FRONT YARD SETBACK as applied and shown on Survey of July 26, 1996 prepared by Young & Young, L. S. REASONS/ FINDINGS: Local Law adopted by Town in December 1995 did not continue the code language allowing for reduction in setbacks for subdivision lots which today may be nonconforming and over 40,000 sq. ft. There is no relief currently provided for these lots except by variance application, although schedule 100-244B allows for relief for lots under 40,000 sf. in size. The only alternative available for owners of lots over 40,000 sf. is to request a variance. The variance requested is one foot from the required 60 ft. (eff. 1/96). This type of variance is not uncommon for lots in a subdivision containing lots of this size (40,242 in an 80,000 R-80 zone), and the reduced front yard setback is similar to, or the same as, those built in this subdivision and immediate areas which were formerly allowed with a 50 ft. setback by code provision (100-244) prior to January 1996. No. 4408 - Variance for Front Yard Setback Dear Mr. and Mrs. Malave: Please find enclosed a copy of the determination rendered by the Board of Appeals and filed today with the Town Clerk's Office concerning your variance request- A copy of this determination has also been transmitted to the front desk at the Southold Town Building Department pertaining to the pending building permit application request. However, it will be necessary for you (or the owner) to contact the Building Department (765-1802) in a day or two to be sure the building permit is amended to show the change (as per the variance request and determination). Also, due to the proximity of this project within 500 feet of the Riverhead Town boundary line, we have transmitted copies of the variance file to the Suffolk County Department of Planning for their determination under the County's Administrative Code.
