LOCAL WATERFRONT REVITALIZATION PROGRAM
TOWN OF SOUTHOLD
MEMORANDUM
To: John Bredemeyer, President
Town of Southold Board of Trustees
From: Mark Terry, Principal Planner
LWRP Coordinator
Date: June 15, 2014
Re: Proposed Wetland Permit for KUHL FAMILY TRUST •
SCTM# 1000-70-12-38.1
No past permits were found for the structures.
Jeffrey Patanjo on behalf of KUHL FAMILY TRUST requests a Wetland Permit to replace
existing 206 linear feet of deteriorated timber bulkhead with new vinyl bulkhead in-place;
installation of an 8 linear foot return and an 18 linear foot return; reconstruct in-place existing
4'x10' timber platform with stairs to beach; existing 3'x7' platform leading to ramp to be re-
decked using untreated timber in-place; and install and subsequently maintain a 10'wide non-
turf buffer along the landward edge of the bulkhead; existing ramp and floating dock to remain
undisturbed during construction. Located: 1790 North Bayview Road, Southold. SCTM#70-12-
38.1
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed actions are INCONSISTENT with the Policy Standards 6.3 (below) and
therefore are INCONSISTENT with the LWRP.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees
laws and regulations for all Andros Patent and other lands under their jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in Trustee permit
conditions.
The structures were constructed without Board of Trustee review or a Wetlands
Permit.
It is recommended that in the event that the action is approved, the non-turf buffer be planted
with native vegetation.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.
