The applicant is requesting a Waiver raider Section 100-26 of the Zoning Ordinance, based upon the Building Inspector's March 14, 1996 Notice of Disapproval, in which applicant was denied a building permit to construct a one-family dwelling on vacant land based upon information received by the assessors office since issuance of January 24, 1996 Notice of Disapproval (rear yard setback). Under Article II, Section 100-25A enacted 1/1/96, the subject lot has been held in common ownership with an adjacent lot from 6/17/95 until recently. Town records show the subject parcel was single and separate prior to 6/17/95 when deed transfer was recorded in the Suffolk County Clerk's Office in a probate matter. The subject lot is shown to be in common ownership with an adjoining substandard lot (1000-18-1-9) improved with a single-family dwelling. The subject parcel is identified as County Tax Map Parcel No. 1000-18-1-12, and has been assessed as a separate parcel known as 295 Youngs Road, Orient for more than 32 years. Box 884 Westhampton Beach, NY 11978 Re: Your Letter - New Construction Project/Hugh Murphy Dear Ms. Herold: This letter is in response to your letter asking whether or not the variance for a proposed "addition to existing house" would include or cover demolition of the existing house and the building of a new house to the footprint originally existing, and proposed addition granted in the variance. Since the Murphy application before the building department and the ZBA pertained strictly to an "addition" to existing dwelling rather than the circumstances indicated in your letter (for demolition and outside the original footprint), further application to the ZBA is required. The circumstances and project are different than that originally applied for. It is our position that before an action or determination may be modified or otherwise interpreted to the extent requested, one of the following procedures may be followed: 1) an application for a rehearing of the former case, followed by a possible unanimous vote to rehear based upon the changed (.and new) circumstances furnished; or 2) alternatively, an application for a building permit for the new dwelling construction (without regard to the variance which was for a different request). A similar situation is presently before us in the Matter of Galjaiiic in which the applicant applied for a building permit to replace existing dwelling with an existing nonconforming front yard, replacing same with a new house, at the same setback but outside the footprint of the existing house (different house design and size). The Building Inspector disapproved the application based upon the nonconforming frontyard. This application is open and pending. In opening the house for the season, Mr. Murphy took a critical look at the existing house and felt there was not much to save. He would be interested in razing the existing house and building a new house in the footprint provided by the existing house and two proposed additions. The final design of the house would be the same, but in one case, it would consist of all new materials and in the second case, the house would consist of new and old materials. I have spoken to the Building Department, and they have no objection to building a new house as long as all the permits that have been issued are amended. Therefore, we would like to know whether or not the approval we received from your board would cover the demolition of the existing house and the building of a new house to the proposed footprint originally granted.
