COUNTY TAX MAP DISTRICT 1000, SECTION 14, BLOCK 2, LOT 1.8. 13ASIS OF APPEAL: Building Inspector action dated November 13, 1996 concerning location of accessory gazebo (existing without a building permit since about 1984-1985), and which under Article XXIII Section 100-239.4 adopted September 1985, is less than 100 ft. from the bluff. RELIEF REQUESTED: Accessory structure (not building) is an open gazebo secured at ground with piers (cement) situated approximately 10 ft. from the edge of the bluff, and which has existed for more than 11-12 years. MOTION BY Member Villa, SECONDED BY Members Doyen and Tortora ACTION/RESOLUTION ADOPTED: Granted insufficient setback location WITH THE CONDITION THAT: (a) there shall be no changes reconstruction, rebuilding, except that routine maintenance such as painting or replacement of a single board shall be permitted; (b) when other than routine maintenance, the subject structure shall be located as required by the code (presently 100 ft. from the bluff) or greater to meet the future code requirement in effect. (No plumbing, of course, should be added since this is restricted to a gazebo.) REASONS/ FINDINGS: Although the hardship is self-imposed (by former owner or builder), gazebo is not a permanent building or a substantial structure, and is viewed as temporary in its present location without adverse affects to neighbors or adjoining properties. The gazebo is built ulon concret footings and is located approximately 101 from the top of the. bluff. Applicant was unaware of this problem at the time of the purchase of said premises in 1988 and is now in:contract to sell said premises. STRICT APPLICATION OF 111E ORDIHANCE would produce procticnl difficulties or unneces- sorylIARDSt~IIP because the existing "as built" gazebo is attached to. concrete footings and would be extremely difficult to relocate. Additionally, the residence itself is built up to the 100' setback line, so that the gazebo could not be located a sufficient distance from the top of the bluff, so as to comply with the requirements of the Zoning ;Ordinance. 7_ The hordsbip created is UNIQUE and is not shored by all prnperties alike in the irnmediote vicinity of tbi5.property and in tbis.use district because the residence is built up to the set back line of 100' from the top of the bluff, so that the gazebo could not be located a sufficient distance from the top of the bluff, so as to comply with the requirements of the Zoning Ordinance. I 3. The Variance would observe file spirit of the Ordinance and WOULD NOT CIIAhIrE THE CHARACTER OF THE DISTRICT because the gazebo has existed "as built at its present location since approximately 1985.
