trail for hikers or something. We have plenty of time to work those things out
but as it is drafted it is just for horses.
MS. FRANKE: Okay, because I didn't see anything on there about horses.
COUNCILWOMAN DOHERTY: What Scott is saying is in the future we might work out a
schedule for hikers, walkers but for now we are just getting it done so we can open it up for you.

Windrow Turner Bid Acceptance
WHEREAS two (2) bids were received in response to the Town's bid advertisement of August
20, 2015 for a self-propelled windrow turner for the Cutchogue Compost Facility; and
WHEREAS the bid received by Ecoverse Industries is out of compliance with no fewer than
seven (7) critical specifications issued by the Town for such equipment, and in addition fails to
demonstrate compliance in at least six (6) other critical and/or important specifications as issued
by the Town, and further did not include all information required for consideration as a complete
response to the Town's solicitation; it is hereby
RESOLVED that the Town Board of the Town of Southold hereby rejects the bid of Ecoverse
Industries to supply the Solid Waste Management District with a self-propelled windrow turner
as it does not meet the Town's specifications for said equipment; and, it is further RESOLVED
that the Town Board accepts the bid of Simplicity Engineering, Inc. for such equipment at a cost
of$484,000, all in accordance with the approval of the Town Attorney.

WHEREAS, Section 485-b of the New York State Real Property Tax Law was amended
effective January 1, 1995 to provide exemption from real property tax and ad valorem levies for
certain business investments in order to provide for economic resurgence within the State of New
York and increased total assessed value of real property; and

boards in order to strategically target tax abatements to those industries and geographic areas
considered to have the highest potential for successful development; and
WHEREAS, the Suffolk County Legislature by Resolution No. 48-1995 adopted Local Law No.
9-1995 establishing the Suffolk County Industrial/Commercial Incentive Board (SCICIB); and
WHEREAS, the SCICIB is charged with the preparation of a Plan for consideration by the
Suffolk County Legislature that will define strategic geographic areas and businesses that will be
eligible for real property tax exemption pursuant to applicable State Law; and
WHEREAS, on September 1, 1998, by Resolution No. 12-1998, and on July 3, 2012, by
Resolution No. 12-544 the Town Board elected to participate in the County Program and to offer
the incentive program to eligible local businesses; and
WHEREAS, the Town Board has determined that Heather Lanza, Town Planning Director, shall
be a member of the SCICIB; now, therefore, be it

Elect to Purchase Walker/McCall, LLC Dev Rights Easement
WHEREAS, the Town Board of the Town of Southold held a public hearing on the question of
the purchase of a development rights easement on a certain parcel of property owned by
Walker/McCall LLC on the 20th day of October, 2015, at which time all interested parties were
given the opportunity to be heard; and
WHEREAS, said property is identified as SCTM #1000-115.-8-3.6. The address is 21140 Main
Road (NYS Route 25) in Mattituck. The property is located in the Agricultural-Conservation
(A-C) Zoning District and situated on the southerly side of Main Road (NYS Route 25)
approximately 820 feet easterly from the intersection of Locust Avenue with Main Road (NYS
Route 25) in Mattituck,New York; and
WHEREAS, the proposed acquisition is for the purchase of a development rights easement on a
3.8863 acres. The 3.8863 acre area is part of a 28.6496 acre farm on which 24.5418 acres are
subject to a Deed of Development Rights dated the 25th day of August, 2003, between John Elak
and the Town of Southold and recorded in the Suffolk County Clerk's Office in Liber
D00012273 at Page 138 on September 19, 2003. The 3.8863 acre area was excluded from the
recorded 2003 Deed of Development Rights; and
WHEREAS, federal monies obtained through a United States Department of Agriculture -
Natural Resources Conservation Service ("NRCS") grant#73-2C31-02-671 were used to fund
part of the 24.5418 acre acquisition in 2003. The metes and bounds description in the 2003
easement will be modified to include the additional 3.8863 acres. NRCS has approved this
modification, as required under the easement. In addition, NRCS has recognized the addition of
3.8863 acres to the existing easement area as an acceptable donation of an interest in real

property by the Town to NRCS under the NRCS draft gift acceptance policy. Such a donation is
further authorized by the New York State Constitution; and
WHEREAS, the 3.8863 acre easement will be acquired using Community Preservation Funds.
The purchase price is $65,000 (sixty-five thousand dollars) per acre for the 3.8863 acre easement
plus acquisition costs; and
WHEREAS, the property is listed on the Town's Community Preservation Project Plan as
property that should be preserved due to its agricultural value; and
WHEREAS, the purchase of the development rights on this property is in conformance with the
provisions of Chapter 17 (Community Preservation Fund) and Chapter 70 (Agricultural Lands
Preservation) of the Town Code, and
WHEREAS, the proposed action has been reviewed pursuant to Chapter 268 (Waterfront
Consistency Review) of the Town Code and Local Waterfront Revitalization Program
("LWRP") and the LWRP Coordinator has recommended that this action is consistent with the
LWRP; and
WHEREAS, the Land Preservation Committee has reviewed the application for the acquisition,
and recommends that the Town Board acquire the development rights easement; and
WHEREAS, the Town Board deems it in the best public interest that the Town of Southold
purchase the development rights on this agricultural land; and,
WHEREAS,the Town Board of the Town of Southold classifies this action as an Unlisted
Action pursuant to the SEQRA Rules and Regulations, 6NYCRR 617.1 et. Seq.; and,
WHEREAS, the Town of Southold is the only involved agency pursuant to SEQRA Rules and
Regulations; and,
WHEREAS, the Town Board of the Town of Southold accepted the Short Environmental Form
for this project that is attached hereto; now, therefore, be it
RESOLVED that the Town Board of the Town of Southold hereby finds no significant impact
on the environment and declares a negative declaration pursuant to SEQRA Rules and
Regulations for this action; and be it further
RESOLVED that the Town Board of the Town of Southold hereby elects to purchase a
development rights easement on agricultural land owned by Walker/McCall LLC, identified as
SCTM #1000-115.-8-3.6. The proposed action has been reviewed pursuant to Chapter 268
(Waterfront Consistency Review) of the Town Code and the LWRP and the Town Board has
determined that this action is consistent with the LWRP.

SUPERVISOR RUSSELL: Yes with a comment. Mr. McCall has made a substantial
commitment to preservation around that area. I know the acreage doesn't seem substantial in this
particular case but if you look at the site location, it is a substantial piece and a key piece for
preservation. I want to thank him for his historic and ongoing commitment.

COUNCILMAN GHOSIO: NOTICE IS HEREBY GIVEN that pursuant to the provisions of
Chapter 17 (Community Preservation Fund) and Chapter 70 (Agricultural Lands) of the Town
Code, the Town Board of the Town of Southold hereby sets Tuesday, October 20, 2015, at 4:32
p.m., Southold Town Hall, 53095 Main Road, Southold, New York as the time and place for
a public hearing for the purchase of a development rights easement on property owned by
Walker/McCall, LLC. Said property is identified as SCTM #1000-115.-8-3.6. The address is
21140 Main Road (NYS Route 25) in Mattituck .The property is located in the Agricultural-
Conservation (A-C) Zoning District and is situated on the southerly side of Main Road (NYS
Route 25), approximately 820 feet east of the intersection of Locust Avenue with Main Road
(NYS Route 25) in Mattituck, New York. The proposed acquisition is for a development rights

easement on 3.8863 acres. The 3.8863 acre area is part of a 28.6496 acre farm on which 24.5418
acres are subject to a Deed of Development Rights dated the 25th day of August, 2003, between
John Elak and the Town of Southold and recorded in the Suffolk County Clerk's Office in Liber
D00012273 at Page 138 on September 19, 2003. The 3.8863 acre area was excluded from the
recorded 2003 Deed of Development Rights.
Federal monies obtained through a United States Department of Agriculture -Natural Resources
Conservation Service ("NRCS") grant#73-2C31-02-671 were used to fund part of the 24.5418
acre acquisition in 2003. The metes and bounds description in the 2003 easement will be
modified to include the additional 3.8863 acres. NRCS has approved this modification, as
required under the easement. In addition,NRCS has recognized the addition of 3.8863 acres to
the existing easement area as an acceptable donation of an interest in real property by the Town
to NRCS under the NRCS draft gift acceptance policy. Such a donation is further authorized by
the New York State Constitution.
The 3.8863 acre easement will be acquired using Community Preservation Funds. The purchase
price is $65,000 (sixty-five thousand dollars) per acre for the 3.8863 acre easement plus
acquisition costs.
The property is listed on the Town's Community Preservation Project Plan as property that
should be preserved due to its agricultural value.
FURTHER NOTICE is hereby given that a more detailed description of the above mentioned
parcel of land is on file in Land Preservation Department, Southold Town Hall Annex, 54375
Route 25, Southold,New York, and may be examined by any interested person during business
hours.
I do have here a signed affidavit that this hearing had been noticed and affixed in a proper and
substantial manner on the Town clerk's bulletin board here in Southold and that is notarized. I
also have here a copy of the legal notice that appeared in the Suffolk Times dated October 15,
2015 and I do have here a memorandum from Principal Planner Mark Terry concerning the
LWRP 'the proposed action is consistent with the policy standards and therefore is consistent
with the LWRP.' That's it.

SUPERVISOR RUSSELL: Would anybody like to address the Town Board on this particular
local law?
Melissa Spiro, Land Preservation Coordinator
MELISSA SPIRO: Melissa Spiro, Land Preservation Coordinator. As we just heard, this is a
small farm but it is surrounded by a larger, protected farm so it will be 28 acres when the town
purchases these development rights. The current landowner applied to the town for the town to
purchase the development rights on what was the excluded area and that's what the subject of the
hearing is tonight. In 2003, the subject area was designed and set back from the road and pretty
much surrounded by the preserved land at that time. the area is made up of prime soils and it is
and I believe it always has been farmed as one, so it was cut out as a separate area but not in

farming. The Committee reviewed the location and the design and for this particular property,
the Land Preservation Committee supports the elimination of this development area. The towns
purchase of the development rights will eliminate the development area and it will result in the
entire just over 28 acre farm for agricultural purposes. The town received federal grant funds
towards the 2003 purchase, the town is not receiving grant funds towards the purchase of this 3.8
acre area. As noted, Community Preservation Funds will be used for the town's purchase. In
2003, John Elak worked with the Peconic Land Trust and recorded an overlay deed of
conservation easement for the purpose of adding additional terms for preserving and protecting
the property's scenic open space and agricultural value. The currently landowner, Russ McCall,
is also working with Peconic Land Trust to amend that easement to include the 3.8 acre area and
to add additional terms. Luke from Peconic Land Trust is here and he is going to address those
additional points. Thank you.

LUKE MCKAY: Luke McKay, Peconic Land Trust. As Melissa mentioned, back in 2003 in
addition to selling the development rights to the town, the Elak's voluntarily donated an overlay
conservation easement further protecting entire farm to the Peconic Land Trust. Although
reinforcing many of the restrictions at the town easement, the trust overlays also restricted the
farm to no more than 10 percent coverage by agricultural structures and no more than 10,000
square feet of greenhouses. Since the trust overlay easement covers the entire farm, the entire 28
acre farm, including the 3.8 acre portion the town is proposing to purchase the development
rights from, the trust has to amend its overlay easement to account for this change. As part of
that amendment process, the current landowner Russ McCall is voluntarily further restricting the
farm by limiting agricultural structures to 2 percent of the farm which is approximately half an
acre and donating an affirmative farming covenant that restricts certain agricultural uses and
requires the farm to remain in active, agricultural production, primarily food production, in
perpetuity. Thank you.

Linda Ruland Executive Director, CAST
LINDA RULAND: Good afternoon, Supervisor Russell and Town Board members. My name is
Linda Ruland and I am the executive director of CAST, Community Action Southold Town.
CAST is a not for profit anti-poverty organization whose mission is to promote self-sufficiency
and to provide a safety net for residents in need. CAST serves all of Southold Town from Laurel
to Orient and Fishers Island. CAST provides emergency food banks for clients in crisis, also a
monthly food bag for those who need it. Other services that CAST provides are referrals and
advocacy, housing assistance, education, classes for ESL, tutoring and most recently, computer
training for those who wanted to enter the workforce and be able to provide for their own
families. We are so grateful to you for supporting CAST over these past years. So far this year,
our food pantry has provided over 2,100 bags of food for seniors and families that include over
400 children. We have welcomed 113 new clients since January, so you can see that food
scarcity is still a problem for many of our town residents. We are also seeing a rise in our
homeless population, who come to CAST for food as well as warm clothing to withstand the
cold nights on the streets. Since I have become CAST's executive director, I have witnessed the
generosity of our community. From the young students of the Mattituck-Cutchogue and
Southold school districts, to the businesses and to the Clubs such as Greenport Rotary, CAST has
been the recipient of many food items and donations but unfortunately it is not enough to provide
the needed food for our struggling neighbors. Your help from the Community Block Grant is of
vital importance to sustain the needed resources for our clients. I am asking you to consider a
grant to CAST for our food pantry. Thank you again for your help in the past, and your
consideration again this year. We are grateful for any assistance that you can offer to us, as
together we continue to be neighbors helping neighbors in this beautiful community we all call

Maryann Gensler, Maureen's Haven Outreach Program
MARYANN GENSLER: Good afternoon, my name is Maryann Gensler and I live in Southold
and I am the interim executive director of Maureen's Haven Homeless Outreach program.
Thank you for the opportunity to address you today in order to request funding for our program,
which is operated under the auspices of the Peconic Community Council. The goal of Maureen's
Haven is to provide safe, warm, free shelter for homeless individuals from November through
March, utilizing volunteer houses of worship and congregation volunteers. The host facilities
and supporting organizations provide much more than a place to sleep and a nutritious dinner
and breakfast. They provide support through embracing the values of human dignity, respect,
service, compassion, teamwork, diversity and love. Now entering its 15th season of service, the
program provides shelter and supportive services five nights a week in partnership with 15
houses of worship, 17 supporting houses of worship and community organizations and over
1,500 individual volunteers providing an estimated 20,000 h ours of service each winter season.
Peconic Community Council is responsible for screening and transporting the homeless guests to
the host facilities each night. Pickup locations are in Riverhead, Hampton Bays and Greenport,
as well as various locations in the Hamptons and throughout the North Fork. Last winter we
served 242 individuals over 152 nights. Our average number of guests per evening was 50 with
a high of 82. Overall, 7,638 beds were made for the season. Of that total, 82 % were male and
18 % were female. It is important to note that due to the ever declining economy, the number of
homeless has risen and the working corps are included in our guest list. In an effort to provide
services to the homeless in Southold Town, we have partnered and collaborated with five houses
of worship, Southold Presbyterian, St. Patrick's Roman Catholic Church, Sacred Heart Roman
Catholic Church and St. Peter's Lutheran Church in Greenport who graciously host our guests
for the overnight program and also in that was, unfortunately, Southold Unitarian which of
course you know burnt down but St. Peter's has graciously offered to host those guests for the
evening that they took, so we are very appreciative of the past support we have received from the
Town of Southold and are respectfully requesting funding once again in support of our program.

LINDA GOLDSMITH: Linda Goldsmith, East Marion. I just wanted to ask you a question on
resolution 2015-872, it's a position of guard for the solid waste management district. What
hours are they?
SUPERVISOR RUSSELL: They generally work weekends. It is to oversee the re-use center.
The area where people can bring in used, rather than throwing it away. It is encouraging re-use
of things that people don't need and it's generally on the weekends.
MS. GOLDSMITH: And I have a second question. In my travels in the last few weeks I have
been asked by a number of people, I guess probably about a year ago, people were asking about
videotaping some of the other meetings in Southold Town, especially the work sessions because
sometimes you get here at 5:00 and you are all done and the work takes place at the work session
as it rightly should and I think you had said or some of you had said that they were going to look
into having students from one of the schools try to do that but I think it has been over a year and
I am wondering if there has been any progress made on that? and I understand that doing every
meeting might become cumbersome if you did ZBA and the Planning Board but specifically I
was asked about the work sessions and I don't know where that is.
SUPERVISOR RUSSELL: Are you familiar with the fact that we had already been doing that?
Work sessions were being broadcast on channel 22?
MS. GOLDSMITH: Were they still being...
SUPERVISOR RUSSELL: Well, we ran into technical difficulties which I am going to defer to
Jim now to explain.
COUNCILMAN DINIZIO: We were experimenting on how to do it with the least amount of
manpower.
MS. GOLDSMITH: Yes.
COUNCILMAN DINIZIO: The schools, we had a couple of meetings, I had a couple of
meetings with them and it would have been difficult to get anybody to commit themselves to that
type of schedule. Even the students, they have other commitments and they seem to drop out. It
was very difficult. As I said, we had those discussions. So what I have been doing is we have
been recording them into the device we have down in the basement and then shipping them over
but the audio was always just not right. You couldn't, all you basically saw was a bunch of
people around a table, sometimes it was too high, sometimes it was too low. Sometimes those
fans would get in the way. The whole thing is, I learned as we did it. We put $5,000 in the
budget to wire the place correctly, put cameras in this room and the other meeting room next to
the Supervisor's office, if he chooses, and just try to work it from there.
MS. GOLDSMITH: I think that's probably where the questions were coming from then. I knew
that they had been aired for a while and I do think once in a while your audio for this meeting is
pretty sad, too, I have to tell you.

COUNCILMAN DINIZIO: Yes.
MS. GOLDSMITH: Sometimes it is non-existent but I am glad to hear that because I didn't
think it would work with students, especially if you have work sessions during the day. It's very
difficult to keep people committed year after year and month after month and I knew that some
had been aired but I didn't know really why they had stopped and I should have asked you
earlier, so now I have my answer.
COUNCILMAN DINIZIO: Well, technically it was very cumbersome.
MS. GOLDSMITH: I can understand.
COUNCILMAN DINIZIO: We are working the bugs out and we will work the bugs out.
MS. GOLDSMITH: So the Town Board is working on it, without worrying about having to go
to a high school student or something to that effect.
COUNCILMAN DINIZIO: Yes.
MS. GOLDSMITH: Okay, thank you.
COUNCILMAN GHOSIO: It should be noted that we are talking about, the remedies that we
have are dealing with the equipment that we currently have, which tends to be older and not up
to date technology wise but at least we will be able to get something going.

JILL FRANKE: Jill Franke. Not to bring up a bug/chicken debate again but Jill, thank you for
handing out reusable bags. I don't have a position either way, I usually end up leaving mine
home but, and I wanted to thank you all for doing the horse trails. As you all know, there's
nothing in Southold Town for horse owners, there's really nothing at all so it's a giant step
forward. Thank you.
SUPERVISOR RUSSELL: Who else would like to address the Town Board?
Darren Finley, Ecoverse
DARREN FINLEY: Ladies and gentlemen of the Board, my name is Darren Finley. I work
with the company Ecoverse. We were the low bid on the windrow turner. I would like to make
a statement on your award of the turner. I have attended a few of your meetings with admiration
of how you are taking your time and cost saving, eco-friendly measures and innovative, new
technologies. This is why I am at a loss on your decision. we had bid a turner capable in size
and power, with more innovation technology than the awarded bid. Our cost of operation is
lower due to our modern tier 4 engines fuel consumption, resulting in a lower carbon footprint.
It was practically impossible to meet the bid spec exactly, when the bid spec is a carbon copy of
the specific manufacturer. We had minor deviations which could be justified with engineering
rationale and with the difference of cost of$96,500 this clearly isn't justified. I don't understand
why we were invited to demonstrate and bid when clearly the decision of what to purchase was

made before this. Ecoverse will be in contact with the town on further action. Thank you for

Actually what I do want to mention and I forgot to, every year I do a presentation on the budget
with a power point to show you the cost. I am doing that actually the 27th of October, here at the
meeting hall at 6:00. Oh, yes, and the Affordable Housing forum is going to be Thursday, that's
at 6:00 right here in the meeting hall. This Thursday.
COUNCILMAN GHOSIO: And tomorrow night, at 5:00 over here at Silversmith's corner, we
are going to be having a 375th Anniversary event where we are going to be burying a time
capsule, so of course, everybody is invited to that as well.
COUNCILMAN DINIZIO: Scott, the housing forum is going to be recorded, right?
