When you do an agenda item and you'll transfer from one budget line to another, those budget lines don't necessarily appear here in this same wording, correct? They are more general? SUPERVISOR RUSSELL: The budget lines on the detail? Do you have the detailed budget.. JUSTICE EVANS: Our work papers have it. SUPERVISOR RUSSELL: Yes, it would. Actually, you.should have the accounting.... MR. DUNN: Let me give you a for instance. Let's just say you found out in November you were running out of money for the police overtime.... SUPERVISOR RUSSELL: Okay, I see what you are saying. MR. DUNN: And you transferred money out of another thing... SUPERVISOR RUSSELL: On that budget, no. When I did the tax, when I did the budget community discussion what I did was I included the budget work papers which breaks it down line by line but no, that doesn't. For accounting purposes we have, if you look on personnel, it will be broken down with three or four lines with more specificity but for the budget it isn't. I can always get you a copy of the work papers which will show you line by line... MR. DUNN: So there is another kind of... Yes, it's the work papers that the Town Board uses, so we generally, you know, they are work products but I make them available to anybody that wants them. I will get you one. COUNCILMAN GHOSIO: Are you talking about in general when we make a budget modification during the course of the year? MR. DUNN: Yes, you find something where you come up short. COUNCILWOMAN DOHERTY: We have one on tonight's agenda. SUPERVISOR RUSSELL: Yes, that would be, when you look at that.... MR. DUNN: I will give you a for instance. You will take money out of Goldsmiths, I know you set aside a certain amount for that, and you'use it for something else but Goldsmiths never appears here, I guess it appears on the other item you are talking about. Right? SUPERVISOR RUSSELL: Goldsmiths would.... MR. DUNN: I am not talking specifically about that, I just know that that's an example. COUNCILMAN GHOSIO: When we make a budget modification in July, to move money from place to place... JUSTICE EVANS: This is not final, this is just what we work from.... COUNCILWOMAN.DOHERTY: Each line item on the budget has its own number. MR. DUNN: Right. • COUNCILWOMAN DOHERTY: So when we are switching out, it might be under the same department... MR. DUNN: But those numbers aren't reflected in here, correct? COUNCILWOMAN DOHERTY: They are on here. SUPERVISOR RUSSELL: No, he doesn't have the accounting numbers. COUNCILMAN DINIZIO: What he is talking about is like when we do an appropriation from last year, last year's budget or money that was left over or not. MR. DUNN: Right. COUNCILWOMAN DOHERTY: Oh, okay. Southold Town Board Meeting page 28 November 4, 2015 COUNCILMAN DINIZIO: We don't anticipate switching money in the budget. MR. DUNN: You can't be exact, I understand. COUNCILMAN DINIZIO: I don't think we even anticipate it, we just, if we need money from one line and want to transfer it to another, we just find a line that's appropriate and transfer it. We are going to do it tonight - MR. DUNN: Right. There's two or three.... SUPERVISOR RUSSELL: Just in the interest of clarity, this is the general budget proposal you have. We do have a budget work papers that breaks it down line by line... MR. DUNN: Oh, okay. SUPERVISOR RUSSELL: It also shows what we had allocated for 2015, what we have spent so far and then what we estimate spending. MR. DUNN: Inaudible. What you will need for 16. SUPERVISOR RUSSELL: Right. MR. DUNN: Thank you. SUPERVISOR RUSSELL: Sure. Would anybody else like to address the Town Board on this proposed budget? (No response) What I do want to quickly cover is, I know you have probably been reading about it, the Southold Town Board is discussing the prospect of perhaps moving money back into the budget to bolster the fund balance. It is just a discussion. This current budget, as it is proposed, does not include any of these changes. What I did was I outlined the changes for the Board just to give them an understanding of what might happen should the Board want to put money back into the budget to bolster the fund balance line. And if we were to add the $250,000 which we took out of the fund balance, if we were to add that back for the highway fund, the increase on the tax rate would be .86 percent which would develop an overall tax rate of 2.16. The current budget that is subject to this hearing actually calls for a 1.3, so it would go from a 1.3 percent to a 2.16. If we added $500,000 to just highway, the overall tax increase would go to 3.01. If we, instead of adding it to highway, added it to the general fund of the town, if we added $500,000, the overall tax increase would be about a 2.93 %. It comes at a little less than if we added the $500 to just highway because the general fund of the town has larger assessed value than the highway fund because the highway fund excludes the Village of Greenport. So when you are taking the same amount of money and you are splitting up less assessment, the rate would go up higher. Those are some of the things we talked about as to what we are going to do as a Board. I know we discussed it today. the Board is going to have to, I guess they are going to ponder it and then make decisions on the 17th. If we had to do something, if we do something it would have to be done by the 17`", prior to the adoption of the budget. Southold Town Board Meeting page 29 November 4, 2015 MR. DUNN: If you have to do it, you have to do it. I don't have a problem with it. When you go over the 2 %.... SUPERVISOR RUSSELL: No, the way the 2 % is calculated and this is another thing, the overall tax rate, to complicate things, would actually go down still. There's a separate line on your tax bill, I believeit might say Article 7, Suffolk County Real Property tax law, I haven't seen my tax bill in a while but it's one of the bottom lines. That is the amount of money that gets reimbursed by Suffolk County each year to property owners who are successful in grieving their taxes, so they get a reduction in assessment. Generally the taxes are paid in advance of that reduction. They get a refund. Sometimes the refund could be for the past two, three, four years, depending on the case. All of that money is paid out by Suffolk County. They collect it back in that line when the tax bill goes out each December. So Suffolk County makes itself whole by extending that. For tax cap purposes, that gets factored into the town tax rate. So the reduction, it substantially increased last year, very unique settlement. Went from about a little over one million dollars to 2.3, 2.4 million in one year. This year it actually went down to about $954,000. So theoretically, by reducing that line that much, the town is removed that much from spending, even though it really hasn't. The consequence of the tax line is that we get held accountable when the number goes up, even though it is beyond the control of the Board but at the same time and with all due candor, we get credit for it when it goes down even though, again, it is outside our aegis. But because that line went down about 60 % this year, when you factor that back into the tax rate, the overall tax rate goes down substantially which allows us to raise actually the town taxes, we could actually raise them to about 5.82 % and still be under the cap. In fact we would still be under the cap by just a little bit. Not that I am proposing that, so please do not misconstrue the fact that I want to raise taxes 5 % after an election, that isjust simply not true despite some probably accusing me of that. Anybody else? (No response) 2016 Budget Hearing 7:00 PM SUPERVISOR RUSSELL: At this point, would anyone like to come up and comment on any of • the proposed budget items? PETER HARRIS: Good evening everybody. First of all, congratulations to everybody in the elections. I am here tonight to bring up a, ask a question, the fact that I would,personally, like to see the Town Board in the Highway Department, their operating budget, under general repairs, DB5110, there is a line for paving. The town receives over $420,000 from the State of New York through the CHIPS program. I personally feel, having been the prior superintendent and that the Town should mirror the State's allotment for resurfacing of roads matching, I mean, I believe and please correct me if I am wrong, this year the town had budgeted $175,000 originally in resurfacing: Years ago, $175,000 went a long way. In 2015, $175,000 doesn't go far at all. I feel that the town relies a tremendous amount on what we receive from New York State and this year I believe they got an additional $63,000 because and not just Southold, every township in the State of New York because it was such a terrible winter and an adverse effect on our roads and with what is allocated through the state and what you have in the general repairs budget, you Southold Town Board.Meeting page 30 November 4, 2015 never are going to catch up. I mean, there's over 400 miles of road, multiply that by 2, there's over 400 lane miles of road and I just feel that Superintendent Orlando, they have resurfaced a fair amount of roads but it's really, it's a drop in the bucket what still needs to be done. And for $400,000 over the course of your entire budget, from where I am standing on this side of the microphone, $400,000 is a drop in the bucket. That your road system in this town is one of your major things that we own and we are responsible for the safety and well-being of the traveling public, so from citizen Pete Harris speaking, $400,000 compared to $400,000 from the state just to minor that contribution that gives the Superintendent of Highways that $800,000 a year amount of money to spend to upgrade our roads. Thank you very much. SUPERVISOR RUSSELL: You are right, Pete. Just for this year, the budget that is being proposed, we had actually allocated outright $250,000 plusin talking to Ken LaValle I was able to get another $250,000 plus CHIPS, at least for the following year but your suggestion is something we probably should have been doing all along. MR. HARRIS: Thank you. SUPERVISOR RUSSELL: Thank you, Pete. Would anyone else like to address the Town Board on the budget? (No response) Okay, what I should again is explain the fund balance discussion we had today, that way it's on camera. Go ahead, Bob. ROBERT DUNN: I don't know if this is really appropriate for the budget but it's about income. We ordered the windrow turner, has been ordered or is being ordered, I am sure there is going to be some legal stuff. Regardless of that, the product that is made there I think is very good and it sold for a penny and a half per pound, there is a company called Hamptons something and they produce out of Yaphank basically the same product that I saw sold in a bag in Waldbaum's for $9. I think it was about 30 pounds, which would be 100 times what we are getting for it and I was just going to suggest as a point of income, we consider bagging it and selling it in a bag. I think it would be foolhardy.... SUPERVISOR RUSSELL: I would agree. It's compelling, several years ago under a different Town Board, Bill, were you on it at the time? We were proposing to buy a bagging machine and we had actually bought a building to house the building machine. We ran into some problems with regard to OSHA, concerns on the part of the union, ventilation, all of those things. Also, the building itself, we came in substantially higher. Just... MR. DUNN: We have a building that we used to use for three separate recycling, we doubled, Inaudible, that we are not fully using as well as we could. SUPERVISOR RUSSELL: That's a fair point. I am just trying to remember what building that is. COUNCILMAN RULAND: The best way to describe the whole situation is between a rock and a hard place. There were two options, the Town could purchase the equipment and bag the material themselves, we ran into substantial union problems. Then we said the other option is we Southold Town Board Meeting page 31 November 4, 2015 will have an outside contractor come, bag whatever you want, 10,000 bags, no, because the union has rights to the work that they didn't want to do. MR. DUNN: Why wouldn't the union want to do it? COUNCILMAN RULAND: They never really said. SUPERVISOR RUSSELL: I am not so sure they weren't willing to, they wanted to make sure that first of all, we would not hire more people to have appropriate personnel and then when you start factoring personnel costs versus profit margins, it gets tight. It's very expensive to hire new help. MR. DUNN: Agreed. You would need to do it with the staff that you have. SUPERVISOR RUSSELL: Well, that wasn't going to be likely in that environment, in that scenario. Things have changed a little bit down there, it's probably a subject for discussion we can have now. MR. DUNN: Even if you turned out and made a deal and said, we get four guys in on Saturday and bag stuff SUPERVISOR RUSSELL: I think this is a discussion we should have, it's a good idea. The one thing I would say... MR. DUNN: Let me just ask you something, I will give you questions for, I am talking more the marketing side of, who in this town, retail, would want to be selling something called Hamptons when they could have something called Southold when they do business in Southold? SUPERVISOR RUSSELL: I agree. I agree. One thing we haven't done well is market, it is a good product... MR. DUNN: A very good product but people don't want to go and fill their trunk but they do want to, I mean you could have a stack of them at the dump and like-I say, some of the landscape stores I am sure would be happy to carry the product. They have to carry a product and why not that product as opposed to somebody else's? SUPERVISOR RUSSELL: Well ironically, some of our landscapers are paying wholesale prices from us and then turning around and charging retail prices.... MR. DUNN: That's fine, that's their game and they will continue to do it. SUPERVISOR RUSSELL: That's right. MR. DUNN: The other thing I was going to say, as some of you know, I was in the-construction business, one other way. I kept people happy on the job, I was usually a supervisor in one Southold Town Board Meeting page 32 November 4, 2015 capacity or another, one of the ways I kept guys happy on the job was I kept a mungo pile, scrap, and most of the guys didn't even know what it was for but at some point in the job, everybody would get a little check. I watched our metal pile, we sell our metal as mixed metal which is the lowest price you can get and again, I mean, if somebody spent an hour a day there with a magnet and a couple of 50 gallon barrels and just took the good stuff and just put it aside and we sold it for its full values because somebody is making a lot of money on that. I mean if you go there on any weekend towards the end of the summer and see how many aluminum chairs we end up selling for mixed metal, it's just, my grandfather told me something very early, watch your nickels kids. They add up. SUPERVISOR RUSSELL: You are right. MR. DUNN: And I know, if it was $5,000 here and $8,000 here, well, maybe you would have more money for asphalt. Just a point. SUPERVISOR RUSSELL: I just want to quickly let everyone know about the fund balance discussion we had today, I know it has been reported. Basically the current budget does not include any changes, the proposed tax rate of 1.3% which was part of the preliminary budget, is still intact. What we did was discuss the fund balance, although it is still very healthy, when you see trends, when balances start to get reduced from year to year, you need to discuss it to see if there's some action that needs to be taken to counteract that. You are all aware of$250,000 we pulled out of the fund balance this year to cover asphalting, there was a discussion as to whether we should restore that in next year's budget. If we were to restore that money, it would result in a tax increase of.86 % added to the 1.3, so it would be a total overall tax increase of 2.16%. if we were to add $500,000 which is $250,000 plus a reasonable cushion, it would have an impact on the tax rate of adding 1.71% which would have an overall tax increase of 3.01. Remember those are in the context of the 1.3% that is being proposed. We could add the fund, instead of directly to highway, we could add it into the general fund wholetown because that's a larger assessment picture, that's a larger assessed value than the highway department, the impacts would be a little bit less. Adding $500,000 would increase the tax rate about 1.63% with an overall tax rate of about 2.93%. Just to put it in perspective to people, if we added as much as a $1,000,000 to the general fund, that would result in an overall tax increase of 4.56%. And I am going to repeat what I said today, nobody is proposing adding $1,000,000 back to the budget and raising taxes 4.56%. I am just trying to illustrate what the impacts are when we manage the fund balance. The way the property tax cap works is it doesn't just calculate what the increase of the tax rate is for the town portion but rather the performance of other taxes that are located on the tax bills. One of the lines is called what people probably see as Article 7 line, it says Article 7 RBTL, something along those lines. That is the amount of money that gets refunded to taxpayers each year that are successful in reducing their assessments. It gets reimbursed directly from Suffolk County, then Suffolk County collects that money back in that next tax cycle. Basically they keep themselves whole by paying the money out now, then taking it back later as part of that tax line. There was a substantial increase last year because of a unique settlement, that number has gone down quite a bit this year, something like $1.3 million plus. Theoretically that gives the town the ability to spend up to $1.3 million for general fund purposes and still come in compliant with the tax cap. Again, no one is suggesting that we spend $1.3 million but it does Southold Town Board Meeting page 33 November 4, 2015 provide room in the cap and the Town Board has to think about if we have a fund balance that we are not restoring and then we have to think about consequences down the road what might happen. We might find ourselves in a situation where the fund balance is so tight, we can't appropriate any over to a new budget, in which case we would have to pierce the cap in a future year. if you pierce the cap, you have concerns about next year is the third year of a tax credit rebate through New York State that would possibly jeopardize the rebate that is due property owners, if towns comply with the cap. The consequences of adding to the tax rate right now particularly when they are nominal amounts would be far less at cost to the homeowners then were we to let the tax cap get pierced and people lose that credit. I am not saying we have to pierce the cap, I am just saying it's something we need to keep an eye on. The fund balance is very important to the town and we have to think about making sure that we either maintain it at its very healthy, current level or at least making it grow a little bit back to previous levels. There was something else I wanted to say, like I said, the balance itself right now is very healthy but we want to consider future impacts. MR. DUNN: Inaudible. SUPERVISOR RUSSELL: Well, because we have so much room and still comply with the cap this year, we might want to consider making adjustments now to have the money in there to make up for a year where we probably don't have as much room. The one thing I would say is a lot of these weren't factored in the budget. I sit down and do the budget. I collect all the budget requests from the department heads in July, they are generally using information they have up until the end of the second quarter, how much money they spent through the 30th of June, maybe a little bit later. I sit down, I take those budgets the end of July, I sit down with the department heads each in August, so in some instances, department heads simply are just unaware yet of how much they are going to need as they move later in the year. We try to predict as best we can but because we weren't discussing the shortage in asphalt, that came tome in October, I wasn't able to account for it in the budget. I take the budget that is submitted by the department head and assume that includes all factors. In this instance, there were unique storm related costs that needed to be accounted for. However, that is a discussion the board is going to have. And if anybody has questions about it or simply doesn't understand it because I know when you talk about tax cap, you tend to lose a lot of people. I have been studying it for five years now and I still have a lot of uncertainty in understanding every aspect of it. COUNCILWOMAN DOHERTY: And I just want to note, you mentioned before, you mentioned that we have to make a decision by the 17th. SUPERVISOR RUSSELL: Yes, we have until the 17th which is when we were scheduled to adopt the budget. COUNCILMAN DINIZIO: If you are talking about pay me now, pay me later. You listen to • what Peter said, you know we have roads that existed, we need to continue to have exist... MR. DUNN: Inaudible. Southold Town Board Meeting page 34 November 4, 2015 COUNCILMAN DINIZIO: Right. Exactly. MR. DUNN: Inaudible. COUNCILMAN DINIZIO: It goes down the line, it's everything. You lower the amount of money you have available to make up a budget next year, then you know you end up having to borrow, you end up having to do all of the things that we try to avoid. MR. DUNN: Inaudible. COUNCILMAN GHOSIO: As I said this morning at the work session, sometimes when you have to deal with these fiscal realities, particularly in business, you may not be happy about it but it's the responsible thing to do and in this particular case, I don't think we necessarily are happy about it but the responsible thing to do is to plan and that's what part of this is all about. SUPERVISOR RUSSELL: And again, the budget that we proposed, with the current proposal, the preliminary budget with the 1.3% still leaves a very healthy fund balance. We are not suggesting the fund balance has reached a crisis but when these opportunities present themselves and there's again, unique circumstances, unique costs, you might want to at least, the responsible thing to do is look at those circumstances. And again, when you are producing a budget in August, using receipts through the end of June, you don't have, you know, you develop a better understanding of those costs as you get later in the season, when the superintendent gets out and starts doing a lot of the asphalting. And that's why he came to us recently, had to make the adjustment. Anybody have any other comments on the budget? Closing Statements Supervisor Russell SUPERVISOR RUSSELL: That concludes the business of the agenda. I will just say to Pete, it's a pleasure seeing you and this winter when you are sitting in front of your fireplace and we are dealing with a major storm, I will be thinking of you. • COUNCILWOMAN DOHERTY: I will be calling you. Peter Harris PETE HARRIS: My neighbors love that I am home because I don't know how many different driveways I have plowed out. SUPERVISOR RUSSELL: Well, I said I would be thinking of you, I didn't say what I would be thinking. Would anybody like to address the Town Board on any issue? Sure. MR. HARRIS: This goes back to asphalt. When I was in office when I would get my budget, between with CHIPS and my paving allotment, I personally would go out and I would measure every single road personally that I wanted to be either micro-surfaced or asphalt and I would be able to keep a running tally of how much money I have to spend and how much bang for the buck that I can get done. I don't, I am only assuming that Vinny does the same thing but I Southold Town Board Meeting page 35 November 4, 2015 always knew when I ran out of money, when the money was getting to the end and how far I could go. I just was, you know, I can't speak for him but I personally as the Superintendent would go out and measure and I know that there is a formula that you calculate, square yards to get tons and what have you and this way here, not only is it good for your own purpose for bookkeeping but whatever contractor that you may be dealing with, you know you have got a piece of paper with figures on it how much you feel it should cost to either pave or resurface with micro-surface. You have already got a baseline number that would, you pretty much know how much that should cost so when the vendor comes up and says this is how much it is, if there is a big discrepancy, you say well, how can that be? I measured it, I figured it out and you know, we need to straighten this, sometimes it's, when I did asphalt and when a road runs true and narrow, it's pretty straightforward but when you are dealing with intersecting roads and your aprons are, your wings are a lot wider and figuring it out and you make, I always would figure in. a little extra just to cover, to make sure that I cover that. but what I am trying to say is that anyone should have a good understanding of how much money they have to spend in the course of year and then unless, again, something arises and you have a road that just totally falling apart and you have to come back to you people and ask for additional funding but you should be able to have a pretty good understanding of how much you have to spend and have it right on paper in front of you. That's it. Thank you. SUPERVISOR RUSSELL: Thank you, Pete. Would anyone else like to address the Town Board? COUNCILMAN DINIZIO: I would just like to address Pete's, you know he did come to us in March, Peter. Basically I don't think there was a lot of urgency but he did say that the winter was harsh and there were roads out there that needed, they were dirt. Basically the people were riding on dirt. And at that time, that was before most of the frost even got out of the ground and I think it just kind of crept right up, it was a terrible winter. You know that because you plowed everybody's driveway and sidewalk on the block. And I just think it's, you know, an extraordinary event that happened and you know.... MR. HARRIS: Again, by no means am in trying to.... • COUNCILMAN DINIZIO: No, no, I know that. MR. HARRIS: I can tell you, it's a difficult situation because you have so many miles of road that really need to be taken care of and you know, if you go to this town and you start doing work here and then the next town over, hey, what about me? My road is just as bad and you say, well, you know I have got to go on a scale of 1 to 10. This road is a 10, you are a 7 '/2 . He needs it this year more than, you know, I have only got X amount of dollars to play with. And people just, they have a hard time understanding that, it's, you are not trying to service someone because they are a.friend of yours or whatever, it's the road. The road is just falling apart, you have got to go take care of it in today's dollar amount, I have records from when Ray Dean was Highway Superintendent, back when Ray Jacobs first took over as Highway Superintendent and even back when Ray Jacobs had first took over from Ray Dean, they used to do half, half of the roads this year and then the next year they'd do the other half. Dollars and cents bought you a Southold Town Board Meeting page 36 November 4, 2015 • whole, back then most all your roads were tar and sand. They probably were a better road back then, tar and sand but the fact of the matter is you can't get good asphalt, hot asphalt, the liquid today to make that and people, first of all, wouldn't put up with tar and sand but it just shows you the progression of how expensive it is today to maintain your roads. It's probably the toughest job of any job including doing snowstorms and hurricane cleanups and whatever because the fact - that it's all said and done, the storm goes through and the roads are still there. COUNCILMAN DINIZIO: Yes and they have to be there. They have to be there. I mean, there are a couple of extraordinary examples and one is Peconic Bay Boulevard. It's falling apart and I think that no one really anticipated that, the road to get that bad in that amount of time. you know, we had this discussion with Vinny when he came in and I kind of got my lesson learned about there's two types of paving going on here that I was not aware of. This slurry that the put down, which is like a five year thing and then there's this 20 year asphalt which is really what we should be doing in the first place, you know, on most of our roads I think. MR. HARRIS: Technology on how they built roads years ago is they stripped off the topsoil and they put the material down. Today you go, a subdivision is proposed, they have to build that road to code. There's a process of, because just for the simple fact if they are not made to do that, then when they sell all their lots, if they put a substandard road in there, they sold all their building lots out and then they say, okay, Southold Town we want to turn the roads over to you. COUNCILMAN DINIZIO: Thank you. Well, in any case, I think we are going to get a handle on it and you are exactly right. The money we invest today will be money well spent, even if we have to raise taxes to do it in the springtime. SUPERVISOR RUSSELL: Any other questions?* Comments? Robert Dunn ROBERT DUNN: Robert Dunn. I have been holding on to these for a while now because I didn't want it to get caught up in the politicking. SUPERVISOR RUSSELL: Are they absentee ballots? MR. DUNN: No,just some subjects that I thought would be better said afterwards. There were two and a fraction of hot button issues this year and the mariculture, the rentals and almost the Mattituck rezoning and there were a lot of things that were said and I thought some of them were unfair to both the town and the board in that people were saying things were trying to be put in backdoor, quietly, cloaked and all that kind of stuff Jim and I have talked about this and I think tonight is one more example of there is no (inaudible) fee, there is no cloaks hiding or anything, there's nobody here. If you want to know what's going on, you have got to be here. I was, and you guys aren't hiding anything and you are as transparent as you could be. Anybody that would complain about it is just wrong. I was here about the shrimp lady's debut, it was as open as you could be, there may have been some procedural questions that could have been raised but it was open from day one. I attended code committee hearings, I attended agricultural committee, they were all open and nobody was trying to jam anything down anywhere, in fact, I know I made some comments that ultimately were put into the bill and as did some other people. So for Southold Town Board Meeting page 37 November 4, 2015 anybody who suggests that you weren't open and fair or there wasn't open and fairness about it, is just foolish. The same thing went with the rental laws. I mean, that kicked around back and forth for months. It wasn't something that was pushed through or (inaudible). It was done fairly and openly. As far as the, and we laughed about this last night, as far as the Mattituck re-zoning, I mean, people got up here and screamed and yelled and he withdrew it. I mean, how much more could you'ask? And I don't know, he may even have withdrew it prematurely but the bottom line is, people spoke up, got the opportunity to and he withdrew it. so I am just coming and it's really not for you guys, cause you guys know with your hearts, those guys are not here, that everybody should know that its' totally fair. Again, in listening to those issues over the last year. there's something that has bothered me, and I really tried to come up with a way to talk about it. I have heard a number of people get up, in here during various'issues, and complain about the people that aren't born here, they should be given no room in this room ever. We are • all here under this flag. When anybody sends me the tax bill, they don't ask me where' I am born. I understand Southold Schools is going to ask for a $9 million bond issue in December, when I get to pay my share of that, nobody is going to ask me where I was born. During the mariculture hearing, Mr. Gordon stood up and said I lived here for 11 years, when do I get to be a local. Somebody back there said never. That just shouldn't be tolerated. I mean, you wouldn't tolerate people in here with white sheets on their heads or Nazi uniforms. You shouldn't tolerate that. I don't need to prove anything to anybody, nor does anybody else. And as a matter of fact, I know that I am not the only person in the room right now that wasn't born here. Get my point across? SUPERVISOR RUSSELL: I agree 100 percent. MR. DUNN: That just shouldn't be allowed. I mean, there was, it didn't happen in this room. I think it was a follow-up on the (inaudible) set up that horse trail? And someone was commenting on it on-line, it's city people who are ruining it and there's no more places to ride horses, there's not one city person that's here that didn't buy a piece of land, probably from someone who was born here, so when they take the money and run, (inaudible). So we need to stop that in here. People have the right to their opinion but there's just things that shouldn't go on in here, for the future. The Mattituck parking lot, has that been resolved? SUPERVISOR RUSSELL: I just signed closing documents Monday. The one we are purchasing on Pike Street? MR. DUNN: You are going to or you will? SUPERVISOR RUSSELL: Pike Street? I signed the closing documents on Monday. We are just waiting for recording now, right? MR. DUNN: Now, is that mortgaged? How does that work? I didn't see anything on the agenda. SUPERVISOR RUSSELL: No, we bought that with capital funds. Southold Town Board Meeting page 38 November 4, 2015 MR. DUNN: Okay, so that's budgeted and you don't have to... SUPERVISOR RUSSELL: That's all budgeted. JUSTICE EVANS: We did pass a resolution at some point... MR. DUNN: And the figure was? SUPERVISOR RUSSELL: Authorizing the sale of bonds. MR. DUNN: Sorry? SUPERVISOR RUSSELL: We passed a resolution authorizing the sale of the bonds and then we bought it with the bonds. MR. DUNN: Okay. And the figure was? SUPERVISOR RUSSELL: $250,000. MR. DUNN: How many spots are there? SUPERVISOR RUSSELL: It's difficult to say. I think our engineer looked out there, a haphazard guess would be, I think 46. MR. DUNN: 46 at$250,000. So that's approximately $5,000 a spot? SUPERVISOR RUSSELL: Yes. MR. DUNN: Inaudible. SUPERVISOR RUSSELL: It might be more than that. I am trying to remember. The problem is it's not striked out. It hasn't been for years. MR. DUNN: Sure. Let's just say $5,000 a spot. Back in the spring there was a gentleman in here and he was complaining about some dumpsters in the other municipal lot and it kind of piqued my interest. At the time, those dumpsters were sitting on top of a landscape (inaudible), kind of precariously, really. They have since been moved and they are sitting in the lot. There's four of them and some additional oil cans. That to me is a kind of indirect subsidies to the businesses that use them. I don't know that that's fair to the people of the town. In addition to the fact that I don't know what our rules are but many municipalities have, including Nassau and New York,City, laws about where those cans can be placed. They can't be placed out in the open like that. There's also more cans of waste oil, cooking oil, which is waiting to become and if you don't know, I am sure Mr. Ruland does, it is waiting to become diesel fuel and it's sitting in the middle of our lot. There's a liability issue there, the gentleman raised the issue and I think he was right. They shouldn't be there. They really shouldn't be there and if they should be, they • Southold Town Board Meeting page 39 November 4, 2015 should be properly covered. And somebody should be paying for it because in fact, the people in the town, some of who can't afford to eat in those restaurants, shop in those stores, are being forced to subsidize them. As far as I know, that's the only place in town that that happens. I can think of a restaurant here in Southold that if the town was supplying them with land to use for their parking lot or garbage cans, there would be people in here screaming somebody should go to jail. SUPERVISOR RUSSELL: Namely my brother. MR. DUNN: I just, and there's a liability issue. SUPERVISOR RUSSELL: We agree. We are actually working on a license agreement to address those issues you just raised, it's actually in response to what the gentleman had raised. We had heard from other people, so we are working on licensing agreements with the owners that are required. I just want to get back to Pike Street for a second. I realize $5,000 a lot might sound like a lot of money but.... • MR. DUNN: Oh, I don't think it's a lot. If there's one thing I agree 100 percent, whatever that cost, I am sure you paid fair market.... SUPERVISOR RUSSELL: That was our requirement. MR. DUNN: I agree 100 percent on it, I think the town of Mattituck bears an unfair burden for commercial, that we all shop in Mattituck. Nobody shops on Mill Lane. Some of them bring their noisy kids there in the summer but I can live with that but nobody ever shops on Mill Lane. Mr. Softy truck can be a pain but other than that, nobody shops there. so if you give them people a little relief, I am all for it. but I just don't' think that we should be A, subsidizing businesses and B, taking on the liability for whatever might happen as a result of those cans, especially the waste oil. I mean, they are sitting there uncovered. I believe there might even be state laws about that, they are not supposed to be out in the middle of a parking lot. SUPERVISOR RUSSELL: Bill, will you attend to that? MR. DUNN: Sorry? TOWN ATTORNEY DUFFY: I will. MR. DUNN: The cans are just sitting there. TOWN ATTORNEY DUFFY: They were supposed to remove them and they did remove some of them but I guess they are back.... MR. DUNN: You know, you get some stupid kid, kicks them over and somebody comes through and slips, bingo, I mean the town is involved in a lawsuit because of a guy that was Southold Town Board Meeting page 40 November 4, 2015 involved in an illegal turn and another guy was drinking and somehow the town is getting sued, can you imagine how it would be if there was grease all over the parking lot. SUPERVISOR RUSSELL: Bill will address that with Stephen. Let me just mention, while we are talking about parking, one of the things I have been raising is the issue of creating a parking bank. When you develop a commercial property, you have site plan requirements to provide parking for the guests. If you live near a municipal lot, you can count the spaces in the lot, the municipal lot, in your site plan. So if you need to create six spaces on site but you have municipal parking, you can simply use the municipal parking to count towards the six. MR. DUNN: I heard that one with the guy who is trying to redo the development on Pike Street. SUPERVISOR RUSSELL: Well, what I suggested is we create a parking bank because if you are going to rely on municipal parking to satisfy your site plan, you have just gained an advantage on other businesses that don't have that luxury. So what I had suggested is creating a parking bank to have people, if they are going to use municipal parking as the parking bank, to pay for those slips, at least a reasonable amount of funds, so we can put that money into an account to acquire more, buy some more lots and to improve the ones we have. So hopefully we will be taking that up over the next year or so. MR. DUNN: How do you get to do that,just as, now that you brought that up? SUPERVISOR RUSSELL: Town code that's been around forever. I don't know what the genesis of it was but it has been part of the town code for many years. With regard to banking, being able to bank,parking banking, it's been part of the town code.... MR. DUNN: No, no. Being able to use, if you tell me I need six spots to open my business and I can say well, the town has got six spots across the street.... SUPERVISOR RUSSELL: How that came to be was part of the town code has allowed for it and it has allowed for it for many years but it is time to rethink that.... MR. DUNN: Yeah, yeah. SUPERVISOR RUSSELL: There's an equity in that. There's a value in that and the town should be able to get some of that value. Certainly in fairness to other businesses that don't have that benefit but secondly so we can invest in our assets and provide more parking and better parking. MR. DUNN: So if you are opening a business that's not near a town lot, you have got to provide spots. SUPERVISOR RUSSELL: Right. MR. DUNN: But if you are opening a business near a town lot, then youcan use it. Southold Town Board Meeting page 41 November 4, 2015 SUPERVISOR RUSSELL: Right. MR. DUNN: But you didn't pay for it. SUPERVISOR RUSSELL: Which is what we are trying to do with the parking bank. MR. DUNN: That law has got some defective thinking there. SUPERVISOR RUSSELL: It's been around forever and there's time that we have got to look at parking as a premium. MR. DUNN: There's a few things that have been around forever that probably shouldn't be here anymore. SUPERVISOR RUSSELL: I would agree. I have been around forever, so... COUNCILMAN GHOSIO: I think it would depend when it occurred what the circumstances were. I am sure there was a time when we were looking to attract business, you know, and rather than tax abatements, that was.... MR. DUNN: But I mean, how many people can use those spots? If I say, okay, I am going to open an ice cream store, there's six spots there and then Mr. Ruland says I am going to open a restaurant, there's six spots there, well, now we have just made 12 spots out of six spots. There's still only six spots. SUPERVISOR RUSSELL: That's a good question. I don't know how the Planning Board does address that. But I do know the underlying principal needs to be addressed. If there's going to be a parking bank on a municipal lot, there needs to be some consideration of enumeration to the town so that we can do some, we can expand and improve, so I would agree. MR. DUNN: Sure. TOWN ATTORNEY DUFFY: Mr. Supervisor, the Planning Board has the authority to allow those people to use the parking lot but the town just did a parking assessment for Mattituck and the Planning Board, based on that, would not allow the developer to use the municipal parking... MR. DUNN: Inaudible. The guy who's trying to do that thing on Pike Street. TOWN ATTORNEY DUFFY: He has got to provide parking. He cannot rely on the town parking lot because of the latest parking assessment. SUPERVISOR RUSSELL: Anybody else? COUNCILMAN RULAND: I just want to comment to Mr. Dunn, as we go forward, we are going to be, I guess at my urging, partly because of the amount of angst that went into the town- , Southold Town Board Meeting page 42 November 4, 2015 actually acquiring title to the Pike Street parking facility, we are going to look at parking, municipal parking facilities that we have throughout the town and I think that a number of questions have come up about usage. Who can use, how long can they use, those types of things and we are going to have a discussion about globally, about parking and how it's been addressed in other places and what can be done not only to ensure that the parking is maintained but that we have a revenue stream to help maintain it. From a practical point. MR. DUNN: Well, from a real point, I mean, there's a, I guess you guys, well, now us guys. It was you guys before, I am only here five years. I have been around longer but I have only been living here five years.... COUNCILMAN DINIZIO: Bob, that doesn't make any difference to me. MR. DUNN: Okay, but I am trying to set up the conversation, you have had it too good for too long. COUNCILMAN RULAND: That's a good way to put it. MR. DUNN: And the reality is, it's coming. I mean, the future is here and all of the bad parts and if you don't prepare for it, it's just going to get you, I mean, I grew up in Flushing, New York on a fairly busy street, it was commercial and there were guys selling fruits on horse carts when I was a kid. You could sleep in the streets. My father ended up getting killed in that street but it just progressed to where now it's like Sixth Avenue in Manhattan. And that same kind of thing is coming here to an extent and it's the way you handle it and what you are describing there is... COUNCILMAN RULAND: Well, anyplace that has become a tourist destination, if you will, throughout let's just say New York State because a lot of states have different rules, a lot of them have good models, whether they will work here or not but it's time that we have that discussion because there are common denominators of destination parking, transient parking, a bigger problem than ever is not only overnight parking but over week parking which has swollen... MR. DUNN: Oh, I could see that across the street, across the street from the bus stop. COUNCILMAN RULAND: And many people would say, well, if you are going to allow that at all, then there has to be some type of a premium attached to that because it's not available for transient parking because someone occupied it for something it really wasn't intended for. As we look at our hamlets, we are not really in a position that we can create more lots in the hamlets for parking because there are precious few. MR. DUNN: Eliminate overnight parking. COUNCILMAN RULAND: Well, it's one or the other. You are either going to have limited overnight parking, you are going to have to pay for the privilege... Southold Town Board Meeting page 43 November 4, 2015 MR. DUNN: No, I am saying eliminate it... COUNCILMAN RULAND: I understand that. MR. DUNN: That eliminates the possibility of somebody dropping a car off for a week. COUNCILMAN RULAND: I understand that but the other side is, if you are going to allow it in certain spots, like it is already, I think ybu are going to have to pay for that privilege. MR. DUNN: Sounds fair. COUNCILMAN RULAND: And the proceeds, as the Supervisor was alluding to, are going to be dedicated into parking. Going forward though, alright, because it's almost impractical to say, as far as I am concerned, we were kind of backed into a corner with this Pike Street parking, okay, but the right thing to do for the Town of Southold to do was purchase it and we all agreed. MR. DUNN: Correct. COUNCILMAN RULAND: And this is what we did. But how we use it going forward and how it gets used and how we maintain it and all the upkeep and the things that are needed to maintain law and order in that parking lot specifically, when it is now a free for all, is something that is up for discussion as far as I am concerned. And that's all I will say because I will say I had an initial discussion with the town attorney about the legality of certain things and what is done in other areas. MR. DUNN: That's a partial dirt lot, isn't it? COUNCILMAN RULAND: No, it's paved. MR. DUNN: It's all paved? COUNCILMAN RULAND: Yes. Well, it's paved but the pavement is well worn. MR. DUNN: It was paved. - COUNCILMAN RULAND: Yes. So it is going to need some TLC but you know, Rome wasn't built in a day. And I am not sure that our budget or any budget can say we are not going to do • anything and then at the end of whatever period, well, we need $250,000 to, you know, because the rainy day has now come. If we put a mechanism in place at some time, it will generate some revenue for the rainy day fund, we'll have at least a fighting chance to say we can do something. But more to follow. MR.
