SCTM#1000-103-4-37.2 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated December 1, 2015 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The parcel is a non-conforming 19,950 square foot parcel located in an R- 40 zone. The parcel has 133.00 feet running along Beebe Drive, and 150.00 feet running along Emory Road. The parcel runs 133.00 feet on the East side and 150.00 feet on the South side. The parcel is improved with a 1 story frame house with attached deck and an accessory shed. All is shown on a survey prepared Nathan Taft Corwin, III, LLS, and dated October 23,2015. BASIS OF APPLICATION: Request for Variance from Article XXIII Section 280-124 and the Building Inspector's October 1, 2015 Notice of Disapproval based on an application for building permit to construct a garage addition to existing single family dwelling, at; 1) less than the minimum code required front yard setback of 35 feet. RELIEF REQUESTED: The applicant requests a variance to construct an attached garage with a front yard setback of+/-29 feet where code requires a 35 foot front yard setback. ADDITIONAL INFORMATION: At the hearing several neighbors testified against the application and a neighbor's letter was received opposing the request. The applicant's agent testified that the applicant has substantial vegetative screening along Emory Road which will make the garage addition difficult to see from the street,which was corroborated by ZBA Members through personal site inspection. FINDINGS OF FACT/REASONS FOR BOARD ACTION: Page 2 of 3—January 21,2016 ZBA#6906—Rubenstein SCTM#1000-103-4-37.2 The Zoning Board of Appeals held a public hearing on this application on January 7,2016 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Attached garages are typical in the neighborhood. The applicant has two front yards. The front yard along Beebe Drive is the architectural front yard and the yard along Emory Drive is the Architectural side yard. The applicant's proposed project would have a conforming side yard setback. The existing vegetation and berm along the property line on Emory Drive will remain, which screens the garage from the road. 2. Town.Law §267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant could build an accessory garage or could build a much smaller attached garage with a conforming front yard setback. However, accessory garages are not characteristic in the neighborhood and, due to the placement and layout of the existing dwelling and driveway, the proposed location for an attached garage is the most logical and functional. The applicant's agent testified that reducing the width of the proposed attached garage to maintain a code conforming front yard setback from Emory Drive would make the garage unsuitable for the applicant's car and storage needs. 3. Town Law§267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 17% relief from the code. However,the applicant is burdened by the fact that this property has two front yards. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an attached garage while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dantes, seconded by Member Schneider, and duly carried,to GRANT, the variance as applied for, and shown on the building plans by Joseph Fischetti, P.E. labeled A-1 through A-7 dated September 13, 2015 and the survey prepared Nathan Taft Corwin, III, L.L.S. and dated October 23,2015. Subject to the following condition; CONDITION: The existing vegetative screening along the property line fronting on Emory Drive shall be maintained in perpetuity. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured,and/or a subdivision map has not been filed with the Suffolk County Clerk,within three(3)years from the date such variance was granted. The Board of Appeals may,upon written request prior to the date of expiration, grant an extension not to exceed three(3)consecutive one(1)year terms. To the Town of Southold Zoning Board of Appeals, I am writing this letter to once again urge you to deny the request of my neighbor on Emory Road in Cuthchogue,to receive a variance to build a two-car garage which would extend beyond the legal property line setback requirements of the Town of Southold. Although I do believe that the two week window of opportunity given to me by the Zoning Board is more than fair, I do wish that my personal circumstances were different right now. Between holding down two jobs and caring for two sick family members, I barely have time to write this letter. However, I do hope that the Zoning Board will read and consider my thoughts. As you know, I searched far and wide very recently to purchase the perfect piece of property; I spent my life savings on the land which I bought. One of the major reasons I bought my property is because I had done research to make sure that the "look,feel,and view"of and from the property could not change. I loved it just the way it was. During the summer, my family comes to my house and we sit on my front porch and have a beautiful view, including clear sight of the beautiful creek at the end of the street. Anyone who has ever come to see my home has always commented on it,and I really do give credit to Southold Town for holding tight to their laws and ordinances in order to keep the town as close as possible to the way that it is now.Of course, if a garage must be built,my neighbor has the full rights to do so. However,she does not"need" a two car garage. I see no reason why a full sized garage which complies with current setback regulations cannot suffice. I am afraid that, because it seemed that the Zoning Board knew and liked the gentleman (I assume the builder of the garage)who spoke, the Board will simply decide to"compromise"and still allow a variance, but just not the full one being requested. I would be very disappointed if this was the decision of the Board. I respectfully ask that my neighbor's request be denied,and that she only be allowed to build a garage that fits within the regulations of the current town ordinances. I have two points that I would like to make. First, please do take a moment to look at the pictures that I took,which clearly shows the beautiful view which I currently have from the front of my house. Where the cars are, I assume,would be where the new garage would be built.There is nothing I can do about that. However,it is clear from the pictures that for every single inch beyond the"legal" boundaries for the new structure, I,as a tax-paying citizen,would lose even more beauty when I am in my front yard I purposely spent more money on the modest home that I built just so that I could have an old-fashioned country front porch with nature and beauty surrounding me. With each additional inch that the Zoning Board allows, I will lose an inch more of this beauty. I also respectfully ask that the members of the Board examine the exact advertisement which I read and which drew me to the property on Emory Road. It clearly states: "Yes"after the word "waterview". In addition,the second page of the listing is completely filled with pictures which illustrate the beautiful view,which came along with the property. With complete honesty,this listing drew me to the property and once I saw the reality of it, I decided to make my big decision to purchase it. I do not know if or how my decision to purchase this property would have changed, had I also seen a very large garage,jutting out, beyond the required setbacks, but it is very possible that I may have tried to negotiate at least a somewhat lesser price for the lot. It just seems so unfair to purchase land, based on a clear and accurate advertisement,and then,just one year later, have the Town of Southold issue a variance to the adjoining property of my house which further obstructs my view. As you probably know,the person requesting the variance is the same person who sold me the property and who is also responsible for the advertisement of the "beautiful view"which the property provides. I am sure that the builder of the large garage (the same person who would profit from the construction of the garage)will try to say that the extra footage will make no difference. But I know my property best, I know what I purchased,and I know what I expected to maintain and hold in my family for the foreseeable future. Also,with the little time that I had, I did look up the Southold Town information regarding the Zoning Board of Appeal's mission, etc. Under Article I: "General Provisions",Section 280-2,the purposes of the Zoning Board are clear: c. "The provisions of privacy for families" E. "The maximum protection of...residential areas" F. "The gradual elimination of nonconforming uses G. "The enhancement of the appearance of the Town of Southold" One thing that came up at the meeting two weeks ago which I do not understand is that it seemed as though the Zoning Board was going to check to see if and/or how many"non-conforming"structures, etc.existed on Emory Road. However,according to Article I, 280-2 of the Town Code, it seems that a primary mission of the Zoning Board of Appeals is to gradually eliminate this, not to add to the problems that may or may not already exist on the street. After reading this section of the Zoning Codes, it is my humble(and I stress"humble")opinion that if the Board allows ANY kind of variance for this structure, each of these purposes would be compromised. My final point comes from this same document,Article I,280-3, "Interpretation and Conficts": A. "Where a provision of this chapter conflicts with or imposes a different requirement....the provision which is more restrictive or which establishes the higher standard shall govern." B. "Where the provisions of this chapter conflict with or impose a different requirement...the ordinance, rule or regulation which establishes the higher standard or requirement shall govern." Although both A and B of Article 1280-3 are very similar,they seem to state the same,very important concept;that when conflicts arise,the Town of Southold should hold to the highest of standards. I believe that the Town of Southold is one of the few towns left,that actually upholds such ordinances and regulations,and this is why, in my opinion, it is the best possible place on all of Long Island to live. Obviously,the ladies and gentlemen of the Southold Town Zoning Board of Appeals know far more about such issues as I do, and so I put my trust and confidence in each and every one of you to simply uphold the current ordinances which are already in place. There is no"emergency"or extraordinary C061nc, circumstance here, as far as I can see. I know that there is a true need for a Zoning Board of Appeals but I always understood that it existed to help people who actually do have extraordinary circumstances. In closing, I plea to you to deny the request for this variance, and not to"compromise" in any way which requires extension of this structure any further than the current ordinances call for. Since many of the surrounding homes have similar garage space, this would put her property in conformity with her neighbors. While some have voiced objections that this detracts from the integrity of the neighborhood,this is clearly untrue. Mrs. Rubenstein's age and physical limitations have prompted this request. She is almost 82 years of age, and has difficulty walking down a flight of stairs to the basement to do laundry, retrieve storage and supplies, as well as traversing an often icy backyard to dispose of her garbage for its removal. Since Mrs. Rubenstein is recently widowed, these chores now fall on her. Her husband passed away two years ago. Six months after that she suffered four grand mal seizures, which left her with limited mobility, unsteady walk and balance, and other physical limitations. She is getting less and less mobile and can no longer safely maneuver on stairs. In addition, she suffers from severe asthma which at times limits her exposure to the outside. The Rubenstein's have lived in their Cutchogue home for over 30 years after Mr. Rubenstein retired as a teacher on Long Island. The couple loved their home and town and have been upstanding, contributing members of the neighborhood and town. They have also been regular volunteers to the community: regularly volunteering at Eastern Long Island Hospital, serving as President/active members of New Suffolk/Cutchogue Historical Counsel, serving as President/active member of Cutchogue Homemakers Society, and even hosting the local cable show "Our Town," which interviewed community leaders, bringing positive exposure to the North Fork. In addition, the care of their property has contributed to the beautification of the neighborhood. They not only planted glorious gardens, they have transplanted perennials on common property in the neighborhood for all to enjoy. The corner lot in question is a scant 50 square feet less than the zoning requirements of 20,000 square feet—a product of the time when the subdivision was laid out and there were less precise measurement standards. The current driveway and the parking for the vehicles on the property already encroach on this setback, which have always been located there. Instead of the two vehicles being parked outside, they would be housed. This would beautify rather than detract from the integrity of the neighborhood. 1 In summary, on behalf of my siblings and mother I kindly ask that you approve the variance, allowing my mother to safely navigate on one level of living while also limiting her exposure to the outside, which would include the garage as proposed. We purchased our home in the town of Southold due to the open and spacious environment the town provides. We happily paid our tax to the Peconic Land Trust when we purchased this home but would hope that the integrity of the neighborhood be maintained. This variance request seems to be in direct conflict of the Peconic Land trust mission to maintain the rural nature of the area, including Emory Road. We would hope the town of Southold continues to enforce the existing building guidelines in order to maintain the quaint and rural charm that makes this town such a nice place to live. We hope our concerns are taken into account and that the request for the variance is denied.
