A meeting of the Southold Town Conservation Advisory Council was held Wed., January
13, 2016 at Down's Farm Preserve.

CALL TO ORDER
The meeting was called to order at 4:30PM by Chairman Peter Young.
REPORTS
John Stein attended the Board of Trustees meeting held on December 16, 2015. There
was a special presentation for Lori Hulse, Assistant Town Attorney and Trustee Dave
Bergen recognizing them for their years of service to the Town. The remainder of the
meeting was business as usual.
GUEST SPEAKERS

John Bredemeyer, President of the Board of Trustees and Michael Domino, Vice-
President of the Board of Trustees attended the meeting. John distributed copies of his
Targeted/Redefined Role for CAC. They recently met with Supervisor Russell and Peter
Young to discuss the administrative and management roles of the CAC. The goal is to
eliminate duplication of efforts and possibly limit the CAC role to only the projects with
major impacts on the environment in accordance with SEQRA determinations. Any
changes to the SEQRA review process will require an amendment to the code. The CAC
could also have involvement in special projects such as wetland restoration projects and
water quality projects, as well as assist with conservation advice for applicants and
provide environmental audits upon request. Chairman Peter Young requested the CAC
members review the Targeted/Redefined Role for CAC, and prepare comments for a
continued discussion at the next meeting in February. He also asked that the members
review and become more familiar with Chapter 275 and the SEQRA review process.
Peter Meeker distributed a working outline as part of the joint efforts to update the
procedures and mission statement of the CAC.
Jack McGreevy expressed his concern with potential code violations on properties that
are not within the Trustees' jurisdiction. John Bredemeyer and Michael Domino both
suggested that the CAC develop protocol to address these types of issues in an effort to
streamline the process.
APPROVAL OF MINUTES
Moved by John Stein, seconded by Keith McCamy, to Approve the Minutes of December
9, 2015.
DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT & COASTAL
EROSION PERMIT APPLICATIONS
Moved by John Stein, seconded by Keith McCamy, it was
RESOLVED to NOT SUPPPORT the application of LAZARUS ALEXANDROU to
construct a 16' X 32' gunite pool with cartridge system and drywell all behind existing non-
turf buffer.
Located: 2700 Sound Dr., Greenport. SCTM#33-1-11

The CAC does Not Support the application based on the following:
• The project was not staked;
• The proposed 35' setback does not meet Ch. 275 code requirements; and
® The project lacks an entrapment protection plan in compliance with sect. AG106.

Given the scope of this project, a landscapers plan is inadequate. The applicant should be
required to submit a complete site plan stamped by a licensed engineer. (See application
submitted on behalf of O'Toole #145-2-6.)

RESOLVED to SUPPORT the application of BRUCE & ALLAN GOLDSMITH to remove
existing 75' of bulkhead and 32' west return. Construct 75' of new bulkhead and 32' west
return, in-kind, in-place. Maintain existing 10' wide non-turf buffer.

existing 74' of bulkhead. Construct 75' of new bulkhead, in-place, raising the elevation to
5' to match adjacent property's bulkhead. Modify inshore end of existing dock ramp to
match new bulkhead elevation. Maintain existing 10' buffer.

RESOLVED to SUPPORT the application of GIOIA TURITTO & NABIL EL SHERIF to
remove existing stone circular retaining wall; remove gunite pond; and drain. Leave as-
built retaining wall approx. 65' in length with stone steps. Relocate stone circular retaining
wall approx. 23' in dia. with an octagonal shaped gazebo in the center and restore 50' of
disturbed land landward of vegetated wetland and landscape remainder of lot 61.1 in
accordance with landscape plan.

RESOLVED to SUPPORT the application of CHRISTINE & PHILIP MASCIA for the
construction of a 12'X 12' screened porch addition to existing dwelling; 4'X 4' outdoor
shower on landward side of proposed porch; and a 6'X 12' addition located on the
roadside of the dwelling.

RESOLVED to SUPPORT the application of VINCENT & EILEEN FLAHERTY to remove
232' of existing bulkhead. Construct 232' of new bulkhead, in-place. Remove 50' landward
section of existing jetty. Construct 50' of new jetty section, in-place.

The CAC Supports the application with the recommendation to consider
removing/relocating the existing jetty, low-profile, to the east alongside the channel
entrance. The existing location blocks public access along the shoreline.

RESOLVED to NOT SUPPORT the application of RIVKA SHOENFELD to relocate an
existing cottage 37' landward of its present location, construct a new two-story frame
addition, new two-story frame garage and studio and two new decks. Construct new path
from the new 800 sf. deck to the top of bluff, new timber stairway 65'X 3' with three
landings from top of bluff to the beach and regrade the lip at the crest of the bluff. Approx.
30 cy. of fill will be used to regrade the footprint of the existing cottage after it has been
relocated and to re-grade the lip at the crest of the bluff to prevent storm water run-off
from eroding the bluff.

The CAC does Not Support the application because of a concern with the massive tree
removal and the setbacks from the top of the bluff. The CAC recommends the structures
are relocated to no closer than 100' from the top of the bluff.

RESOLVED to SUPPORT the application of RAYMOND RAIMONDI for the demolition of
the existing one-story house with existing garage and shed to remain, construction of new
two-story single-family dwelling with first-floor raised for flood zone conformance, new
conforming sanitary system, and reconfigure driveway.

beach.

ASSOC. to remove and replace approx. 25 If. of existing bulkhead and replace in-kind due
to storm damage. Repair or replace in-kind approx. 85'X 3'4" wide stairs, repair or replace
one 5'X 7' platform, one 8'X 7' platform, and one 7'X 4' platform. Add 11'X 3' wide new
stair to grade. Construct new 6'X 3' stairs to beach from new bulkhead.

RESOLVED to SUPPORT the application of NASSAU POINT PROPERTY OWNERS
ASSOC. to remove and replace existing 3' wide X 22' long stairs and 3' X 3' platform
down bluff in same location and size as existing. Remove and replace existing 20.5' X
11.5' deck surface in same location and elevation as existing with new untreated or
composite decking. Add two additional 6X6 CCA wales sistered to existing on navy style
bulkhead.

replace 40 If. of existing bulkhead with new vinyl bulkhead in same location and 12" raised
height; installation of 20 If. of proposed vinyl bulkhead extension; re-shaping of 60 If. of
eroded bank along with installation of two tiers of coir logs and planting with beach grass
and wetland plantings; dredging of approx. 65 cy. material to be utilized as nourishment
behind low-sill bulkhead or disposed of off-site.

RESOLVED to NOT SUPPORT the application of HENRY & MELISSA SILVERMAN to
construct a 4'X 10' ramp utilizing open grate decking with a 3' high handrail on each side
leading to a 4'X 95' catwalk utilizing open grate decking with a 3' high handrail on each
side and 2'X 8' bench, 3'X 24' aluminum ramp with handrails, 2'X 5' bump-out float, 6'X
20' floating dock secured by two batter piles and one tie-off pile, with water and electric to
dock.

The CAC does Not Support the application because the project was not staked and the
property was not properly posted with a Notice of Hearing. There is a major concern with
the structure exceeding 1/3 the width of the creek, as well as exceeding the limitation of
square footage of floating docks.

RESOLVED to SUPPORT the application of EMMA HALL to remove remnants of existing
beach access stairs from bluff and replace with new stairs consisting of a 6'X 3' landing at
top of bluff and railings; stabilize 500 sf. of western upper edge of bluff with 60 cy. of sand
and gravel, cribbing and vegetation.

The CAC Supports the application with a further definition of the materials to be used, a
plan for bluff stabilization, and erosion control devices for the bluff stairs.

RESOLVED to SUPPORT the application of KATHY & RICH O'TOOLE to install a 20'X
40' gunite swimming pool with patio and fence to enclose at patio edge. Pool equipment
next to split-rail fence and drywell southwest corner by pool fence.

HAY HARBOR CLUB to conduct maintenance dredging in Hay Harbor in accordance with
existing guidelines set forth in the Town of Southold ordinance No. 6, 2004.
Located: Fox Ave., Fishers Island. SCTM#9-3-1
The CAC did not make an inspection, therefore no recommendation was made.
Jack McGreevy will attend the next regular meeting of the Board of Trustees scheduled
for Wed., January 20, 2016 at 5:30 PM.
The next meeting of the Conservation Advisory Council has been set for Wed., February
10, 2016 at 4:30 PM to be held at Down's Farm Preserve.
There being no further business to come before the Council, the meeting was adjourned
at 7:00PM.

Targeted/Redefined Role for CAC:
Consider a reduced advisory role in wetland permit
applications, limiting CAC input to actions classified as Type I
and "Unlisted Actions"under SEQRA (typically those involving
revetments & bulkheads in/out of the CEHA, docks, wetland
clearing w/ow/o violations, major commercial facility
expansion, etc.) The CAC would not review Type H Actions
typical of single family house construction on approved lots
where environmental mitigation is standardized and repeatable.
Another possibility would be to restrict CAC input only to those
actions receiving a "Positive Declaration" under SEQRA, i.e.
those applications which are classified as Type I or Unlisted
Actions under SEQRA wherein one or more significant
environmental impacts, that are not easily mitigated, have
been identified. A check-off would be included in all future
wetland applications encouraging applicants to seek
conservation advice:
0 I/we request an voluntary environmental audit of best
management environmental practices for this site, to be
performed at a mutually agreeable time by member(s) of the
Southold Town Conservation Advisory Council.
Supporting Reasons:
Eliminate duplication of effort and advice that at times has no
nexus to the instances of an application before the Trustees.
Free up CAC time to work on targeted requests from the TB &
TT such as: assist with research/reports/special projects.
Presently there are two outstanding grants the Trustees have
with the Cornell Cooperative Extension Marine Program for
marsh stabilization. Upcoming projects such as the removal of
invasive vegetation around Great Pond and the possibility of
turning the Marion Lake outlet into a fish ladder, where the
CAC could assist community groups and Trustees with site
surveys and DEC permitting are envisioned as possibilities for
more rewarding and productive use of CAC efforts.
