JOHN FISCHETTI and DEBORAH DEAVER #6854 SCTM# 1000-86-2-1.2 JOHN FISCHETTI and DEBORAH DEAVER#6854 - Request for Variance from Article III Section 280- 14 and the Building Inspector's March 3, 2015 Notice of Disapproval based on an application for building permit for additions and alterations to an existing single family dwelling, at; 1) less than the code required minimum front yard setback of 60 feet, located at: 2615 Wells Road (adj. to Richmond Creek) Peconic, NY. SCTM#1000-86-2-1.2 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my determination that the proposed action is INCONSISTENT with the below listed LWRP polices and therefore INCONSISTENT with the LWRP: Policy 4.1. Minimize losses of human life and structures from flooding and erosion hazards."The following management measures to minimize losses of human life and structures from flooding and erosion hazards are recommended: specifically A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. A portion of the structure (new swimming pool) is located within the FEMA Flood Zone AE El 6; an area of Special Flood Hazard and could be subject to flooding. An area is also specified to be filled on the plan however no other details are provided. It is recommended that the structure be relocated to outside of the AE flood zone to prevent future structure loss. Note that the test hole was drilled at 7' elevation and water was encountered at 6.1' feet below the surface. The new swimming pool • location is proposed in an area below the 7' elevation and it is unclear if the pool bottom will sit in standing water. Policy 6.3 Protect and restore tidal and freshwater wetlands. E. Maintain buffers to ensure that adverse effects of adjacent or nearby development are avoided: 1. Maintain buffers to achieve a high filtration efficiency of surface runoff The plan shows an area in the southeast of the parcel as "existing trees and vegetation to be removed". 2. Avoid permanent or unnecessary disturbance within buffer areas. 3. Maintain existing indigenous vegetation within buffer areas. If the action is approved, it is recommended that a perpetual Natural Vegetation Buffer, 15 feet in width be required landward from the wetland line. The buffer should incorporate all existing, beneficial vegetation. Pursuant to Chapter 268, the Southold Town Zoning Board of Appeals shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action Cc: Stephen Kiely, Assistant Town Attorney if- Office Location: ,IIiOolF S00:6 ` Mailing Address: Town Annex/First Floor,Capital One Bank ~ 53095 Main Road iiis 54375 Main Road(at Youngs Avenue) . - ; P.O.Box 1179 Southold,NY 11971iQ/ Southold,NY 11971-0959 ,gE [ivf '• Rhttp://southoldtown.northfork.net D - BOARD OF APPEALS MAR 2.015 TOWN OF SOUTHOLD —Southold southoltlTown _II Tel. An undesirable change will not be produced in the CHARACTER of the neighborhood for a detriment to nearby properties if granted. The proposed addition is characteristic of other residential properties in the neighborhood in scale, design and setbacks to the street. 2. The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance. A portion of the existing building structure is within the 60' front yard setback line. The j ; existing building structure was built prior to zoning and has not been renovated or 1, improved since it was built. The proposed construction maintains the existing . building setback and renovates and updates the structure to bring the structure to I meet current building codes. 3. The amount of relief requested is not substantial. The proposed addition will be built over an existing structure which is in a non-conforming location: The house will be reconstructed within the existing footprint, with modest and appropriate expansions. The existing main entry into the residence is adjacent to I the front yard setback. The new addition to the residence is in the area of the ! ' existing main entry. The new addition and new entry into the residence is +/- 3 1/2 feet in front of the existing building structure. The new covered entry porch is extending into the front yard setback by 3 1/2 feet. 4. The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. The new I i construction is mostly within the existing footprint of the building. The proposed construction will retain all rain water on site via new drywells and comply with all best management practices for storm water run off during construction. In keeping with requirements of the Southold Trustees, State DEC and County Health Department, it will include a new updated conforming sanitary system. 5. The alleged difficulty has not been self-created. The new construction is the result of a pre-existing situation where the existing house was located within the ; I setback prior to zoning. ! ; - r There are no Covenants or Restrictions concerning this land. Prior to construction, the I { project must also be approved by the Trustees, NYSDEC and SCDHS. This is the MINIMUM that is necessary and adequate, and at the same time preserve and protect the character of the neighborhood, and the health, safety, and welfare of the community. The variance requested is the minimum relief practicable given the personal benefits anticipated by the applicant. The renovation is needed to maintain the I j investment and the proposed expansion is modest in scope and scale. We respectfully request that the appeal be granted, together with any further relief that is deemed necessary and reasonable. Box 416, East Marion, NY 11939 At a Meeting of the Zoning Board of Appeals held on May 27, 1983 - the above appeal was considered, and the action indicated below was taken on your [ ] Request for Variance Due to Lack of Access to Property New York Town Law, Section 280-a [ ] Request for Special Exception under the Zoning Ordinance Article , Section IX)! Request for Variance to the Zoning Ordinance Article III , Section 100-32 S C I ] Request for Upon application of HENRY PIERCE, 2615 Wells Road, Peconic, NY for a Variance to the Zoning Ordinance, Article III, Section 100-32 for permis- sion to construct accessory storage building in the front and side yard area at 2615 Wells Road, Peconic, NY; County Tax Map Parcel No. 1000- 086-02-1.2. The board made the following findings and determination: By this appeal, appellant seeks to construct a 36' by 30' accessory two-car garage structure approximately 160 feet north of the existing one-family dwelling and 35 feet from Wells Road. For the record it is noted that the N.Y.S. Department of Environmental Conservation has restricted the proposed construction to an area a minimum of 75' from tidal wetlands as shown in Permit #10-83-0014 TW issued March 24, 1983. Inasmuch as the land in question is partly meadowland, there is minimal practical building area, and the board does agree with reasoning of appellant. In considering this appeal, the board determines that the variance request is not substantial; that the circumstances herein are unique; that by allowing the variance no substantial detriment to adjoining properties will be created; that the difficulty cannot be obviated by a method feasible to appellant other than a variance; that no adverse effects will be produced on available governmental facilities of any increased population; that the relief requested will be -in harmony with and promote the general purposes of zoning; and that the interests of justice will be served by allowing the variance as indicated below. On motion by Mr. Sawicki, seconded by Mr. Douglass, it was RESOLVED, that Appeal No. 3123, application for HENRY PIERCE for permission to locate accessory two-car garage structure in an area other than the rearyard, as applied, BE AND HEREBY IS APPROVED SUBJECT TO THE FOLLOWING CONDITION: That the entrance/exit doors of this proposed accessory building do not face Wells Road. Location of Property: 2615 Wells Road, Peconic, NY; 1000-086-02-1.2. Vote of the Board: Ayes: Messrs. Goehringer, Douglass, Doyen and Sawicki. (Member Grigonis was absent.) This resolution was unanimously adopted. DATED: June 27, 1983.
