The original house was constructed(started in 1986)still under construction in 1989 (see attached Jaeger survey Exhibit _A ) and received a c.o. in 1991 (attached exhibit_B ). The house is located at approximately 75 feet from the bulkhead The under construction survey shows a patio, but the patio was replaced with a wood deck by the prior owners. That deck is being replaced with the proposed raised stone patio and swimming pool. The numerous properties on Albacore Drive and Blue Marlin Drive have obtained setbackvariances from the Bulkhead for additions, decks, hot tubs and swimming pools. In one of the many appeals, appeal # 4365 in 1996 for Joseph A. Pottgen the Board listed the neighboring setbacks on Blue Marlin Drive, and noted that while the variance relief requested was considered substantial, nevertheless, the board found that the setback request was similar to those setbacks generally existing in the neighborhood (Attached Exhibit C )The neighborhood remains developed by homes with decks and accessory structures which are less then 75 to the bulkhead The setback of 50 feet from the bulkhead includes a 5'raised walkway along the northerly and southerly side of the swimming pool giving access around the swimming pool. The swimming pool is only 16'in width. A very strong effort was made to limit the size of the swimming pool with the minimum safe walkway around the pool to conform to the existing character and development of the community,at 50'from the bulkhead The plans of the pool and decking were redesigned several times,prior to making the application, in order to conform to the 20%lot coverage and to maximize the setback The swimming pool is proposed at 55' from the bulkhead with only a 5 foot walkway around the northerly side of the pool. (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: The property slopes gradually towards the water, the house is elevated, so the proposed stone patio and pool will be raised above the grade approximately 3'11"for a level area. The walkways around the proposed pool are the minimum which provide a safe and comfortable area around the pool for the applicant and his family. Castillo landscaping has provided the proposed plans for the project (attached as exhibit DJ (3) The amount of relief requested is not substantial because: The house is at 75'from the bulkhead, therefore any improvements on the waterfront side of the house will require a variance. The applicant has requested the minimal variance feasible. (4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The raised patio and pool will comply with the Town drainage code and the property already maintains a non-turf(gravel) area landward of the bulkhead with a second stone retaining wall landward of the non-turf area and bulkhead The Southold Shores canal is a man made canal with homes which have been developed with bulkheads. (5) Has the alleged difficulty been self-created? ( )Yes, or (X)No The house was constructed at 75'from the bulkhead with a "brick patio" in 1986. At some point the patio was replaced with a wood deck. The proposed application replaces the existing deck(of unknown date and without a permit)with the proposed raised stone patio. The Board of Southold Town Trustees has issued a Waiver under the Wetlands Regulations of the Southold Town Code at its September. 28, 1995 meeting for a 1,000 square ft. deck. 8. It is the position of this Board in considering this application: (a) the relief requested for a setback at 50, 51 or 52 feet is not the minimum necessary to afford relief, and the alternative is more reasonable under the circumstances of the area; (b) the setback granted is substantial at 22 feet less than the requirement, or 29%; however, this setback is similar to those generally existing in the neighborhood, as noted above; (c the variance requested is not self-created; (d) the relief, as alternatively granted, will not create a substantial change in the character 'of the neighborhood along this bulkhead and waterway, and although there will be a minor visual effect, there will not be an adverse detriment created in the neighborhood or district for the type of construction (restricted herein for an open deck); Page 3 - Appl.
