Main Rd. &Youngs Ave.) t,,4*.i.kz!to"Southold, NY 11971 � elephone: 631 765-1938 ' LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: John Bredemeyer, President Town of Southold Board of Trustees From: Mark Terry, Principal Planner LWRP Coordinator Date: June 15, 2015 Re: Local Waterfront Coastal Consistency Review for JOHN FISCHETTI & DEBORAH DEAVER SCTM# 1000-86-2-1.2 Samuels & Steelman Architects on behalf of JOHN FISCHETTI & DEBORAH DEAVER request a Wetland Permit to renovate the existing 3,074sq.ft. one-story dwelling by raising the height of the first floor by 10' and construct a new second floor; constructing a 92sq.ft. addition on the west side with a 110sq.ft. covered porch with stone paving and steps to grade; install a 380sq.ft. stone paved-on-slab walkway connecting to porch; remove existing concrete driveway and clear marked trees in area of proposed driveway; install a 5,320sq.ft. permeable crushed stone driveway and add drainage per Chapter 236 of the Town Code; construct a 344sq.ft. addition onto existing wood framed deck for a total of 1,410sq.ft. of decking attached to seaward side of dwelling with steps leading to a proposed 1,099sq.ft. stone-on-slab pool patio; install a 20'x40' gunite swimming pool; install 4' high pool fencing and pool equipment area; abandon and fill in existing sanitary and install new shallow sanitary system with a septic tank and eight leaching pools; existing 1,097sq.ft. two-car detached garage with patio to remain; existing 288sq.ft. shed to be demolished; install and subsequently maintain a 10' wide vegetated non-turf buffer along the entire landward edge of tidal wetlands; toxic underbrush and trees under 4" caliper will be removed in south east corner of property and install non-turf plantings; and for the installation of gutters to leaders to drywells to contain roof runoff. SCTM#86-2-1.2 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my determination that the proposed .action is INCONSISTENT with the below listed LWRP polices and therefore INCONSISTENT with the LWRP: Policy 4.9. Minimize losses of human life and structures from flooding and erosion hazards."The following management measures to minimize losses of human life and structures from flooding and erosion hazards are recommended. specifically A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. A portion of the structure (new swimming pool) is located within the FEMA Flood Zone AE El 6; an area of Special Flood Hazard and could be subject to repetitive flooding. An area is also specified to be filled on the plan however no other details are provided. Note that water was encountered at 6.1' feet below the surface. Will the pool bottom sit in standing water? It is recommended that the pool/deck be relocated to outside of the AE flood zone to prevent future structure loss Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. The foot print of the house will be enlarged by a 92 square foot addition to the west (road) side, together with a new covered porch with stone paving of 110 square feet, with steps to grade. A new stone paved-on-slab walkway of 380 square feet will connect the porch to the new permeable crushed stone driveway of 5,320 square feet, which replaces the existing poured concrete driveway of 2,831 square feet. The new driveway will have drainage per Town Code and the Town Engineer. . On the east (water) side of the house, the existing wood framed deck of 344 square feet will be expanded with new wood framed decking totaling 1,410 square feet, which will include new wood steps down to a stone-on-slab patio of 1,099 square feet, which will surround a new 20 foot by 40 foot gunite swimming pool, whose filtration system will not require a leaching pool for backwash. The pool will be surrounded by a four foot high metal fence to comply with the New York State Building Code for pool enclosure. The pool equipment will be located on the south side of the house, as will the new shallow sanitary system, which will have a septic tank and eight leaching pools, per requirements of the Suffolk County Dept. of Health Services. The existing two car detached garage of 1,097 square feet will remain. An existing shed of 288 square feet will be demolished.
