After the completion of the restoration work, it will allow beneficial use of the waterfront portion of the owner's property. Specifically, the destroyed bulkhead has been replaced as well as retaining walls constructed to fortify the bluff; clean fill has been uniformly placed on the bluff, graded, stabilized, beach grass and other environmental plantings have been planted; stairs have been constructed for safe access from the top of the bluff to the beach. All restoration work was focused on rebuilding the bluff to prevent future erosion and to protect the residents on the property. Further, the mitigation efforts will prevent the bluff soil from eroding onto the beach along Peconic Bay, thereby making efficient use of the infrastructure and the beneficial use of this coastal location. SCTM# 111-13-6 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the as-built structures are INCONSISTENT with the LWRP Policies 6.3 (below) and therefore, INCONSISTENT with the LWRP. 6.3 Protect and restore tidal and freshwater wetlands. - t • 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The actions do not comply with Wetland Permits issued. • 1. The bluff stair does not conform to permitted specifications (7706, 7652 and 8222) The 95 square foot stair landing stair was not included in approvals. Wetland Permit 8222 allows the installation of a 10x10 observation platform at the mid-bluff retaining wall. It looks like the 75 square foot platform would comply with this condition. 2. The as built retaining walls do not conform to permitted specifications (8222). 3. The as built bulkhead does not conform to permitted specifications (8049). Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
