APPLICANT: PHILIP GIOIA. DATE OF RESOLUTION: July 24, 1996
LOCATION OF PROPERTY: 3450 Peconic Bay Blvd, Laurel.
COUNTY TAX MAP DISTRICT 1000, SECTION 128, BLOCK 6, LOT 27.
BASIS OF APPEAL: Notice of Disapproval issued by the BuildinE Inspector
dated November 3, 1995, and based upon new circumstances unknown under
prior Appeal #4352 with conditions rendered December 6 1995.
APPEALED PROVISIONS: Art. IIIA, Section 100-30A.4 (ref. Section 100-33).
RELIEF REQUESTED: 22 ft, by 20 ft. accessory garage - storage building
in the front yard 38 feet from the northerly front property line along
Peconic Bay Boulevard and five (5) feet at its closest point to the easterly
right-of-way, also known as applicant's easterly property line. The
easterly side of the garage running parallel with the easterly neighbor's
right-of-way is confirmed by Roderick VanTuyl, surveyor, by survey
amended July 3, 1996 at five feet instead of 15+- feet and 17+- feet (on an
angle) as originally requested in 1995. Both corners of proposed garage
from the easterly property line are shown to be at five feet.

ACTION/ RESOLUTION ADOPTED: Granted as applied and shown on the
survey amended for Philip Gioia July 3 1996 (name of map is Raymond T.
Goodwin, Map #2864-2). Former conditions under Appl. #4352 allows only
electric (no water or other utilities is proposed at this time and will
require further consideration after written request to the ZBA).
REASONS/FINDINGS: Requested location is not unreasonable due to the
variable dimensions of the lot and the fact that a major portion of the yard
areas are "front yard areas." Accessory buildings are required to be in a
rear yard, but the applicant indicates he would not have vehicular access to
the rear yard for a garage from Peconic Bay Boulevard and that he does not
have a legal access for vehicles to cross over the neighboring easterly
right-of-way which runs along his easterly property line. The rear yard is
not be able to be used for this garage since variances would also be
required. No other alternative is available.

Lydia A. Tortora, Gerard P. Goehringer, Chairman. (Absent: J. Dinizio,
Jr. (out-of-state).) This resolution was unanimously adopted 4-0.

NOTICE IS HEREBY GIVEN, pursuant to Section 267 of the Town Law
and the Code of the Town of Southold, the following applications will be
held for public hearings before the SOUTHOLD TOWN BOARD OF APPEALS,
at the Southold Town Hall, 53095 Main Road, Southold, New York 11971, on
WEDNESDAY, JULY 24, 1996, commencing at the times specified below:
7:15 p.m. (Carryover hearing, continued from 6/26/96)
Appl. No. 4389 - TIMOTHY GRAY and JIMBO REALTY. Location of
Property: 43560 and 44360 County Road 48, Southold, NY; Lots r8 & 9 as
shown on the Minor Subdivision Map for Pudge Corp. approved by the

Please be aware that the Suffolk County Department of Planning may

Please find enclosed a copy of our Legal Notice published in this week's
publication of the Long Island Traveler. The public hearing will not start
before the time noted in this Notice and will be held in the Southold Town
Hall (court room). Either an owner or someone familiar with this property and
the proposed project should appear at that time.
Be sure to place the sign (provided to you) on the property at 10 feet
(or less) from the front property line near the entrance to the property,
where it can be easily seen by passersby and Board Members viewing the
neighborhood over the new few days. The sign may not be placed on a
telephone pole or on anyone else's property. Once placed, you will need to

sufficient widt and area on the north side of Albo Drive,
Laurel, New York. The Board finds that the majority of the
homes built in thi area are built on 100 foot lots, and
some are built on 50 cot lots. The findings of the Board
are that this division will not change the character of
the area. The Board ag es with the reasoning of the
applicant.

Section 100-30 and Bulk Schedule for permission to construct
dwelling with insufficient setback from Private Road. Location
of property: South side Peconic Bay Boulevard and Private
Road, Laurel, New York, bounded on the north by Peconic
Bay Blvd., east by Private Road; south by right of way Private
Rd.; west by now or formerly Battenfield. Fee paid $15.00.
The Chairman opened the hearing by reading the application
for a variance, legal notice of hearing, affidavits attesting
to its publication in the official newspapers, and notice to
the applicant. The Chairman also read letter from Town Clerk
stating that notification by certified mail has been made
to: Mr. and Mrs. Peter J. Warren and to Mrs. Florence F.
Battenfield.

The application is also accompanied by a sketch indi-
cating that applicant is the owner of a long, narrow piece
of property which will require a setback from the right-of-
way of 25 feet.
THE CHAIRMAN: Is there anyone present who wishes to
speak for this application?
WILLIAM WICKHAM, ESQ.: While I was reviewing this
application this afternoon, this little instrument gave me
quite a bit of grief. It would appear that the whole frontage
is perhaps within 35 feet. When I made the application I
assumed that part of the house had a setback of 35 feet. The
north part is closer to 32 feet. I would like to have the
record straight so there will be no confusion at a later date.
THE CHAIRMAN: You are talking about the northeast corner.
MR. WICKHAM: That is about 32 feet. When I made the
application I thought it was 35 feet.
THE CHAIRMAN: This is the legal access to the house so
this is the front yard. Actually, you are fairly close to
Peconic Boulevard. How about the northwest corner?
MR. WICKHAM: There is a line which doesn't go straight
out. If you go right out to the street it would be 50 feet
at this point.
THE CHAIRMAN: Does anyone wish to speak against this
application?
(There was no response.)
After investigation and inspection the Board finds that
applicant requests permission to construct dwelling with in-
sufficient setback from Private Road, south side of Peconic
Bay Blvd. and Private Road, Laurel, New York. The findings
of the Board are that applicant has a hardship due to the
shape of this lot, and that this is part of a minor subdivision
granted in 1968 at a time when lots were smaller. The Board
agrees with the reasoning of the applicant.
The Board finds that strict application of the Ordinance
would produce practical difficulties or unnecessary hardship;
the hardship created is unique and would not be shared by all
properties alike in the immediate vicinity of this property
and in the same use district; and the variance will not
change the character of the neighborhood, and will observe
the spirit of the Ordinance.

Chairman Goehringer: The applicant proposes a 20 by 22 foot garage
approximately 15 feet of, actually it's 17 feet from its closest
point to the right of way leading to the property formally owned by
Warren. And approximately 38 feet from Peconic Bay Boulevard. I
have a copy of the Suffolk County Tax Map indicating this and
surrounding properties in the area. How are you tonight Sir?
Mr. Gioia: Fine, fine. Thank you.

Mr. Gioia: Yes.
Chairman: OK. You want to explain to us your problem.
Mr. Gioia: The problem is, I want to build a two car garage right
next to the building.
Chairman : OK
Mr. Gioia: The present garage that I have, I want to change it to
living quarters.
Chairman: OK. And that garage is encompassed in your house
now.
Mr. Gioia: Plus we have two extra cars and we have a boat. We
need two car garage.
Chairman: Do you want to tell the board why you selected that
location as opposed to.
Mr. Gioia: That's the only spot where you could put the two car
garage.
Chairman: OK. I'm talking mainly rear yard. I mean, well, it's not
rear yard.
Mr. Gioia: I don't have the rear yard.
Chairman: Right.
Mr. Gioia: And the front yard, there isn't that much space. So,
that's the only spot that I think would be suitable for that garage.

Member Villa: Is there any reason you couldn't move it back closer
to the house?
Mr. Gioia: Closer to the house. Well, I have a driveway and I don't
know if you went to see the property.
Member Villa: Yeah, you got a couple of white marks on the
driveway where the corner is going to be.
Mr. Gioia: White marks.
Member Villa: Right
Mr. Gioia: Did you see them?
Member Villa: Yes I did. The driveway actually goes further South
than that.
Mr. Gioia: Well, there is a cesspool nearby. I don't want to be too
close to the cesspool.
Member Villa: The cesspool is right out in front of the house
according to the Map here-
Mr. Gioia: And, if it needs repairs, trucks have to go to it.
MEMBER Villa: Go to what? Trucks go to what?
Mr. Gioia: If the cesspool needs to be replaced.
Member Villa: You can get in off the right of way, right.
Mr. Gioia: If you want me to move a little closer, I'll do it.
Chairman: Bob, that access is for the entrance to Journey's End.

Chairman: But you don't have a driving right-of-way, no. Mrs.
Tortora had a question.
Member Tortora: No, I just wondered along the same lines as Bob
was asking, why you couldn't move it further in. You have two
different dimensions on the map. You have it 17 feet from the right
of way and then you have it 15 feet from the right of way. So, that
we can establish a clear line.
Mr. Gioia: Thirteen feet.
Member Tortora: No, on your map you have.
Mr. Gioia: Can I approach the bench.
Chairman: Sure.
Member Tortora: You have 17 feet and below that you have 15 feet.
Secretary: It's probably the angle, Lydia. The angle of the garage.
Member Tortora: But is there anv reason why you couldn't move it
over further, this way'
Mr. Gioia: Further, over this way.
Member Tortora: Yes.
Mr. Gioia: We have an entrance, you know. The entrance is going
to be so narrow. This way it will be bigger and it's on the side.
It doesn't bother anybody and I'm away from the right of way, away
from the street which is about 38 feet.
Secretary Linda Kowalski: I think you're normally required to be 15
feet awav for a half acre lot. He's not any less than the normal
requirements.
Member Tortora: If he did that, he's going to come closer over here.
Chairman: Yeah, it's not really a bad location at all.
Member Tortora: It's about the only place.
Chairman: Yeah. What kind Of utilit-IT would you be putting in this
structure, just electric.
Mr. Gioia: Just electric. It will be a simple garage just to put
the cars in there and a few more, nothing elaborate.
