Kimack on behalf of KEVIN & PAULA FLAHERTY request a Wetland Permit for the demolition of an east side extension and majority of its foundation; construct a one-story 298sq.ft. addition with the installation of a drywell to contain roof runoff for new addition; as-built 90' long fieldstone retaining wall of varying height with steps located approximately 10' landward of easterly side of existing bulkhead; and as-built 769sq.ft. above grade stone patio with attached +/-20' long retaining wall. Located: 1250 Lupton Point Road, Mattituck. SCTM# 115-11-12 The proposed actions have been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP provided that the Board requires the following: 1. The location of the sanitary system is not shown on the plans. Require that the sanitary system is functioning and in conformance with Chapter 275 setbacks. 2. Verify that the 10' wide non-turf buffer as required in Wetlands Permit 8224 is installed. The "as-built" stone patio and retaining wall are INCONSISTENT with Policy 6.3 of the LWRP. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
