Located: 11292 Main Road, East Marion. SCTM#31-13-9.1 The proposed actions have been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP. { Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. 12 Yes n No 0 Not Applicable LWRP CONSISTENCY ASSESSMENT FORM ADDENDUM FOR KIRK O'FERRALL & DENISE CERASANI 11292 MAIN ROAD EAST MARION,NY SCTM#1000-31-13-9.1 Policy 4 The project consists of the ordinary and routine maintenance of a historically existing erosion control structure, specifically the in-place replacement of an existing timber groin that pre-dates the Town's jurisdiction over erosion control structures along the Town's bayfront. The existing groin is and would remain part of a larger field of historically existing groins located along the surrounding shoreline to the north and south and together with those groins serves to maintain the sandy beach along an area that is subject to potentially severe periods of shoreline erosion. The project is consistent with Policy 4 because the fetch and exposure at this location warrants the continued use of a mechanism that can slow and trap the predominately northeast to southwest migration of sand during the winter storm season for the purpose of long term beach maintenance, and there is no functionally equivalent,non-structural,practical design alternative to maintaining the groin to serve as this mechanism. Further consistent with Policy 4 and also with the permit standards of Chapter 111-15, the replacement groin is designed to the minimum scale necessary to continue providing its current beach retention function without causing a measurable increase in erosion at the site or adjacent properties or result in any other adverse impacts on adjacent properties or natural coastal processes and resources. Specifically,the new groin will have a low-profile design such that the seaward end of the groin is elevated no higher than 18 inches above the elevation of low tide; and only the 38 most landward feet of the existing 57' groin that is still functioning to maintain dry beach at low tide will be replaced, while the most seaward 19' section of groin that is now located seaward of the intertidal zone will be permanently removed. The groin is also designed in accordance with generally accepted engineering principles and is intended to provide long term beach retention by withstanding inundation,wave impacts, weathering and other effects of storm conditions for a minimum of 30 years. Therefore,the project is consistent with Policy 4.
