McCarthy Management, Inc. on behalf of 850 PRESIDENT LLC requests a Wetland Permit to construct
a two-story, single-family residence consisting of a 45'x25' dwelling with a 16'x21' attached garage; a
32.5'x20.5' first floor deck; and an 8'x13.5' second floor deck; install a sanitary system and concrete
retaining walls with top of wall to be at elevation 9.0; add +/-300 cubic yards of clean fill to be trucked in
from an approved upland site; and install a driveway using pervious materials. Located: 7165 New
Suffolk Road, New Suffolk. SCTM# 117-5-31
The proposed actions have been reviewed to Chapter 268, Waterfront Consistency Review of the Town
of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed action is
CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP provided that
the Board requires the following:
1. The zoning district setbacks limit the ability to relocate the structure further from the wetlands. It
is recommended that a non-disturbance buffer be required, landward from the wetland line to
the 4' contour line shown on the plans. Path access to the water should be excluded from the
buffer area.
There is no ability to locate the structure outside of the FEMA AE El 6' flood zone (figurel.)

Planning Board
1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area['which includes all of Southold Town),
3. If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency

McCarthy Management, Inc. on behalf of 850 PRESIDENT LLC requests a Wetland Permit to construct
a 30'x59' single-family dwelling with drywells; proposed sanitary system landward of dwelling; and
driveway. Located: 7165 New Suffolk Road, New Suffolk. SCTM# 117-5-31
The proposed action has;been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed action is
CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP provided that
the Board consider the following:
1. The Board issued a Wetlands Permit for the construction of a single family residence on
the property to the north (Permit 6548). The permit conditioned that a non-disturbance
buffer be established at the 4' topographical contour line. The wetlands that the buffer
was created to protect continue onto the subject property.
2. School House Creek is an Uncertified Water Body listed for pathogens. This water body
also contains area(s) subject to administrative shellfish restrictions due to marinas/boat
moorings.
3. In the event that the action is approved, to minimize impacts to the water body from the
action, it is recommended that the Board establish a 25'wide non-disturbance buffer
landward of the 'edge of wetland"where practicable. The buffer should exclude existing
accessory structures and the established access to the School House Creek. This
recommendation furthers policy 6.3 listed below:

F. Restore tidal wetlands and freshwater wetlands, wherever practical, to foster their
continued existence'as natural systems by:

Pursuant to Chapter 268, the Board of'Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed•action.
