That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit,and the said Permittee will,at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months,which is considered to be the estimated time required to complete the work involved,but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely,or as long as the said Permittee wishes to maintain the structure or project involved, to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. , s 6. That there shall be no interference with the right of the public to pass,and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if,in the opinion of the Board of Trustees,the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit,which may be subject to revoke upon failure to obtain same. 11. No right to trespass or interfere with riparian rights. This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or interest in real or personal property held or vested in a person not a party to the permit. A lot of the existing bluff face on the Nickolaus property has been bulldozed away in the past few weeks to create a heavy equipment& construction road from the top of the bluff down to the to the beach. Boulders have already been placed at the shoreline via this road cut like a "canyon" diagonally into the bluff and some sort of trench has been dug on the western side of the property line. We assume this has all been previously approved and we sincerely wish the Nickolaus' only success with this whole project. We want this to be a12i9 success. However, with the work that is being done next door, we want to be sure that measures have been taken in the design process that will ensure that this project at 17555 Soundview does not act to dislodge our bluff or act in any way to speed up the deterioration of the bluff. As,it stands now, with the "canyon" road cut through the bluff and very near our joint property line, there is now new exposure of soil open to erosion where there was never any exposure before. Our fear is that we will now be dealing with erosion;not only on our north side but from the west property line as well. Hopefully, this will or has been addressed and a plan to prevent erosion from all sides is part of the plan up for approval. Grade and Stabilize Slope of Tidal Wetland The existing bank shall be graded and shaped to receive the revetment c r other shoreline stabilization structure so that the final toe of slope extends no further seaward or closer to the tidal wetlands than the existing toe of slope. 14. Seeding Disturbel Areas All areas 0r soil disturbance resulting from the approved project shall be stabilized with appropi iate vegetation(grasses,etc-)immediately following project completion or prior to permit expiration,whichever comes first. If the project site remains inactive for more than 48 hours or planting is impracti,gal due to the season, then the area shall be stabilized with straw or hay mulch or jute matting until weal=conditions favor germination. 15. Establish Vegetal ed Buffer To protect the values of the tidal wetlands, a permanent vegetated buffer zone shall be established.There shall be no disturbance to the natural vegetation or topography within an area extend ig fifteen linear feet landward of the top of the bluff. 16. STATEMENT OF EFFECT The subject property is located along a stretch of Long Island Sound shoreline running parallel with Soundview Avenue that has been severely impacted by increasing bluff erosion during the many Nor'easter and other significant storm events of the past 5 years, especially including the Christmas 2010 Blizzard and Super Storm Sandy in October 2012. In response to this erosion, several privately owned properties throughout this geologic cell have been forced to replace or construct new shoreline stabilization structures in response to accelerated shoreline erosion, and the Town of Southold was similarly forced to make install a publicly sponsored revetment to prevent the breach of Soundview Avenue itself. Similarly, the bluff fronting the subject property has experienced severe erosional losses, as evidenced by a landward transgressing bluff toe, a steepening bluff face, and a sloughing of the bluff crest, all resulting in the loss of bluff and adjacent upland. To remediate this process of erosional loss and the potential damage to and loss of residential structures located landward of the bluff, an erosion control project was designed in accordance with the generally accepted eroding bluff stabilization practices recommended by the USDA Natural Resources Conservation Service to simultaneously stabilize the toe,top, and face of the bluff by implementing a combination of structural toe stabilization; structural and vegetative bluff face renourishment; and shoreline retreat, including the removal and/or landward relocation residential structures and sanitary facilities. Specifically, in 2011, an engineering plan was designed by Jeffrey T. Butler, P.E.,P.C., which called for installation of a stone revetment to stabilize the toe of the bluff,which would occur first. Then the bluff face can be stabilized with terrace walls and renourished with sand and planted with native vegetation, including beach grass for groundcover and woody plants such as northern bayberry and beach rose. Comprehensive terracing was proposed in the upper portion of the bluff due to the limited space within which to rework the bluff crest. A nonturf buffer to be planted with native vegetation is to be established in place of existing lawn behind the top of the bluff to increase the absorption capacity of the upland area behind the bluff in order to reduce the volume of surface water runoff reaching the bluff. A small berm is incorporated into the buffer design to slow the potential rate of sheet flow runoff down the bluff during heavy rain events when water is moving faster than it can be efficiently absorbed. A stormwater drainage system was proposed to provide additional structural remediation of stormwater runoff. Finally, existing residential structures such as the historically existing swimming pool and patio located closest to the bluff and sanitary system were designated for removal and/or landward relocation. After submission of this design plan with the required application materials and review by the Board of Trustees during a public hearing held on November 16, 2011, Wetlands Permit No. 7693 and Coastal Erosion Management Permit No. 7693C were issued for the project. Further pursuant to Chapter 111-15,the purpose of the structure and integrated erosion control remediation plan is designed specifically to stem the continued denuding and loss of the bluff,the property's natural protective feature; the design has been engineered in accordance with generally accepted engineering principles and is likely to control long-term bluff erosion at the site through long-term maintenance and its intended ability in to withstand inundation, wave impacts, weathering and other effects of storm conditions for a minimum of 30 years. Inaddition to the project's conformance with Chapters 275 and 111,the project is further consistent with Policy 4 of the LWRP because the structure is being proposed only where non-structural, vegetative means alone would not be sufficient to stem the ongoing bluff erosion; where the natural protective feature cannot be effectively enhanced without effective stabilization at the toe; where a hard structure is the only design consideration that can practicably and effectively provide such toe stabilization; and where vegetative enhancement is and will remain part of the long-term remediation plan design. Yes No ® Not Applicable � 1 POLICY 4 The subject property is located along a stretch of Long Island Sound shoreline running parallel with Soundview Avenue that has been severely impacted by increasing bluff erosion during the many Nor'easter and other significant storm events of the past 5 years, especially including the Christmas 2010 Blizzard and Super Storm Sandy in October 2012. In response to this erosion, several privately owned properties throughout this geologic cell have been forced to replace or construct new shoreline stabilization structures in response to accelerated shoreline erosion, and the Town of Southold was similarly forced to make install a publicly sponsored revetment to prevent the breach of Soundview Avenue itself. Similarly,the bluff fronting the subject property has experienced severe erosional losses, as evidenced by a landward transgressing bluff toe, a steepening bluff face, and a sloughing of the bluff crest, all resulting in the loss of bluff and adjacent upland. To remediate this process of erosional loss and the potential damage to and loss of residential structures located landward of the bluff, an erosion control project was designed in accordance with the generally accepted eroding bluff stabilization practices recommended by the USDA Natural Resources Conservation Service to simultaneously stabilize the toe,top, and face of the bluff by implementing a combination of structural toe stabilization; structural and vegetative bluff face renourishment; and shoreline retreat, including the removal and/or landward relocation residential structures and sanitary facilities. Specifically, in 2011, an engineering plan was designed by Jeffrey T. Butler,P.E.,P.C., which called for installation of a stone revetment to stabilize the toe of the bluff,which would occur first. Then the bluff face can be stabilized with terrace walls and renourished with sand and planted with native vegetation, including beach grass for groundcover and woody plants such as northern bayberry and beach rose. Comprehensive terracing was proposed in the upper portion of the bluff due to the limited space within which to rework the bluff crest. A nonturf buffer to be planted with native vegetation is to be established in place of existing lawn behind the top of the bluff to increase the absorption capacity of the upland area behind the bluff in order to reduce the volume of surface water runoff reaching the bluff. A small berm is incorporated into the buffer design to slow the potential rate of sheet flow runoff down the bluff during heavy rain events when water is moving faster than it can be efficiently absorbed. A stormwater drainage system was proposed to provide additional structural remediation of stormwater runoff. Finally, existing residential structures such as the historically existing swimming pool and patio located closest to the bluff and sanitary system were designated for removal and/or landward relocation. After submission of this design plan with the required application materials and review by the Board of Trustees during a public hearing held on November 16, 2011, Wetlands Permit No. 7693 and Coastal Erosion Management Permit No. 7693C were issued for the project. These permits were later amended on August 22, 2012, to reflect minor plan changes required by the New York State Department of Environmental Conservation, Nickolaus - 17555 Soundview Avenue,Southold Page 1 who issued a New York State Tidal Wetlands Permit for the project on August 1, 2012. However,the property owners were not prepared to execute the work until recently in 2015, and although the permits could have been extended through November 16, 2015, they were allowed to expire,thus necessitating submission of additional applications for new permits. As described in the originally submitted applications,pursuant to the principles set forth by Chapter 275-11(B)(1)(b),the proposed stone revetment is proposed in an area suffering from extreme erosion. Pursuant to Chapter 275-11(B)(1)(b) and Chapter 111- 15,the revetment will be installed with a sloped face and angled returns with no surface encroachment on the beach seaward of the existing, eroded bluff toe so as not to cause a measurable increase in erosion at the site or adjacent properties. Further pursuant to Chapter 111-15, the purpose of the structure and integrated erosion control remediation plan is designed specifically to stem the continued denuding and loss of the bluff,the property's natural protective feature;the design has been engineered in accordance with generally accepted engineering principles and is likely to control long-term bluff erosion at the site through long-term maintenance and its intended ability in to withstand inundation, wave impacts,weathering and other effects of storm conditions for a minimum of 30 years. In addition to the project's conformance with Chapters 275 and 111,the project is further consistent with Policy 4 of the LWRP because the structure is being proposed only where non-structural,vegetative means alone would not be sufficient to stem the ongoing bluff erosion; where the natural protective feature cannot be effectively enhanced without effective stabilization at the toe; where a hard structure is the only design consideration that can practicably and effectively provide such toe stabilization; and where vegetative enhancement is and will remain part of the long-term remediation plan design.
