No. 4,190 - RICHARD SIRIANO PARCEL 1000-97-7-5 STREET & LOCALITY: 600 Beebe Drive, Cutchogue DATE OF PUBLIC HEARING: July 10, 1997. FINDINGS OF FACT PROPERTY DESCRIPTION: This property is located in all R-40 Low -Density Residential Zone District, being situate along Beebe Drive all(] fronting along a canal of East Creek. This lot consists of a total area of approximately 22,200 sq. ft., lot width (frontage) along Beebe Drive of 100 feet and average lot depth of 220 feet. This lot is improved with a single-family, 1-1/2 story dwelling with frame deck and walk as shown on the survey last dated April 17, 1997. BASIS OF APPEAL: Building Inspector's Action of Disapproval dated April 29, 1997, which states that in the case of a waterfront parcel, accessory buildings and structures may be located in the front yard, provided that such buildings and structures meet a minimum front yard setback 40 feet. The side yard setback is shown to be the minimum requirement at five feet (as per 100-244B for lots having 22,200 sf in size). AREA VARIANCE RELIEF REQUESTED BY APPLICANT: To locate an accessory garage on a waterfront lot at 28 feet (closest setback) and 32 ft. front yard at the opposite front yard setback. Article III, Section 100-33 requires a minimum of 40 feet from the front property line. REASONS FOR BOARD ACTION, DESCRIBED BELOW: (1) The granting of the area variance will not produce an undesirable change in character of neighborhood or a detriment to nearby properties because two houses to the northeast visually appear in harmony with the adjacent house to the northeast. (2) 'Phe benefit sought by the applicant cannot be achieved by some method, feasible for applicant to pursue, other than an area variance. (3) The requested area variance is not substantial representing approximately 30 percent variation for the front yard setback. (5) The situation has not been self-created. (6) This action is the minimum that the Board deems necessary and adequate and at the same time preserves and protects the character of the neighborhood, and the health, safety, welfare of the community. RESOLUTION/ACTION: On motion by Member Dinizio, seconded by Member Tortora, it was RESOLVED, to GRANT the relief as applied With electric utility only. FINDINGS OF FACT PROPERTY DESCRIPTION: This property is located in an R-40 Low -Density Residential Zone District, being situate along Beebe Drive and fronting along a canal of East Creek. This lot consists of a total area of approximately 22,200 sq. ft., lot width (frontage) along Beebe Drive of 100 feet and average lot depth of 220 feet. This lot is improved with a single-family, 1-1/2 story dwelling with frame deck and walk as shown on the survey last dated April 17, 1997. BASIS OF APPEAL: Building Inspector's Action of Disapproval dated April 29, 1997, which states that in the case of a waterfront parcel, accessory buildings and structures may be located in the front yard, provided that such buildings and structures meet a minimum front yard setback 40 feet. The side yard setback is shown to be the minimum requirement at five feet (as per 100-244B for lots having 22,200 sf in size) . AREA VARIANCE RELIEF REQUESTED BY APPLICANT: To locate an accessory garage on a waterfront lot at 28 feet (closest setback) and 32 ft. front yard at the opposite front yard setback. Article III, Section 100-33 requires a minimum of 40 feet from the front property line. REASONS FOR BOARD ACTION, DESCRIBED BELOW: (1) The granting of the area variance will not produce an undesirable change in character of neighborhood or a detriment to nearby properties because two houses to the northeast visually appear in harmony with the adjacent house to the northeast. (2) The benefit sought by the applicant cannot be achieved by some method, feasible for applicant to pursue, other than an area variance. (3) The requested area variance is not substantial representing approximately 30 percent variation for the front yard setback. Moore 1 PCM\Mr Encls. r Reason for Appeal Continued Zoning Board of Appeals re: Richard and Theresa Siriano Pursuant to Town Law.section 267b-3 the Southold Town Zoning Board of Appeals is to analyze and asses the personal benefits anticipated by the applicant against the potentially deleterious effects that a grant of the relief requested would have on the health, safety and welfare of the effected neighborhood or community. In performing this balancing test, the Zoning Board is charged with the responsibility to consider the five factors enumerated in Town Law Section 267b -3(b). The variance should be granted for the following reasons: 1. No undesirable change will be produced in the character of the neighborhood or a detriment to nearby properties,if the variance is granted. The zoning is R-40 which allows accessory structures in the front yard on a waterfront parcel, however, the required setback for the accessory structure is a minimum of 40 feet. The road angles out, an additional 12 feet from the property line, so the garage will appear to be located in character with the community and similarly located to other properties in the neighborhood. The house on the adjacent property, as well as the house to the north, are set back approximately 40 feet from their front property line, however due to the angle of the road the garage will be at the same line of sight of the neighboring homes. 2. The benefit sought by the applicant can not be achieved by some method, feasible for the applicant to pursue, other than an area variance. The property is only 100 feet in width, the house is located in the center of the property. The existing garage is under the house. The applicant has experienced significant flooding in the past year during storm tides making the existing garage unusable, causing flooding to the inside of his house, and creating a situation which is dangerous to the health and welfare of the applicant. If the proposed garage is approved the existing garage under the house will be enclosed in order to prevent flooding in the house. The foundation will be back-filled, and the grade of the property will be brought to the existing grade of the house. The location of the proposed garage is very difficult to locate, with little flexibility, because the owner must continue to have access to the rear of the property. The area variance is not substantial, in that the proposed garage will replace the existing garage, be located in the same line of sight as the adjacent properties. The proposed set back is as far back as practical in order to allow for emergency vehicle, and boat trailers, to access the rear of the waterfront property. The application of the balancing test weighs in favor of the grant of the variance. 4. The variance will have no adverse effect or impact on the physical or environmental conditions in the neighborhood or district. The flooding of the property will be eliminated by the construction of the proposed garage and regrading of the property. The homes in this neighborhood were built prior to wetland regulations., the homes were located close to the wetlands with attached garages in the front yard. Any development of the existing homes will have similar unique problems with locating structures with the required setbacks from the wetlands, and required setbacks from the street. The, character of the neighborhood is not affected.. 5. The alleged difficulty was not self-created. The existing house was built in conformity to zoning, the applicants bought the house as built. The property was excavated in„order to place the garage under the house. This original -desigh"and topography of this property was very imprudent. The garage floods and up to three feet of water accumulates in the garage, destroying all -it's contents. The applicant wishes to correct this situation. 6. The variance requested is the minimum variance practicable given the personal benefits anticipated by the applicant. The applicant cannot increase the front yard setback of the garage because the rear access to the property will be adversely affected. The garage is the average size of the waterfront homes in this community. We respectfully request that the appeal be granted,together with any further relief that is deemed necessary and reasonable.
