SCTM# 1000-81-3-19.6 The parcel is subject to the following Covenant and Restrictions L11516: P586 and L11514: P519 placed on the property during the original subdivision. 4. No grading shall be permitted within 50 feet of the top edge of the bank except that which may be necessary to control or remedy erosion or to prevent stormwater from flowing over the edge of the bank. ' 5. The woodland nature of the premises are to be preserved except where the removal of such trees and shrubs are necessary for construction or maintenance of access driveways to the lots. Land Use Ecological Services, Inc. on behalf of JOHN PETROCELLI, SR. requests a Wetland Permit to construct a 1,892sq.ft. one story single-family dwelling with a 7'x12' front porch and a 14'x20' rear patio; install a sanitary system on the south side of the dwelling; install gutters to leaders to drywells to contain roof runoff; installation of a driveway with drywells to contain runoff; a line of staked hay bales with silt fencing to be installed prior to and during construction; and construct a 5' wide set of bluff stairs to beach with attached 14'x25' deck. SCTM# 81-3-19.6 The proposed actions have been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP).Policy.Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the below Policy Standard and therefore is INCONSISTENT with the LWRP. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. 1. The regulated natural feature in is the Top-of bluff. The setback is incorrectly shown from the concrete bulkhead. Chapter 275 defines a SETBACK as the minimum distance by which any building, structure or operations must be separated from a wetland boundary, coastal erosion hazard line or bluffs. To further 4.1 Minimize losses of human life and structures from flooding and erosion hazards it is recommended that the structure be relocated to the greatest extent practicable to meet the required chapter 275 setback and minimize potential loss and damage from erosion hazards. In the event the action is approved: 1. Establish a 15' wide natural vegetated buffer incorporating existing vegetation (trees). A recommended definition for the natural vegetated buffer is as follows: A land area of a certain length and width where existing vegetation occurs prior to the commencement of any grading or clearing activity....Maintenance activities within the buffer are limited to removing vegetation which is hazardous to life and property, trimming tree limbs up to a height of 15 feet to maintain viewsheds, replanting of vegetation and establishing a four- foot-wide access path constructed of pervious material for access to the water-body. 2. Restrict the clearing of trees in the Board's jurisdiction to comply with covenant and restrictions. 3. Restrict grading within 50' from the top of bluff to comply with the covenant and restrictions. Currently, there is a garage on the property and cleared areas. The property owner seeks to construct a 1- story residence containing 3 bedrooms and a basement. The proposed house is 1,892 square feet and accessory structures include a 7 foot by 12 foot front porch and 14 foot by 20 foot rear patio. There is currently no access to the beach down the vegetated bluff. New 5-feet wide beach access stairs and a 14 foot by 25 foot deck are proposed to allow access to the beach and Southold Bay for water-dependent recreation and enjoyment. A concrete bulkhead exists along the toe of the bluff on this property; a timber jetty also exists on the shoreline.No work is proposed to these existing shoreline structures. A new sanitary system was designed based on the proposed 3 bedrooms within the house and consists of a 1,200 gallon septic tank and an 8 foot diameter by 12 foot deep distribution pool on the south side of the house. The sanitary system is proposed 65 linear feet from the top of the bluff. The sizing of the sanitary system and the room for expansion are in accordance with the Suffolk County Department of Health Services residential standards. There was no groundwater encountered down to 17 feet below grade as shown on the test hole data. All stormwater runoff accumulated from the roof and the driveway will be stored in the proposed drainage system designed for a 2-inch rainfall event. The proposed drainage system consists of two 8 foot diameter by 4 feet deep drywells for the house and nine 8 foot diameter by 8 foot deep drywells and two 8 foot diameter by 5 feet deep drywells for the driveway. The proposed house is strategically located to preserve the very large beech trees on the property. The beech trees to be preserved are shown on the site plan west of the proposed driveway. The proposed small house is the minimum necessary for the property owner. The proposed area of disturbance is 31,572 square feet. Haybales and silt fencing is proposed around the construction area of the house to prevent any sediment erosion from.entering adjacent properties or the tidal waters of Southold Bay. The construction area is relatively flat with a slope of less than 5%. No work or disturbance is proposed within the tidal waters of Southold Bay. The seaward edge of the proposed deck is 75 linear feet away from the existing bulkhead and 89.1 linear feet from the spring high water mark (tidal wetland boundary). Although the enclosed application questions are answered for all of the proposed work over the entire property, the actual Trustees jurisdiction line (100 foot setback from the spring high water line/tidal wetland boundary) is shown cutting through a portion of the proposed deck on the site plan. The Trustee jurisdictional area encompasses approximately 80% of the proposed deck (in the rear), the rear patio area and the beach access stairs and deck. All other structures, including the house, driveway and garage are outside the 100 foot wetlands jurisdiction. Land Use Ecological Services,Inc.
