Douglass i MAY25 19:10 Situate: Major's Pond Road, Orient TOWN OF SOUTHOLD SCTM#1000-26-2-39.1 Dear Board Members, As you know, an application for wetlands permit pursuant to Chapter 97 of the Southold Town Code was submitted on March 29, 1995 to construct a single family dwelling and related appurtenances no closer than 52 feet from the landward edge of freshwater wetlands at the above referenced property. The purpose of this correspondence is to provide additional information in connection with the application as to address any further questions the Board may have as it moves to render the requisite SEQRA determination and conduct a public hearing. Towards this end,the following report is organized to address the relevant site conditions,zoning considerations,potential environmental impacts to wetlands and proposed mitigation measures to control and minimize these potential impacts. Site Conditions Subject parcel contains 62,968 square feet and is bordered by Majors Pond Road to the east,the permanently preserved park land parcel of the subdivision of Willow Terrace Farms to the south, Majors Pond to the west,property now or formally owned by John and Joyce Holzapfel to the northwest and Lot#3 of the Subdivision of Willow Terrace Farms to the north. I have been informed by Mr. Metzger that the Board's preliminary review of the survey submitted with the application culminated in a concern regarding the eastern boundary of subject parcel and ownership of the pond edge. Ln addressing this issue, I have asked Mr. Metzger to recheck this boundary with respect to the meets and bounds set forth on the map of the subdivision of Willow Terrace Farms and the deed for subject parcel. Mr. Metzger has informed me that the meets and bounds of subject property are in agreement with these documents and the property boundaries are accurate. In contrast, Page 2 5/25/95 there are no meets and bounds associated with the pond edge and I believe that it is these boundaries as set forth in the subdivision map of Willow Terrace Farm that are in question. It is probable that the pond shoreline as disclosed in the subdivision map was derived by interpretation of an area map showing a pond or by interpretation of an aerial photograph. Both methods of estimation involve varying degrees of error. In the case of shoreline interpretation by area map,there could be no certainty that the shoreline of Majors Pond is exact. Furthermore,manipulation of scale for any area map would introduce a second level of error. In the case where the pond's shoreline may have been mapped by of interpretation of aerial photographs, such interpretation would be subject to two sources of error. First,there is an inherent source of error associated with aerial photographs attributed to the phenomenon known as parallax. Parallax refers to the error associated with the location of object(such as the shoreline of a pond)resulting from multiple or undefined viewpoints. In any aerial photograph,the central portion of the photograph is subject to error resulting from the height and angle from which it is taken. Also,in all aerial photographs,the locations of objects appearing towards the outer edges of the photograph are subject to error resulting from different viewing angles,the curvature of the earth,the curvature of the camera lens, and the inability to obtain sharp focus. Secondly,the manipulation of scale of any aerial photograph results in further error. As stated above, I am informed by Mr. Metzger that the boundaries of subject parcel are accurate. Majors Pond is classified as a freshwater pond by the NYSDEC. While there is no formal connection to Peconic Bay, it is believed that Majors Pond is a brackish pond subject to some degree of salt spray from Peconic Bay. There is a likelihood that Majors Pond was at least formally dredged or excavated as the dominant shoreline vegetation is Phragmites. That is,the presence of Phragmites throughout the shoreline area is indicative of prior disturbance. The quality of the pond and surrounding wetland vegetation is regarded as marginal and there are no rare species concerns related to this system. However,repeated field inspections of the pond has revealed the presence of a pair of swans. The quality of the adjacent upland area is also regarded as marginal. This site and other adjacent land areas were previously fanned. Vegetation in these adjacent uplands is characterized as successional field and woodland growth. Field vegetation includes a variety of weed species as well as shrubs including blackberry, catbrier, and multiflora rose. Woodland vegetation is dominated by locust and black cherry. Most of the site's topography is flat. However, the topography sharply slopes downward towards the pond east of the 10 foot contour. Accordingly,there are no significant stormwater runoff concerns for lands west of the 10 foot contour. Page 3 5/25/95 Zoning Considerations Subject parcel lies within the R-80 Zone(a residential zone requiring 80,000 square feet minimum lot area). Because subject parcel contains approximately 62,968 square feet and was created prior to the Town's enactment of the R-80 Zone in this area, subject parcel is regarded as a pre-existing non conforming lot. In the R-80 zone,the required lot depth, in this case,the distance between Majors Pond Road and Majors Pond is 250 feet and there is no point on subject parcel where the minimum lot depth is achieved. Furthermore,the minimum required front and rear yards are 60 feet and 100 feet,respectively and there is no possibility that these zoning setbacks can be achieved. Therefore, any residential development of subject parcel will require relief from the zoning code which can only be granted by the Southold Town Zoning Board of Appeals. In developing of the design and layout of the proposed dwelling and related appurtenances for subject parcel,the applicant and the applicant's agent endeavored to balance the environmental concerns related to protection of Majors Pond and the zoning concerns for this pre-existing non-conforming parcel. In arriving at this balance, the distances from the proposed house to landward edge of wetlands at Majors Pond and Majors Pond Road were essentially equalized at 52 to 53 feet,respectively. The applicant is reluctant to upset this balance by relocating the proposed house closer to Majors Pond Road and further from Majors Pond because such an alternative would jeopardize our ability to obtain the requisite zoning variance. Specifically,we are fearful that relocation of the dwelling closer to Majors Pond Road may result in a project that is out of character with the surrounding area. It is under this circumstance that the Southold Town Zoning Board could deny this application. Potential Environmental Impacts and Mitigation The potential environmental impacts related to the proposed project include the following: (1) clearing of upland vegetation adjacent to Majors Pond; (2) increased runoff generated by impervious surfaces namely the roof of the proposed dwelling and attached garage; (3)runoff generated from landscaped areas and(4) groundwater impacts related to the operation of an on-site septic system. These potential environmental impacts along with the proposed mitigative strategies are discussed below. Clearing of Upland Vegetation Any development of the subject parcel will require some degree of clearing in the upland areas. Submitted herewith is a revised survey which depicts an edge of turf area ("Revised Survey"). The edge of turf area is also the edge of clearing. As set forth in the Revised Survey,the applicant is proposing to retain extensive adjacent upland areas and limit the clearing to points no closer than 42 feet from the landward edge of freshwater wetlands. In actuality,the extent of clearing increases to 75 feet and more on the northern Page 4 5/25/95 portion of the property. The proposed edge of clearing is regarded as reasonable and necessary in the ordinary construction of any residential dwelling. As to prevent any inadvertent clearing further into the adjacent area, a project limiting fence is also proposed. The project limiting fence would be erected along the proposed clearing line prior to any site disturbance so that a clear delineation between preserved vegetation and developed area is established. The project limiting fence would be removed following completion of the proposed construction and stabilization of upland soils. The proposed limit of clearing along with the project limiting fence is the principle mitigative strategy in controlling this potential impact. Increased Runoff Generated by Impervious Surfaces Any development of subject parcel will result in an increase in impervious surface. Accordingly,there is certainty that additional stormwater runoff will occur. In this case,the probability that increased runoff will result in a measurable impact to the pond including water quality is extremely remote. Reasons in support of this finding include the fact that the developed portion of the site is characterized by flat topography. All clearing and construction is to take place landward of the 10 foot contour adjacent to the pond. Even so, as set forth in the survey submitted with the application,two drywells are proposed. The drywells have been located on the northwestern and southwestern corners of the proposed dwelling away from the pond. Each drywell is to be of six feet in diameter and two feet in depth. Gutters will be constructed along the perimeter of the roof line and all stormwater generated from these impervious surfaces will be directed into the proposed drywells. Accordingly, all runoff generated from these impervious surfaces will be recharged leaving no additional runoff to enter the wetlands of Majors Pond. Runoff Generated from Landscaped Areas As stated above, a certain amount of clearing is necessary in order to construct any dwelling over subject parcel and in this case all such clearing will be limited to beyond 42 feet from the landward edge of wetlands within areas that are topographically flat. What results from this development strategy is a 42 foot upland buffer which will be retained in its natural condition. The designation of a permanent buffer adjacent to the wetlands of Majors Pond is the principle mitigation to this potential environmental impact. Groundwater Impacts Related to the Operation of an On-She Septic System Because subject parcel and surrounding lands are not served by a sewage plant, the only alternative available to the applicant for sewage treatment and disposal is the on site septic system. As proposed,the septic system has been located adjacent to Majors Pond Road. The distance between the nearest septic ring or leaching pool from the Page 5 5/25/95 landward edge of freshwater wetlands is 136 feet. Furthermore,the distance between the nearest septic ring and the shoreline of the bay exceeds 400 feet. Finally,the prevailing direction of ground water flow is towards the bay or away from the pond. Accordingly, the septic system is not expected to cause any impact to the wetlands and surface waters of Majors Pond. I trust that the Board will agree that the proposed development of the site will not cause any undue or adverse impact to the wetlands of Majors Pond and,accordingly, is consistent with the stated policies set forth in Chapter 97 of the Town Code("Wetlands"). As this project has been under review by the Board for some time,I request that the Board undertake two actions at this meeting. First, I request that the Board render the requisite SEQRA Determination and, as appropriate, issue a negative declaration for this action. Second,I request that the Board schedule the requisite public hearing for this action during their next regular meeting. Douglass Situate: Major's Pond Road, Orient SCTM #1000-26-2-39.1 Dear Board Members, As you know,an application for wetlands permit pursuant to Chapter 97 of the Southold Town Code was submitted on March 29, 1995 to construct a single family dwelling and related appurtenances no closer than 52 feet from the landward edge of freshwater wetlands at the above referenced property. The purpose of this correspondence is to provide additional information in connection with the application as to address any further questions the Board may have as it moves to render the requisite SEQRA determination and conduct a public hearing. Towards this end, the following report is organized to address the relevant site conditions, zoning considerations,potential environmental impacts to wetlands and proposed mitigation measures to control and minimize these potential impacts. Site Conditions Subject parcel contains 62,968 square feet and is bordered by Majors Pond Road to the east; the permanently preserved park land parcel of the subdivision of Willow Terrace Farms to the south, Majors Pond to the west,property now or formally owned by John and Joyce Holzapfel to the northwest and Lot#3 of the Subdivision of Willow Terrace Farms to the north. I have been informed by Mr. Metzger that the Board's preliminary review of the survey submitted with the application culminated in a concern regarding the eastern boundary of subject parcel and ownership of the pond edge. In addressing this issue, I have asked Mr. Metzger to recheck this boundary with respect to the meets and bounds set forth on the map of the subdivision of Willow Terrace Farms and the deed for subject parcel. Mr. Metzger has informed me that the meets and bounds of subject property are in agreement with these documents and the property boundaries are accurate. In contrast, i I Page 2 5/25/95 there are no meets and bounds associated with the pond edge and I believe that it is these boundaries as set forth in the subdivision map of Willow Terrace Farm that are in question. It is probable that the pond shoreline as disclosed in the subdivision map was derived by interpretation of an area map showing a pond or by interpretation of an aerial photograph, Both methods of estimation involve varying degrees of error. In the case of shoreline interpretation by area map,there could be no certainty that the shoreline of Majors Pond is exact. Furthermore,manipulation of scale for any area map would introduce a second level of error. In the case where the pond's shoreline may have been mapped by of interpretation of aerial photographs, such interpretation would be subject to two sources of error. First,there is an inherent source of error associated with aerial photographs attributed to the phenomenon known as parallax. Parallax refers to the error associated with the location of object(such as the shoreline of a pond)resulting from multiple or undefined viewpoints. In any aerial photograph,the central portion of the photograph is subject to error resulting from the height and angle from which it is taken. Also,in all aerial photographs,the locations of objects appearing towards the outer edges of the photograph are subject to error resulting from different viewing angles,the curvature of the earth,the curvature of the camera lens,and the inability to obtain sharp focus. Secondly,the manipulation of scale of any aerial photograph results in further error. As stated above,I am informed by Mr. Metzger that the boundaries of subject parcel are accurate. Majors Pond is classified as a freshwater pond by the NYSDEC. While there is no formal connection to Peconic Bay, it is believed that Majors Pond is a brackish pond subject to some degree of salt spray from Peconic Bay. There is a likelihood that Majors Pond was at least formally dredged or excavated as the dominant shoreline vegetation is Phragmites. That is,the presence of Phragmites throughout the shoreline area is indicative of prior disturbance. The quality of the pond and surrounding wetland vegetation is regarded as marginal and there are no rare species concerns related to this system. However, repeated field inspections of the pond has revealed the presence of a pair of swans. The quality of the adjacent upland area is also regarded as marginal. This site and other adjacent land areas were previously farmed. Vegetation in these adjacent uplands is characterized as successional field and woodland growth. Field vegetation includes a variety of weed species as well as shrubs including blackberry,catbrier, and multiflora rose. Woodland vegetation is dominated by locust and black cherry. Most of the site's topography is flat. However, the topography sharply slopes downward towards the pond east of the 10 foot contour. Accordingly,there are no significant stormwater runoff concerns for lands west of the 10 foot contour. Page 3 5/25/95 Zoning Considerations Subject parcel lies within the R-80 Zone(a residential zone requiring 80,000 square feet minimum lot area). Because subject parcel contains approximately 62,968 square feet and was created prior to the Town's enactment of the R-80 Zone in this area, subject parcel is regarded as a pre-existing non conforming lot. In the R-80 zone,the required lot depth, in this case, the distance between Majors Pond Road and Majors Pond is 250 feet and there is no point on subject parcel where the minimum lot depth is achieved. Furthermore,the minimum required front and rear yards are 60 feet and 100 feet, respectively and there is no possibility that these zoning setbacks can be achieved. Therefore, any residential development of subject parcel will require relief from the zoning code which can only be granted by the Southold Town Zoning Board of Appeals. In developing of the design and layout of the proposed dwelling and related appurtenances for subject parcel,the applicant and the applicant's agent endeavored to balance the environmental concerns related to protection of Majors Pond and the zoning concerns for this pre-existing non-conforming parcel. In arriving at this balance, the distances from the proposed house to landward edge of wetlands at Majors Pond and Majors Pond Road were essentially equalized at 52 to 53 feet,respectively. The applicant is reluctant to upset this balance by relocating the proposed house closer to Majors Pond Road and further from Majors Pond because such an alternative would jeopardize our ability to obtain the requisite zoning variance. Specifically, we are fearful that relocation of the dwelling closer to Majors Pond Road may result in a project that is out of character with the surrounding area. It is under this circumstance that the Southold Town Zoning Board could deny this application. Potential Environmental Impacts and Mitigation The potential environmental impacts related to the proposed project include the following: (1) clearing of upland vegetation adjacent to Majors Pond; (2) increased runoff generated by impervious surfaces namely the roof of the proposed dwelling and attached garage; (3)runoff generated from landscaped areas and (4) groundwater impacts related to the operation of an on-site septic system. These potential environmental impacts along with the proposed mitigative strategies are discussed below. Clearing of Upland Vegetation Any development of the subject parcel will require some degree of clearing in the upland areas. Submitted herewith is a revised survey which depicts an edge of turf area ("Revised Survey"). The edge of turf area is also the edge of clearing. As set forth in the Revised Survey,the applicant is proposing to retain extensive adjacent upland areas and limit the clearing to points no closer than 42 feet from the Iandward edge of freshwater wetlands. In actuality,the extent of clearing increases to 75 feet and more on the northern Page 4 5/25/95 portion of the property. The proposed edge of clearing is regarded as reasonable and necessary iii the ordinary construction of any residential dwelling. As to prevent any inadvertent clearing further into the adjacent area,a project limiting fence is also proposed.The project limiting fence would be erected along the proposed clearing line prior to any site disturbance so that a clear delineation between preserved vegetation and developed area is established. The project limiting fence would be removed following completion of the proposed construction and stabilization of upland soils. The proposed limit of clearing along with the project limiting fence is the principle mitigative strategy in controlling this potential impact. Increased Runoff Generated by Impervious Surfaces Any development of subject parcel will result in an increase in impervious surface. Accordingly,there is certainty that additional stormwater runoff will occur. In this case, the probability that increased runoff will result in a measurable impact to the pond including water quality is extremely remote. Reasons in support of this finding include the fact that the developed portion of the site is characterized by flat topography. All clearing and construction is to take place landward of the 10 foot contour adjacent to the pond. Even so, as set forth in the survey submitted with the application,two drywells are proposed. The drywells have been located on the northwestern and southwestern corners of the proposed dwelling away from the pond. Each drywell is to be of six feet in diameter and two feet in depth. Gutters will be constructed along the perimeter of the roof line and all stormwater generated from these impervious surfaces will be directed into the proposed drywells. Accordingly, all runoff generated from these impervious surfaces will be recharged leaving no additional runoff to enter the wetlands of Majors Pond. Runoff Generated from Landscaped Areas As stated above,a certain amount of clearing is necessary in order to construct any dwelling over subject parcel and in this case all such clearing will be limited to beyond 42 feet from the landward edge of wetlands within areas that are topographically flat. What results from this development strategy is a 42 foot upland buffer which will be retained in its natural condition. The designation of a permanent buffer adjacent to the wetlands of Majors Pond is the principle mitigation to this potential environmental impact. Groundwater Impacts Related to the Operation of an On-Site Septic System Because subject parcel and surrounding lands are not served by a sewage plant, the only alternative available to the applicant for sewage treatment and disposal is the on site septic system. As proposed,the septic system has been located adjacent to Majors Pond Road. The distance between the nearest septic ring or leaching pool from the Page 5 5/25/95 landward edge of freshwater wetlands is 136 feet. Furthermore,the distance between the nearest septic ring and the shoreline of the bay exceeds 400 feet. Finally, the prevailing direction of ground water flow is towards the bay or away from the pond. Accordingly, the septic system is not expected to cause any impact to the wetlands and surface waters of Majors Pond. I trust that the Board will agree that the proposed development of the site will not cause any undue or adverse impact to the wetlands of Majors Pond and, accordingly, is consistent with the stated policies set forth in Chapter 97 of the Town Code ("Wetlands"). As this project has been under review by the Board for some time,I request that the Board undertake two actions at this meeting. First, I request that the Board render the requisite SEQRA Determination and, as appropriate, issue a negative declaration for this action. Second,I request that the Board schedule the requisite public hearing for this action during their next regular meeting.
