Located: 980 Oak Avenue, Southold. SCTM#77-1-6 The Zoning Board of Appeals granted a variance (6845) in May 2015 with no conditions. The proposed actions have been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP based on the following: 1. The Board of Trustees issued a Wetlands Permit (5692) in 2003 that required the installation of a 15'wide non -turf buffer. A sand buffer is in place. 2. The structure is currently located within FEMA flood zone AE El 7. The action would make the structure compliant with FEMA regulations. 3. The action will require compliance with Chapter 236 Stormwater Management. Note that two concrete troughs that were installed in the past to carry storm water to Goose Creek are still in place. Although that the troughs are not actively discharging stormwater into Goose Creek, it is recommended that the Board addresses (prohibits) the future use of the troughs. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
