APPLICANT: JOSEPH CORRETTI LOCATION OF PROPERTY: 2285 West View Drive, Mattituck. COUNTY TAX MAP DISTRICT 1000, SECTION 107, BLOCK 7, LOT 1.1. BASIS OF APPEAL,: Building Inspector action dated March 22, 1996 concerning construction of a dwelling with proposed insufficient front and rear yard setbacks" Article XXIV, Section 100-244B. RELIEF REQUESTED: Building Inspector has determined this parcel fronts along three streets or access ways under the definition of "front yard" under the Zoning Code. The remaining yard is a side yard proposed at 15 ft. Applicants request setbacks at variables from 50 ft., 25 ft. and 70 ft. from The Anchorage Way (north), Woodcliff Drive (east), and Westview Drive (south), respectively. MOTION MADE BY: Member Tortora SECONDED BY: Chairman Goehringer ACTION /RESOLUTION ADOPTED: Granted setbacks as requested and shown on sketch submitted with this application. REASONS/FINDINGS: Property technically consists of three front yards and one side yard, with double corners. An only alternative would be to "turn" the house facing east, however, this would leave an odd "side yard" rather than a usable rear of the dwelling. The dwelling as located is in general keeping of area houses off Westview Drive and will not set a precedent for other such reductions. The variance is minimal, is not unreasonable and will continue to preserve and protect the character of the neighborhood and the health, safety and welfare of the community. VOTE OF THE BOARD: Ayes: James Dinizio Jr., Robert A. Villa, L dia A. Tortora, and Gerard P. Goehringer. BASIS OF APPEAL: Building Inspector action dated March 22, 1996 concerning construction of a dwelling with proposed insufficient front and rear yard setbacks" Article XXIV, Section 100-244B. MOTION MADE BY: Member Tortora SECONDED BY: Chairman Goehringer ACTION/ RESOLUTION ADOPTED: Granted setbacks as requested and shown on sketch submitted with this application. REASONS/ FINDINGS: Property technically consists of three front yards and one side yard, with double corners. (E.D.S.T.) upon application of Frank and Vera Scott, West View Drive, Mattituck, New York (Abigail Wickham, Esq.) for a variance in accordance with the Zoning ordinance, Article III, Section 100-30 and Bulk Schedule for permission to divide property with insufficient width and area. Location of property: Northwest side of West View Drive, Mattituck, New York, bounded on the north by Anchorage; east by Woodcliff Drive; south by West View Drive and A. Boscomb; west by Mattituck Creek. The Chairman opened the hearing by reading the application for a variance, legal notice of hearing, affidavits attesting to its publication in the official newspapers, disapproval from the Building Inspector, and notice to the applicant. The Chair- man also read statement from the Town Clerk that notification by certified mail had been made to: Alfred Bascomb. Fee paid $15.00. THE CHAIRMAN: The application is accompanied by a photostat of the County Tax Map which supports the applicant's statements. Is there anyone present who wishes to speak for this application? ABIGAIL WICKHAM, ESQ.: I would like to speak in favor of the application based mainly on the characteristics of the neighborhood. THE CHAIRMAN: Where these lots bought at separate times? ABIGAIL WICKHAM, ESQ.: No, they were bought together. THE CHAIRMAN: Anyone wish to add anything? (There was no response.) one question, the 11,000 sq. ft., which lot will that go with? ABIGAIL WICKHAM, ESQ.: That will go with the lot of 26,000 sq. ft. THE CHAIRMAN: So in effect, you'll have a lot there of 37,000 sq. ft. ABIGAIL WICKHAM, ESQ.: It will be one large lot, yes, but due to the location of that filled in area, we really didn't have a choice, that is certainly not a separate building lot. THE CHAIRMAN: It's listed on the tax map as 1.2 acres. That is certainly larger. Is there anyone who wishes to speak against this application? (There was no response.) Southold Town Board of Appeals -6- May 12, 19.77 After investigation and inspection, the Board finds that the applicants request permission to divide property with in- sufficient width and area, northwest side of West View Drive, Mattituck, New York. The findings of the Board are that the Board is in agreement with the reasoning of the applicant. The Board finds that strict application of the ordinance would produce practical difficulties or unnecessary hardship; the hardship created. is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the ordinance. On motion by Mr. Bergen, seconded by Mr. Hulse, it was RESOLVED, Frank and Vera Scott, West View Drive, Mattituck, New York, be GRANTED permission to divide property with insuffi- cient width and area, northwest side of West View Drive, Mattituck, New York, as applied for. Vote of the Board: Ayes: - Messrs: Gillispie, Bergen, Hulse, Grigonis, Doyen. PUBLIC HEARING: Appeal No. 2270 - 8:30 P.M. (E.D. .T.) upon a !cation of Robert and Virginia Kroepel, 236 aklawn Avenue, S hold, New York for a variance in accor nce with the Zoning O inance, Article III, Section 100-3 for permis- sion to constru tennis court with fence exce ing maximum height. Location f property: West side Oa awn Avenue, Southold, New York, unded on the north b Southold School District and L. Baker; ast by J. Graves south by Jockey Creek Drive; west by H. Arm. The Chairman also read statement that tification b certified mail had been made to: Dr. John Grav Dr. Herbert S. m; Mr. Louis F. Baker; Southold Union Free S ool District. Fee p 'd - $15.00. THE CHAI The photostat of the Tax p indicates that the applicant i the owner of two lots #26 and '13 on this map. one of them onts on Oaklawn Avenue and the other 621, Jockey reek Driv One has a frontage of 150' on Jockey Cre Drive, and a fro tage of 160' on Oaklawn Avenue.
