ZONING CODE DISTRICT DESIGNATION: B-General Business.
BASIS OF APPEAL: Section 274B of New York Town Law and Southold Town
Zoning Code, Article XIII, Section 100-IOIB(6) which provides for certain
fully enclosed commercial recreation facilities, as well as other business
uses.
PROJECT DESCRIPTION: Use of a portion of the existing building, referred
to as Unit #8, for recreational activities (for children).

ACTION/ RESOLUTION ADOPTED: Granted as applied.
REASONS/ FINDINGS: 1) The zoning code provides for authorization of this
particular use, and related accessory uses, in this B-General Business Zone
District;
2) the use requested is reasonable in relation to the District in which is
is located, adjacent use districts, and nearby and adjacent uses (motor
vehicle repair site to the east, other business uses on the subject site,
retail sales (liquor), bagel-bakery with on-site service; restaurant and
deli uses, and other business uses in very close proximity);
3) the Special Exception use will not prevent the orderly and reasonable
use of adjacent properties - the use in question will occupy the existing
building without any new areas;
4) the use will not prevent orderly and reasonable uses proposed or existing
in adjacent use districts, for the same reasons as noted in,#3 above.
5) No evidence has been submitted to show that the safety, health, welfare,
comfort, convenience, order of the town would be adversely affected, and it
was decided by the enactment of this Code in January 1989, and subsequent
amendments thereto, that this use shall be an authorized use, with or
without conditions related to the particular project;
6) all units and site access-egress areas shall continue to be accessible
for fire and police protection, as well as right-of-way areas, and this unit
must continue to meet all fire/building regulations.
7) no other adverse conditions were found after considering items listed
under Section 100-263 and 100-264 of the Zoning Code.

our November 19, 1996 Meeting.
As required by the Suffolk County Administrative Code, the County
Planning Commission is reviewing this local action affecting property located

I am writing this letter on behalf of Theresa Walker and Kid `N Round. I have been the
recreation supervisor for the Town of Southold for the past 9 years and can honestly say
that the programs she offers are much needed and very well received. Parents of young
children are constantly looking for worthwhile, educational, fun, and interesting
programs for their children. Kid `N Round definitely provides these programs.
Any assistance you can give Mrs. Walker with Kid `N Round would be greatly
appreciated. We offer joint programs on a continual basis (see attached) and I would like
to see these programs continue unimpeded.

subject application indicating that no significant adverse environmental
effects are likely to occur should the project be implemented as planned,

Shopping Center at N/s CR 48, East of Youngs
Avenue, Southold
Last Thursday, we received a PB staff response* to a ZBA request
for comments regarding the above property (a copy of which is
attached).
Since the expansion of the original building has been built and has
received Certificates of Occupancy, please let us know whether or not
the ZBA may proceed on a prospective tenant's request for a Special
Exception to "occupy one of the units" with a children's recreational
use (provided by Section 100-10IB-6). Copies of the Certificate of
Occupancy* for this area to be re-occupied are also attached for your
convenience and review.
If, however, it is the position of the Planning Board that it will
require site plan approval, it would be appreciated if you or the
Planning Board could directly notify the owner as to the steps
involved. We have provided a courtesy copy of the PB's informal
response to the tenant, Mrs. T. Walker d/b/a Kid N'Round, who has
indicated she would pass the information on to the owner, Anthony
Pirrera, in Nevada.
We will await your response before closing the ZBA hearing on Decem-
ber 12, 1996. Thank you.

The Planning Board has reviewed the preliminary site plan and finds
it to be satisfactory. The compressors will be screened from view by
a berm and double row of evergreens. The noise level of the gas
compressor is not of major concern because it seems to be within
acceptable limits and will be operating primarily during electrical
outages. Also, the proposed elevation of the compressors and the
berm should mitigate whatever noise may be generated.

has not been completed and endorsed by the Chairman.
Please submit the requested. floor plan as soon as possible
so the Board can authorize the Chairman to endorse the plan.
When the floor plan is submitted and endorsed the Building

reviewing an application shall provide for the giving of notice:
A. By causing a notice giving the time, date, place and nature of the
hearing to be published in the official newspaper within the period
prescribed bylaw.
8. By requiring the applicant to erect the sign provided by the Town,
which shall be prominently displayed an the premises facing each
public or private street which the property involved in the application
abuts, giving notice of the application, the nature of the approval
sought thereby and the time and place of the public hearing thereon.
The sign shall be set back not more than ten (10) feet from the prop-
erty line. The sign shall be displayed for a period of not less than
seven (7) days immediately preceding the date of the public hearing.
The applicant or hisiher agent shall file an affidavit that slhe has

I would like to say I am writing on behalf of Theresa Walker, Kid N' Round,
however, my motives are selfish ones. M5. Walker provides us with a safe,
clean, fun environment for our chi Idren to play in and learn to play with each
otner
Kid N' Round is a community gathering place, where not only my son, but
have m-ide friends The service Kid N' Round provides is especially
appreclcted in the winter months when playgrounds are not accessible and
there is really nothing for one to two year olds to do. Additionally, I believe
Kid N' Rot,-,d, directed by Ms. Walker, was essential in my son's gross-motor
and soc.at development over the past eight months.
We ask that the town take the needs of our little ones into consideration and
assist [Is walker in her endeavor. We are looking forward to retuning to
Kid N Pound in its new location at Villacie of Southold Shopping Plaza.
