FINDINGS OF FACT
PROPER'T'Y FACTS/DESCRIP'T'ION:
This property is located in an R-40 Low -Density Residential Zone
District, being situate on the northerly side of Peconic Bay
Boulevard, Laurel. This lot contains a total area of 6175 sq. ft.
and as shown on the map submitted under this application, the
property is improved with a single-family dwelling and deck, all
lotaliug approximately 3520 square feet.
BASIS OF APPEAL: Building Inspector's Action of Disapproval dated
June 20, 1997 as amended, which reads as follows:
"...In an R.-40 Zone, the rear yard setback on a lot with less
than 20,000 sq. ft. is 35 feet. The 'as built' deck replacement
encroaches two feet more than the original screen porch. The
oew deck creates a rear yard setback of approximately 19.5
feet. The original screen porch was 21.8 feet from the rear
property line. See attached survey dated August 17, 1989.
Also, Article IIIA, Ch. 100-30A.3 the deck construction causes
allowable lot coverage to be exceeded by approx. 19 sq. ft.
Article XXIV, Section 100-244B...."
AREA VARIANCE' RELIEF REQUESTED BY APPLICANT: For approval
of reduced rear yard setback after construction of new deck "as
built" with a size shown at 14 ft. deep by 16 ft. wide extending
from the rear wall of the dwelling, leaving a principal rear yard
setback at 19'8" and lot coverage at approximately 19 feet over the
maximum permitted of 20 percent of the total lot area. The size of
the lot is 6,175 square feet.

REASONS FOR BOARD ACTION DESCRIBED BELOW:
A similarly sized parcel of land to the north (1000-128-1-11) has a
rear yard setback reduction at 25 feet (approved in 1989).
(1) The granting of the area variance will not produce an
undesirable change in character of neighborhood or a detriment to
nearby properties because the yard is enclosed with a stockade fence
giving maximum privacy.
(2) The benefit sought by the applicant cannot be achieved by some
method, feasible for applicant to pursue, other than an area variance
because the deck is "as built."
(3) The requested area variance is substantial reducing required
setback of 35 feet to 19.5 feet and modifying nonconforming lot
coverage to a new calculation of 56.230.
(4) The proposed variance will not have an adverse effect or impact
on the physical or environmental conditions in the neighborhood or
district because it does not interfere with neighboring properties
directly or indirectly.
(5) The situation has been self-created since the replacement of an
existing porch changed the measurements of the footage for the new
deck. Applicant should have been aware of or informed of the
setback requirements prior to building.
(6) This action is the minimum that the Board deems necessary and
adequate and at the same time preserves and protects the character
of the neighborhood, and the health, safety, welfare of the
community.
RESOLUTION/ACTION: On motion by Member Ostermann, seconded
by Member Dinizio, it was
RESOLVED, to GRANT the relief as applied, subject to the
CONDI'T'ION that the deck not be enclosed.

encroaches two .feet more than the original screen porch. The

REASONS FOR BOARD ACTION, DESCRIBED BELOW:
A similarly sized parcel of; land.. to the,north (1000-128-1-11) has a'L
rear yard setback reduction at 25 feet (approved in 1989) .
(1) The . granting of the area variance 'will not produce an
undesirable change in .character of. neighborhood or, a detriment to
nearby properties because the yard.: is enclosed with a. stockade fence
giving maximum privacy.
(2) The benefit sought by,- the, applicanf- cannot - be achieved by some
method, feasible for applicant', to "pursue, ---other than an area variance
because the deck is "as built . "
(3) The requested area variance is substantial reducing required
setback of 35 feet to 19.'5 feet and modifying nonconforming , lot
coverage to a new calculation of,.56.230.
(4) The proposed variance will not have an adverse effect or impact
on the physical or environmental conditions in the neighborhood or
district because it does not interfere with neighboring properties
directly or indirectly.
(5) The situation- has- been self-created -since the replacement of an
existing porch changed the; measurements . of the footage for the new

(6) This action is the minimum that the Board deems necessary and
adequate and ' at the same time preserves and protects the character

This Agreement,' dated the 3rd day of December, 1996, between NOREEN
KELLY (SELLER) and John Peterson & Denise Flannery ("PURCHASERS") reflects their
desire to modify the Contract of Sale, dated September, 1996 as follows:
Inasmuch as the premises' rear deck may have been added or altered without the
benefit of permit(s) and.
Inasmuch. as the premises, as novo existing, may. or may not require a variance;
the SELLER agrees:
(a) to apply to the Town 'of Southold for a permit, to legalize the premises'
rear deck and to make all efforts necessary to obtain a Certificate of Occupancy, letter -in -lieu
of Certificate, of .Occupancy or Certificate of -Completion or variance in an expedited fashion;
(b) to deposit $500-.00into an_escrow account with the law firm of. Lian,
Malapero. & Prisco as escrow agent;
(c) PURCHASERS agree to cooperate fully with the SELLER in any and all
efforts. to secure such documentation;
(d) that should a variance be denied rhe PURCHASERS may take the steps
necessary to legalize the premises' .rear deck and upon production of paid .bil4 forwarded to
Liars,. Malapero & Prisco, the escrow agent. shall reimburse the PURCHASERS -for the cost of
same and any excess remaining in escrow shall be paid to the SELLER'

implementing regulations pertaining to Article 8 of the N.Y.S.
Environmental Quality Review Act of the Environmental
Conservation Law and Local Law 74^-4 of the Town_ of Southold.
An Environmental Assessment (Short) Form has been
submitted; however, Section 66 7.13 of 6 NYCRR. Part '616, and
Section 8-0113 of the Environmental Conservation Law, this
variance application -falls under the Type I1 classification as
established by law. Further, this Department may not be an
involved agency under SEQRA {Section 617.13(a) as amended
February 14, 1990)..
Although this action is classified as Type IT for this
variance application under SEQRA {specifically 617.13, 616.3(j),
and 617.2(jj)), this determination shall have no affect upon any
other agency's interest or SEQRA determination as an involved
agency.

SUBJECT: Notice . of Disapproval for 1000-128-,1-12 (Toscano)
We have today received an application for a variance for an "as
built" deck.
In reviewing the disapproval, it is noted that the rear yard setback
shows that the setback should be 25 feet for a nonconforming lot
with less than 20,000 sq. ft.
Please confirm and update the Notice of Disapproval to include the
code's requirements for:
a) 35 ft. rear requirement instead of 25 feet noted in the March
4, 1997 disapproval, under Section 100-244B for nonconforming lots
under 20,000 sq. ft. , and
b) lot coverage calculations - it appears to be slightly over
20% -. also under Section 100-244B.
