SCTM# 1000-64-1-30.2 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my determination that the proposed actions are INCONSISTENT with the below listed LWRP policies 5, 6 and 9.3 and therefore is INCONSISTENT with the LWRP: What is the purpose of lights, water and electricity for a kayak dock? Policy 5 Protect and improve water quality and supply in the Town of Southold. Policy 6 Protect and restore the quality and function of the Town of Southold ecosystem. MLLW at the end of the dock is shown as 12 inches. There is no restriction offered on vessel size in the future. Policy 9.3 Preserve the public interest in and use of lands and waters held in public trust by the state and the Town of Southold. A. Limit grants, leases, easements, permits or lesser interest in lands underwater in accordance with an assessment of potential adverse impacts of the proposed use, structure, or facility on public interest in public lands under water. Use the following factors in assessing potential adverse impact: The proposed, permanent, private, dock structure will further extend into public waters resulting in a net decrease in public access to public underwater lands and the nearshore area. The applicant currently enjoys access to public waters via a public launching ramp accessing Town Creek at the end of Terry Lane. BENJAMIN & SIOBHAN MORDEN 801 MAPLE LANE SOUTHOLD,NY SCTM#1000-64-1-30.2 Statement of Effect Although floating dock structures are common along the shorelines of Town Creek to the immediate south,the subject property is located near the northerly end of the most northeast arm of Town Creek where the water shallows significantly and vegetated tidal wetlands are abundant to the north of the project site. Therefore, the proposed"kayak dock" is intended to provide a fixed point of elevated structural access over the existing vegetated intertidal marsh to allow for dockage and use of small watercraft, such as a kayak, canoe, or dinghy in water that is too shallow during low tide to accommodate a floating dock or large boats. Without such a fixed point of structural access, small watercraft would have to be dragged through the marsh,thus creating the potential for the loss of wetlands vegetation along the shoreline. Many similar fixed docks/walkways have been approved by the Board of Trustees throughout Richmond Creek where similarly shallow waters are common, and a similarly configured dock structure proposed for the subject property was approved by the Trustees in 2006 pursuant to Town Wetlands Permit No. 6369. In order to mitigate any potential impact of the project on the adjacent tidal wetland area and Town waters,the proposed dock structure has been designed with the minimal scope necessary to reach a water depth of one foot at mean lower low water at its seaward end and to provide access to its landward end from the existing foot path along the shoreline. The dock will be constructed with 4"x 4" posts and open-grate decking and would be elevated a minimum of 3.5' above the grade of intertidal marsh. And further consistent with §275- 11(C)(2),the dock will be located no closer than 15 feet from the property line; will extend less than one-third the width of the waterway; and will contain only one handrail. EXI Yes n No Not Applicable LWRP CONSISTENCY ASSESSMENT FORM ADDENDUM FOR BENJAMIN & SIOBHAN MORDEN 801 MAPLE LANE SOUTHOLD,NY SCTM#1000-64-1-30.2 Policy 6 Although floating dock structures are common along the shorelines of Town Creek to the immediate south, the subject property is located near the northerly end of the most northeast arm of Town Creek where the water shallows significantly and vegetated tidal wetlands are abundant to the north of the project site. Therefore, the proposed"kayak dock" is intended to provide a fixed point of elevated structural access over the existing vegetated intertidal marsh to allow for dockage and use of small watercraft, such as a kayak, canoe, or dinghy in water that is too shallow during low tide to accommodate a floating dock or large boats. Without such a fixed point of structural access, small watercraft would have to be dragged through the marsh,thus creating the potential for the loss of wetlands vegetation along the shoreline. Many similar fixed docks/walkways have been approved by the Board of Trustees throughout Richmond Creek where similarly shallow waters are common, and a similarly configured dock structure proposed for the subject property was approved by the Trustees in 2006 pursuant to Town Wetlands Permit No. 6369. In order to mitigate any potential impact of the project on the adjacent tidal wetland area and Town waters,the proposed dock structure has been designed with the minimal scope necessary to reach a water depth of one foot at mean lower low water at its seaward end and to provide access to its landward end from the existing foot path along the shoreline. The dock will be constructed with 4"x 4"posts and open-grate decking and would be elevated a minimum of 3.5' above the grade of intertidal marsh. And further consistent with §275- 11(C)(2),the dock will be located no closer than 15 feet from the property line; will extend less than one-third the width of the waterway; and will contain only one handrail. For all of these reasons,the dock would not cause a"fragmentation of ecological communities;"result in the physical loss, degradation, or functional loss of ecological components or otherwise adversely impact the wetlands or tidal waters of the Town; and will meet the statutory and regulatory requirements of Town Code Chapter 275 and New York State ECL, Article 25, Tidal Wetlands Act.
