Inspe<Aor dated November 29, 1995.
PROVISIONS APPEALED PROM: Article 11IA, Section 100-30A.3.
RELIEF REQUESTED: Enclosed porch addition with a reduced setback at
six feet from the front property line along L'Hommedieu lane, and four
feet from the edge of the proposed new front step area. The length of
the porch is proposed at 28'6" by 8 ft. wide.

ACTION/RESOLUTION ADOPTED: Denied requested setback at six feet
for proposed porch enclosure and new front step area at four feet from
the front properly line. This application is denied without prejudice
to a future new, different application.
REASONS/FINDINGS: Alternatives are available to locate a porch area
in other open yard areas without a substantial variance from the code
requirements. The relief requested in this application is substantial,
being a variance of 40% or more of the present nonconforming setback,
and being a variance of 80% of the normal code requirement for a 35 ft.
front yard. House is presently situated on a lot of approximately 8250
sq. ft., approximate dimensions 50' x 150'. Outside wall of existing
house is shown to be 14 feet from the front property line along
L'Ilommedieu Lane, 36+- feet from Old Shipyard Road, and 84+- feet from
the westerly property line. The northerly and easterly yard areas limit
the allowable setbacks and building area due to the preexisting history
of the dwelling in a nonconforming location.

NOTICE OF HEARINGS
NOTICE IS HEREBY GIVEN; pursuant to Section 267 of the' Town Law
and the Code of the Town of Southold, that the following applications will
be held for public hearings before the SOUTHOLD TOWN BOARD OF
APPEALS, at the Southold Town Hall, 53095 Main Road, Southold, New
York 11971, on WEDNESDAY, JANUARY 10, 1996, commencing at the times
specified below:
7:30 p.m. Appl. No. 4356 - MARTIN and CHRISTINE KOSKYNKA. This
is a request, based upon the December 6, 1995 Notice of Disapproval
issued by the Building Inspector, in which applicant was denied a building
permit to construct an accessory garage building in the required front
yard at less than 35 feet. Location of Property: 1985 Pine Tree Road,
Cutchogue, NY; County Tax Map No. 1000-98-1-11.2. This parcel
consists of a size under 20,000 sq. ft., and the principal front yard
setback is shown under Article XXIV, Section 100-244B.
7:33 p.m. Appl. No. 4357 - MARGUERITE RUSSELL. This is an appeal
based upon the December 8, 1995 Notice of Disapproval from the Building
Inspector in which applicant was denied permission to re-construct
one-family dwelling destroyed by fire 6/13/95 on the grounds that
Article XXIV, Section 100-242B of the Zoning Code reads that
reconstruction of a dwelling with a nonconformity (front yard setback) is
not permitted if destroyed by fire. Subject premises contains a
nonconforming lot area of 23,850 sq. ft. and is located in the R-40

Grand Avenue at Wickham Avenue, Mattituck, NY; County Parcel

7:37 p.m. - Appl. No. 4355 - PETER AND JANET BLOOM. This an appeal
based upon the November 29, 1995 Updated Notice of Disapproval issued
by the Building Inspector in which applicant was denied a permit to
construct front porch addition to dwelling with insufficient front yard
setback and exceeding the maximum lot coverage allowable in this R-40
Zone District, Article IIIA, Section 100-30A.3. This parcel contains a
nonconforming lot area of approximately 7,960 sq. ft. Location of
Property: 580 L'Hommedieu Lane at intersection with Old
Shipyard Road, Southold; County Parcel No. 1000-64-2-53. R-40 Zone.
The Board of Appeals will at said time and place hear any
and all persons or representatives desiring to be heard in the
above applications. Written comments may also be submitted
prior to the conclusion of the subject hearing. The above
hearings will not start before the times designated, and are in
addition to other hearings. It is recommended that the file(s)
be reviewed before the scheduled date of the hearing for
updates or new information. If you have questions, please also
do not hesitate to call 765-1809.

Inspector dated November 29, 1995.
PROVISIONS APPEALED FROM: Article ILIA, Section 100-30A.3.
RELIEF REQUESTED: Enclosed porch addition with a reduced setback at
six feet from the front property line along L'Hommedieu lane, and four
feet from the edge of the proposed new front step area. The length of
the porch is proposed at 28'6" by 8 ft. wide.

ACTION/RESOLUTION ADOPTED: Denied requested setback at six feet
for proposed porch enclosure and new front step area at four feet from
the front property line. This application is denied without prejudice
to a. future new, different application.
REASONS/ FINDINGS: Alternatives are available to locate a porch area
in other open yard areas without a substantial variance from the code
requirements. The relief requested in this application is substantial,
being a variance of 40% or more of the present nonconforming setback,
and being a variance of 80% of the normal code requirement for a 35 ft.
front yard. House is presently situated on a lot of approximately 8250
sq. ft., approximate dimensions 50' x 150'. Outside wall of existing
house is shown to be 14 feet from the front property line along
L'Hommed'ieu Lane, 36+- feet from Old Shipyard Road, and 84+- feet from
the westerly property line. The northerly and easterly yard areas limit
the allowable setbacks and building area due to the preexisting history
of the dwelling in a nonconforming location.

Application for PETER BLOOM for a Variance to the Zoning
Ordinance, Articll IIIA, Section 100-30A.3, as disapproved, for
permission to construct a deck addition to existing residoDc7t=
with insufficient sideyard setbacks. Location of Property: 46
Old Shipyard Lane and 580 L'Hommedieu, Southold; County Tax Nail
District 1000, Section 64, Block 2, Lot 53.
WHEREAS, a public hearing was held on September 26, 1,990 5?x
the Matter of the Application of PETER BLOOM under Appeal No.
3966; and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the Board has carefully considered all testimony
and documentation submitted concerning this application; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1. The premises in question is located along the southerly
side of L'Hommedieu Lane in the Hamlet and Town of Southold, is
also known as Lot #71 on the "Map of Founders Estates" filed in
the Suffolk County Clerk's office as Map No. 834, and is
moreparticularly identified on the Suffolk County Tax Maps as
District 1000, Section 64, Block 2, Lot 53.

2. The subject premises is a substandard parcel aontainisxg
a total lot area of approximately 7,500 square feet, and is a
corner lot with two street frontages: 49.79 feet along Old
Shipyard Lane and 150.13 feet along L'HommeDieu Lane.
3. The subject premises:
(a) is improved with a one-and-one-half store
single-family dwelling set back at its closest point from the
northerly (front) property line 14 feet, exclusive of stoop
area, 12+- feet from its closest point to the southerly property
line, and 36 feet from the easterly (front) property line;
(b) is located in the R-40 Zone District which
requires a minimum side yard at 15 feet.
4. Appellants are requestingpermission to construct
raised deck encompassing the existing flagstone patio area and a
partial raised deck around the west side of the house adjacent.

point is to be 11 feet, and the depth 3316" (west to east).
The setback of the proposed deck will be the same as the
existing flagstone patio at approximately 1-1/2 feet from
the southerly property line.
5. In considering this application, the Board also finds
and determines:
(a) that the grant of the variance will not be
adverse to the essential character of the neighborhood;
(b) the variance will not in turn be adverse to the
safety, health, welfare, comfort, convenience or order of the
town, or be adverse to neighboring properties;
(c) the grant of the variance will not increase
dwelling unit density or cause a substantial effect on available
governmental facilities;
(d) the relief is the minimum necessary to afford
relief;
(e) the practical difficulties claimed are sufficient;

(f) the difficulties cannot be obviated by some
method feasible to appellant to pursue, other than a variance;
(g)• in considering all of the above factors, th
interests of justice will be served by granting the variance+, as
conditionally noted below.
Accordingly, on motion by Mr. Grigonis, seconded by
Mr. Doyen, it was
RESOLVED, to GRANT the relief requested under Appeal
No. 3966 in the Matter of PETER BLOOM for a new deck addition as
described above, SUBJECT TO THE FOLLOWING CONDITIONS:
1. That the deck construction be not closer than eighteen
(18") inches to the southerly (side) property line;
2. That the deck not exceed sixteen (1611) inches above
grade;
3. That the deck construction remain open and unroofed,
and not be enclosed, as proposed;
4. That any ligts be ground lighting shielded to the
ground.
5. That the deck construction not be converted for livable
floor area (as proposed).
Vote of the Board: Ayes: Messrs. Goehringer, Doyen,
Grigonis and Dinizio. (Member Sawicki was absent.) This
resolution was duly adopted.

Conservation Law and Local Law #44-4 of the Town of Southold.
An Environmental Assessment (Short} Form has been
submitted; however, Section 617.13 of 6 NYCRR Part 616, and
Section 8-0113 of the Environmental Conservation Law, this
variance application falls under the Type II classification as
established by law. Further, this Department may not be an
involved agency under SEQRA {Section 617.13(a) as amended
February 14, 19901..
Although this action is classified as Type II for this
variance application under SEQRA {specifically 617.13, 616.3(j),
and 617.2(jj)), this determination shall have no affect upon any
other agency's interest or SEQRA determination as an involved
agency.

A. This application must be filled in by typewriter OR ink and submitted to the building
inspector with the following: for new building or new use:
1. Final survey of property with accurate location of all buildings, property lines,
streets, and unusual natural or topographic features.
2. Final Approval from Health Dept. of water supply and sewerage-disposal(S-9 form).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used in system contains
less than 2/10 of 12 lead. _
5. Commercial building, industrial building, multiple residences and similar buildings
and installations, a certificate of Code Compliance from architect or engineer
responsible for the building.
6. Submit Planning Board Approval of completed site plan requirements.
B. For existing buildings (prior to April 9, 1957) non-conforming uses, or buildings and
"pre-existing" land uses:
1. Accurate survey of property showing all property lines, streets, building and
unusual natural or topographic features.
2. A properly completed application and a consent to inspect signed by the applicant.
If a Certificate of Occupancy is denied, the Building Inspector shall state the
reasons therefor in writing to the applicant.
