Application Information Project Title: Joint Industry Board and McBride Applicant: James and Richard McBride & E & C Property Holdings Date of Submission: February 12, 2016 Tax Map Number: 1000-83-2-16 & 1000-83-2-17.1 Project Location: Oregon Road Hamlet: Cutchogue Zoning District: AC & RR II. Description of Project Type of Subdivision: Re-subdivision Acreage of Project Site. Total site= 59.54 acres (2 lots) # of Lots Proposed: NA III: Action to review Review Referral Comments and Site Design IV: Analysis • This proposed re-subdivision will reconfigure the lot lines of two parcels, SCTM1000-83-2-17.1(28.7 ac) and SCTM1000-83-2-16 (30.8 ac), with no change to the current lot sizes. Currently both parcels front on and run perpendicular to Oregon Road. The proposed re-subdivision would result in the majority of the road frontage shifting to Lot 16. Lot 17.1 would be located behind (to the northwest) of Lot 16. This proposal is located in the AC and RR Zoning Districts. • The amount of area in each lot will not change, only the configuration of the lots. The existing and proposed acreage of the Joint Industry Board lot is 28.74 acres and the existing and proposed acreage of the McBride lot is 30.80 acres. • The proposed access for the Joint Industry Board is from a flag extending from Oregon Road. This flag includes a 55-foot right of way and an existing house. Southold Planning Department Staff Report • There is an existing frame barn that is located in the proposed 55-foot right of way. • The new road from Oregon Road will remove prime ag soils from ag production Referral Comments: Cutchogue Fire District- Additional fire protection for this application is not needed. Office of the Town Engineer- 1. The site plan indicates a 55' right of way extending out to Oregon Road. Will there be a new access road constructed here? If the answer is yes than the road must be designed and drainage calculations must be provided to meet the requirements of Chapter 236 for Stormwater Management. 2. There is an existing barn located in the proposed ROW. Will this barn be removed 3. The lot with the proposed row indicates the meets and bounds description of what appears to be an 80,000 sq. ft. lot surrounding the existing residence on Oregon Road. Will this lot be broken out of the larger lot to create another lot? If the answer is yes there will be an issue with an insufficient front yard width. As shown 120' does not meet code. I this is to be considered a separate lot it would also require the additional width of the proposed row to meet the minimum 175' front yard requirement. 4. The private cul-de-sac road terminations of Ihar and Olivia Lane should be shown on the plan along the westerly property line. C&Rs should be recorded along with a site plan approval that prohibits access to these road ends without the recorded easements or access agreements from the adjacent property owners having jurisdiction. 5. There has been an ongoing problem with site runoff coming from the northerly end of the Joint Industry Board property that adversely affects the adjacent residential properties. If this part of the property is to remain in farming there may not be any improvements that we could require. If the site is to be improved for other than farming, I would recommend that some type of drainage be designed and installed at the low point along the westerly property line. Local Waterfront mRevitalmization Pro rg am The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program Policy Standards based upon the information submitted to this department the proposed action is INCONSISTENT with the LWRP below listed policies: 2 Southold Planning Department Staff Report 1. Enhance visual quality and protect scenic resources throughout the Town of Southold. The preservation of scenic resources is State and Town goad established in many plans. At the State level the elevation and preservation of the value of scenic resources in Southold is listed as a NYS Areas: LI North Shore Heritage Area goal. The designation is supported by a plan that includes strategies and specific policy recommendations on the unique historical, maritime and special environmental resources contained within the area. The Towns Comprehensive Plan contains many goals and objectives to identify and protect scenic qualities from land and waters including agricultural lands. Oregon road has been found to be an area of high scenic quality and important to the community and Town of Southold. The introduction and interruption of the scenic view sheds through the construction of a 1.9+/- acre private access road and required street lighting does not meet this policy. 2. Protect agricultural lands from conversion to other land uses.: The site soils are comprised of Haven Loam 0-2% and Riverhead Sandy Loam 3- 8%. The area where the road is proposed is comprised of Haven Loam, a Soil of Statewide Importance (USDA). The conversion of 1.9+/- acres of agricultural lands/soils to a private roadway that in its design also creates a 1.83+/- of non- farmable section of land (Lot) does not meet this policy. 3. Minimize adverse impacts on agriculture from unavoidable conversion of agricultural land. The LWRP states that "Where farmland is converted to residential or other non- agricultural land use, the adverse impacts of that change on the remaining agricultural land should be minimized. To the maximum extent possible, clustering and other techniques should be utilized to remain sufficient land suitable for agricultural opportunities within the new development are. Arrangements for keeping viable fields in production through lease arrangements or easement should be encouraged. Site design should minimize potential conflicts between new residential or commercial uses and the agricultural use." As indicated above a goal of the Town is to keep viable agricultural fields in production and protect prime/significant agricultural soils. The proposal, as submitted, does not meet this policy. It is recommended to relocate the roadway to a new location. 3 Southold Planning Department Staff Report Comments were not received„from the follqWinq agencies within the re uired 30 day timeframe: 1. Department of Environmental Conservation 2. Suffolk County Department of Health Services 3. Suffolk County Water Authority 4. Suffolk County Planning Commission Preliminary Plat Public Hearing Comments: Proposed Right Of Way: The agent stated that the proposed lot line reconfiguration is to allow the Joint Industry Board to have a buffer to Oregon Road. A right of way from Oregon Road is not need to access a buffer. Will the proposed road be paved or unpaved where the land could still be farmed by the McBride family? Existing House against Oregon Road: What will happen to the property behind the house, will it continue to be farmed? Joint Indust Board's Pro osed Property Design: What could be put in the newly created area? Water Runoff: The neighbors to the west have had problems with water run-off and flooding from the north side of the farm property. Planning Comments: • The applicant's attorney stated at the Preliminary Plat Public Hearing that the reason for the proposed reconfiguration was to create a buffer for SCTM# 1000- 83-2-17.3 (Joint Industry Board's Conference Center and Motel) to Oregon Road. • The submitted map shows a 3.7 acre area that includes an existing home and a 55' wide right of way, creating access to the proposed northern lot. 4 Southold Planning Department Staff Report • The existing location of the proposed 55' right of way and existing home are located in an area of prime agricultural soils. This area is currently being farmed by the McBride family. • A goal of the Town is to keep viable agricultural fields in production and protect prime/significant agricultural soils. The combined acreage of prime agricultural soils proposed to be lost through the reconfiguration is approximately 132,259 sq. ft. or 3.0 acres. The submitted proposal and loss of prime agricultural soils is in direct contradiction this Town goal. • The attorney's agent has stated that the Joint Industry Board would like to keep ownership of the house against Oregon Road. • The lot line of the new parcel containing the house is not at a right angle to Oregon Road, and does not comply with Town Code section §240-45 (5) Design Standards. . • The Joint Board parcel contains (and will continue to contain) 2.5 acres of Resort Residential zoning. While this area is partially impacted by steep slopes, future non-residential development may be proposed in this area. • The zoning on the remainder of the property to be owned by the Joint Board would allow, by Special Exception, the following uses of the property (partial list from §280-13 B): o Children's Recreation Camp o Tennis club, including tennis courts, swimming pools, recreational buildings and maintenance buildings catering to members & guests • Given the non-residential nature of the property owner's adjacent uses, the aforementioned non-residential uses are possibilities in the future. • Move this to the first recommendation below and structure it more like this: 1. The design, as proposed is not recommended for the following reasons: A. prime ag soils lost B. doesn't meet the code for lot design C. potential quality of life and noise issues for neighbors with road running along their property line, and future uses unknown but with potential for intensification due to non-residential, non-farming nature of the property owner and their adjacent uses. 2. Suggestions for a new design that could be recommended: 5 Southold Planning Department Staff Report A. Include the Joint Board's parcel to the north in the re-subdivision, and move that line to create the new configuration of the McBride farm. Move the line currently separating the McBride farm and the Joint Board's farm parcel to create a one-acre lot around the house. B. Creates a single large parcel for the Joint Board that includes the farm area and their conference center area. C. Allows the Joint Board to continue to own the house and preserves more useable prime agricultural soils for agriculture. D. Meets the Town Code for lot design. E. Removes the right of way connecting to Oregon Rd, thereby removing the possibility of quality of life and noise issues for neighbors from a road that could end up sustaining a sizable amount of traffic given the potential uses that might be proposed for the Joint Board's new configuration of land. V: Staff Recommendations 1. Redesign the lot lines to conform to Town Code, and preserve prime agricultural soil, protect adjacent residents from potential future noise and reduction in quality of life. 2. Accept the referral comments from the Cutchogue Fire District, Office of the Town Engineer and the Local Waterfront Revitalization Program. 3. Accept all Planning Comments and recommend that the above design changes be made to the map. 4. The Office of the Town Engineer and the comments from the public hearing discussed runoff from the northern farm creating flooding problems with the existing lots on Duck Pond Road. In addition, given the non-residential nature of the owner's adjacent uses, it is likely the property may be used for something other than agriculture in the future. It is recommended to create a covenant and restriction to be placed on the Joint Industry Board's property that states the following: "Any use, other than agriculture, requires review and approval by the Planning Board prior to that change occurring. The purpose of this covenant is for the Planning Board to have the opportunity to plan for adequate buffers and control of stormwater runoff. This covenant applies to all uses, including those considered accessory and those that do not require a building permit. Lot 17.1 would be located behind (to the northwest) of Lot 16.This proposal is located in the AC and RR Zoning Districts. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, the proposed action is INCONSISTENT with the LWRP below listed policies: Policy 3. Enhance visual quality and protect scenic resources throughout the Town of Southold. The preservation of scenic resources is a State and Town goal established in many plans. At the State level the elevation and preservation of the value of scenic resources in Southold is listed as a NYS Areas: LI North Shore Heritage Area goal. The designation is supported by a plan that includes strategies and specific policy recommendations on the unique historical, maritime and special environmental resources contained within the area. The Towns Comprehensive Plan contains many goals and objectives to identify and protect scenic qualities from land and waters including agricultural lands. A, Minimize introduction of structural design components (including utility lines, lighting, signage and fencing) which would be discordant with existing natural scenic components and character. Oregon Road has been found to be an area of high scenic quality and important to the community and Town of Southold. The introduction and interruption of the scenic view sheds through the construction of a 1.9+ acre private, access road and required street lighting does not meet this policy. K. Protect visual quality associated with agricultural land, open space and natural resources. 12.1. Protect agricultural lands from conversion to other land uses. The site soils are comprised of Haven Loam 0-2% and Riverhead Sandy Loam 3-8%. The area where the road is proposed in comprised of Haven Loam, a Soil of Statewide Importance (USDA). The conversion of 1.9+ acres of agricultural lands/soils to a private roadway that, in its design, also creates a 1.83+of non-farmable section of land (Lot)does not meet this policy. 12.3. Minimize adverse impacts on agriculture from unavoidable conversion of agricultural land. The LWRP states that "Where farmland is converted to residential or other non-agricultural land use, the adverse impacts of that change on the remaining agricultural land should be minimized. To the maximum extent possible, clustering and other techniques should be utilized to retain sufficient land suitable for agricultural opportunities within the new development area. Arrangements for keeping viable fields in production through lease arrangements or easements should be encouraged. Site design should minimize potential conflicts between new residential or commercial uses and the agricultural use." As indicated above a goal of the Town is to keep viable agricultural fields in production and protect prime/significant agricultural soils. The proposal, as submitted, does not meet this policy. As per a request from your office, I have reviewed the Re-Subdivision for property owned by the Joint Electrical Industry Board and Mr. McBride. This site plan has been prepared by the office of Jeffery T. Butler, P.E., P.C. and have been dated 10/23/15. Please consider the following: 1. The Site Plan indicates a 55' Right-of-Way(ROW)extending out to Oregon Road. Will there be a new access road constructed here? If the answer is yes than the road must be designed and drainage calculations must be provided to meet the requirements of Chapter 236 for Stormwater Management. 2. There is an existing barn located in the proposed ROW. Will this barn be removed? 3. The lot with the proposed ROW indicates the meets& bounds description of what appears to be an 80,000 SF +/- lot surrounding the existing residence on Oregon Road. Will this lot be broken out of the larger lot to create another lot? If the answer is yes there will be an issue with an insufficient front yard width. As shown (120') does not meet code. If this is to be considered a separate lot it would also require the additional width of the proposed ROW to meet the minimum 175' front yard requirement. 4. The private Cull-de-Sac road terminations of Ihar&Olivia Lane should be shown on the plan along the westerly property line. C&R's should be recorded along with any site plan approval that prohibits access to these road ends without the recorded easements or access agreements from the adjacent property owners having jurisdiction. 5. There has been an ongoing problem with site runoff coming from the northerly end of the Joint Industry Board property that adversely affects the adjacent residential properties. If this part of the property is to remain in farming there may not be any improvements that we could request. If the site is to be improved for other than farming, I would recommend that some type of drainage be designed & installed at the low point along the westerly property line. Southold Planning Department Staff Report • There is an existing frame barn that is located in the proposed 55-foot right of way. • The new road from Oregon Road will remove prime ag soils from ag production • At the March 7, 2016 work session the Planning Board reviewed the application and found it incomplete with the following to be submitted: 1. Submission of copies of all COs for the existing buildings,. On March 28, 2016 the agent submitted copies of all COs for the existing buildings. This proposal is more complicated than a simple lot line change where a single lot line is moved. This proposal is to change the configuration of both parcels as well as the addition of a new road off of Oregon Lane. The Planning Board's procedure is to allow simple lot line changes to have a reduced standard subdivision process. This is done though the waivers section of the Southold Town Code. V: Staff Recommendations 1. Require that this application be handled as a re-subdivision application. This would require a process more like a standard subdivision. 2. The following process is recommended: a. Waive Sketch Plan review. b. Require Preliminary Plat review and approval. A new application and fee is not required. c. Require Final Plat review and approval. Mylars will be required. 3.
