SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated October 30, 2014 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: Subject Parcel is located in a B Zone and is improved with a 16,061 sq. ft. one story metal building. The parcel has 170.33 feet of frontage on Moore's Lane, 305.73 feet on the southerly side, 302.39 feet on the northerly side, and 169.49 feet on the easterly side. As shown on the survey provided by Nathan Taft Corwin, III,Land Surveyor, dated January 28, 2014 last revised October 14,2014. BASIS OF APPLICATION: Request for Variances from Article XI, Sections 280-50A and 280-49 and the Building Inspector's May 30, 2014, renewed July 30, 2014, Amended October 6, 2014 Notice of Disapproval based on an application for building permit for addition and alterations to an existing commercial building, at; 1) less than the code required front yard setback of 100 feet, 2) more than the code permitted maximum lot coverage of 30%. RELIEF REQUESTED: The applicant requests variances to construct a one story office addition to the front of the existing metal building with a front yard setback of 26.6' where the code requires 100 feet and lot coverage of 33.4%where the code allows a maximum of 30% lot coverage. ADDITIONAL INFORMATION: This parcel has had several variance applications before the Zoning Board. File # 353 in 1961 granted temporary amusement use. File #399 in 1961 granted to construct a bowling alley. In 1962 file #434 granted a reduced front yard setback for a cooling tower. Under file #653 in 1964 denied permission to paint the words BOWL and RESTAURANT on the southern roof. File#1513 in 1972 granted permission to rebuild a non-conforming business building. And lastly, granted permission to reduce front and side yard setbacks to construct additions under file#2366 in 1977. Page 2 of -November 20,2014 ZBA#6801—170 Moore's Lane Realty Corp. SCTM#1000-45-7-3 • FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on November 6,2014 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The property is zoned business and is surrounded by other businesses, a school, park, Public Utility Company and a few residential properties. The property has historically been used for business. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. This is because of the size of the building which has been in existence for more than 40 years, and is currently used as a moving and storage company which is a conforming use in the B zone. The present applicant wishes to construct an attached office to a portion of the front of the building. Any other location for the proposed office would either obstruct circulation around two sides of the building and would still require a variance, or if added to the rear would reduce parking flow for vehicles 3. Town Law §267-b(3)(b)(3). The variance granted herein is not mathematically substantial, representing 11% relief from the code for the lot coverage. The variance granted herein for the front yard setback is mathematically substantial, representing 73% relief from the code. However, the applicant submitted documentation showing the average front yard setback for the road to be 24.1 feet and the proposed addition will be setback further than the average. - 4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will not have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an office addition while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member Weisman (Chairperson), and duly carried, to GRANT, the variances as applied for, and shown on the survey prepared by Nathan Taft Corwin, III Land Surveyor dated January 28, 2014 last revised October 14, 2014. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the varrance(s)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when Page 3 of 3-November 20,2014 ZBA#6801—170 Moore's Lane Realty Corp. SCTM#1000-45-7-3 involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity Vote of the Board: Ayes: Members Weisman (Chairperson), Schneider, Horning, Goehringer, Dantes. The action is to construct a 1,140 sq. ft. building in the location of an existing concrete pad; and WHEREAS, on November 6, 2014, the agent for the applicant, Colin Ratsey, submitted the remaining application materials to the Planning Board; and WHEREAS, on November 14, 2014, the Planning Board, pursuant to Southold Town Code §280-131 C., distributed the application to the required agencies for their comments; and WHEREAS, on November 20, 2014, the Zoning Board of Appeals issued a decision for File #6801, granting a non-conforming front yard variance of 26'6" and a lot coverage percentage of 33.4% (LI = 30% max) with no conditions; and WHEREAS, on December 10, 2014, the Southold Town Engineering Inspector reviewed the above-referenced application and determined that the proposed drainage meets the minimum requirements of Chapter 236 for Storm Water Management and required revisions to the Site Plan so the drainage calculations and drainage depictions on the Site Plan are consistent; and WHEREAS, on December 15, 2014, a public hearing was held and closed for the above- referenced application; and WHEREAS,—on-December—l8-2014,—the-Southold Town-Fire-Inspector_reviewed_the proposed Site Plan and determined that there was adequate fire protection and emergency -- ---- — WHEREAS, on January 1, 2015, the Town of Southold LWRP Coordinator reviewed the above-referenced project and determined the proposed project to be consistent with Southold Town-LWRP-Policies-with recommendations for additionallandscaping_and the practices of on-site water quality controls; and WHEREAS, on January 21, 2015, the agent to the applicant, Colin Ratsey, submitted revised Site Plans sufficiently including the revisions required by the Southold Town Engineering Inspector and the Planning Board; and WHEREAS, pursuant to §280-133 C, the Planning Board has the discretion to waive any or all of the requirements of§ 280-133 by resolution at a duly noticed public meeting, for those applications involving modifications to existing structures with no substantial change to the existing footprint, where the Planning Board determines that such modifications or any change in use will not require significant changes to existing major site design features, as well as applications involving uses strictly related to agriculture (but excepting retail winery operations), if it determines such requirements are not necessary to protect and maintain the public health, safety, or welfare and to further the objectives set forth in §280-129. The Planning Board has found that requiring the entire set of Site Plan Application requirements for this site is not necessary to further the objectives set forth in Town Code §280-129 and maintain public health, safety, and welfare for the following reasons: the application is for a small office.addition (1,140 sq. ft.) being placed on an existing concrete pad; the office 170 Moore's Lane [3] February 10, 2015 addition will not be open to the public and will not increase the amount of employees on site; and WHEREAS, the Southold Town Planning Board, pursuant to Southold Town Code §280-131 B (5), has the discretion to vary or waive the parking requirements for Site Plan Applications where doing so would not have a detrimental effect on the public health, safety or general welfare, and will not have the effect of nullifying the intent and provision of the Site Plan requirements chapter of the Town Code. The Planning Board has found that this application is eligible for a waiver of parking requirements because the office space and associated office employees are being moved from inside the existing building to this new location to make more storage space inside the existing building; and WHEREAS, at their Work Session on January 28, 2014, the Southold Town Planning Board determined that all applicable requirements of the Site Plan Regulations, Article XXIV, §280 — 130 Site Plan Approval of the Town of Southold, have been met; and WHEREAS, on February 6, 2015, the Southold Town Chief Building Inspector reviewed and certified the proposed warehousing use as a permitted use in the Light Industrial Zoning District pursuant to ZBA File #6801; therefore, be it RESOLVED, that the Southold Town Planning Board hereby waives the following Site Plan Application requirements: §280-133 B(1)(f), B(1)(g) and B(1)(j); B(2)(d); and be it further RESOLVED, that the Southold Town Planning Board hereby waives the parking -------requirements-as-detailed-above;and-be-it-further._ --_— _ RESOLVED, that the Southold Town Planning Board has determined that this proposed action is a Type II Action and not subject to review under SEQRA; and be it further RESOLVED, that the Southold Town Planning Board has determined that this proposed action is consistent with the policies of the Town of Southold Local Waterfront Revitalization Program; and be it further RESOLVED, that the Southold Town Planning Board grants Approval with One (1) Condition to the survey for SCTM#1000-45-7-3, dated January 28, 2014, last revised January 20, 2015, prepared by Nathan Taft Corwin III.
