Based upon the information provided to this department as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the LWRP Policy Standards and therefore is CONSISTENT with the LWRP. Pursuant to Chapter 268, the Town Board shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Wilcenski, Chairman Members of Planning Board Date: August 31, 2015 Re: A Local Law entitled, "A Local Law in relation to Amendments to Chapter 219, Shellfish and Other Marine Resources, and Chapter 280, Zoning, in connection with Aquaculture Uses" Thank you for the opportunity to provide comments on the above referenced proposed Local Law. The Planning Board supports the adoption of this legislation with the following comments: 1. The setbacks to agricultural operations from the structure to contiguous parcels as established in the section (b) below, should be reduced to 50' if: a. the contiguous parcel is protected; b. in agricultural use; - - -- -c. and single family residence(s) are not located within 200'. "(b) The structures used for land based aquaculture operations shall be set back a minimum of 100 feet from any road and 200 feet from any contiguous parceL" cc: Scott Russell, Town Supervisor Members of the Town Board Assistant Town Attorney
