PROPERTY DESCRIPTION:
This property is located in an R-120 Residential Zone District, being
situate at the southerly end of a private right-of-way, at Middle
Farms, Fishers Island, New York. This lot is a waterfront lot with
frontage along Middle Farms Pond, and contains a total area of
101,930+- sq. ft. The November 12, 1996 survey shows the
property is improved with a single-family, two-story dwelling and
private dock area for the residents' uses.
BASIS OF APPEAL: Building Inspector's Action of Disapproval dated
September 16, 1996 reads as follows: under Article XXIII, Section
100-239.4B, "proposed deck addition to dwelling will have less than
the required 75 feet setback from the bulkhead; 40 ft. indicated.
Action required by the Zoning Board of Appeals...."
AREA VARIANCE RELIEF REQUESTED BY APPLICANT: To locate
accessory swimmingpool in a yard other than the required rear yard
or required front yard on this waterfront parcel, as shown on the
November 12, 1996 Chandler, Palmer & Ding site plan map at more
than 100 feet from all property lines, except that the distance
proposed to the bulkhead at its closest (corner) point is 85 feet
(63+- feet to patio).
REASONS FOR BOARD ACTION, DESCRIBED BELOW:
(1) The granting of the area variance will not produce an
undesirable change in character of neighborhood or a detriment to
nearby properties because the location is situated at the center of
the lot, it is wooded and not visable off-site.
(2) The benefit sought by the applicant cannot be achieved by some
method, feasible for applicant to pursue, other than an area variance
because the topography of the land, and requirements of the Town

Trustees and the wetlands ordinance; also the land falls off on
three sides from the pool - it is a hillside.
(3) The requested area variance is not substantial because there is
more than adequate lot area which does not affect neighboring
properties.
(4) The proposed variance will not have an adverse effect or imps
on the physical or environmental conditions in the neighborhood or
district because the N.Y.S. Department of Environmental
Conservation and Town Trustees (environmental agencies) have
reviewed this project.
(5) The situation has not been self-created because this is a new
project in the most practical location considering all circumstances
relative to the property and its improvements.
(6) This action is the minimum that the Board deems necessary and
adequate and at the same time preserves and protects the character
of the neighborhood, and the health, safety, welfare of the
community.

NOTICE IS HEREBY GIVEN, pursuant to Section 267 of the Town
Law and the Code of the Town of Southold, the following applications
will be held for public hearings by the SOUTHOLD TOWN BOARD OF
APPEALS, at the Southold Town Hall, 53095 Main Road, Southold, New
York 11971, on WEDNESDAY MAY 7, 1997 the times noted below (or
as soon thereafter as possible):
6:45 p.m. Appl. No. 4472 - RICHARD BOARDMAN. This is a variance
application based upon three Actions of Disapproval:
(a) dated March 12, 1997 to construct an alteration and additions

is requested for the reason that construction of a swimming pool on the southerly side of the
residence, which has been designated as the side yard area under the Zoning Ordinance of
the Town of Southold, will require an area variance." See "Site Plan Proposed Pool Prepared

REASON FOR APPEAL Continued
T. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sory HARDSHIP because the Building Inspector has determined the southerly side of the
existing residence is defined as a side yard area under the Zoning Ordinance of the
Town of Southold. The Appellant has received approval from the Southold Town Trustees
and the NYS Department of Environmental Conservation to construct a pool in this area
as shown on Exhibits 4 and 5.
It is submitted that allowing a swimming pool on the southerly side yard area of
the residence would not produce an undesirable change in the character of the
neighborhood nor will a detriment to nearby properties be created by the granting
of this side yard variance. This request for aside yard variance is technical in
nature becauseof the location of the house in relationship to Middle Farms.Poud and
the right-of-way granting ingress and egress to the property, there will be no change,
much less an adverse effect or impact on the physical or environmental conditions in
the neighborhood.
Due to the Building Inspector's interpretation of the side yard area under the
Zoning Ordinance, and the approvals of the Southold Town Trustees and the NYS Department
of Environmental Conservation, the alleged difficulty was not self-created. Since the
property is 2.06+ acres and this particular side yard is approximately 210 feet, this
requested variance is not substantial. The relief sought by the Appellant cannot be
achieved by any other method than the granting of a side yard variance from the Zoning
Board of Appeals because to locate the swimming pool in the rear yard area would be a
violation of the permits of the DEC and Trustees, and to locate it in the front yard
area could affect the aestheies of this property.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because as it is submitted this is the only
property in this neighborhood ',where _the.position of the house creates a_"side yard"
which in reality is'the�rear yard living space in relationship with Middle Farms Pond
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because this particular area is residential and the
installation of a swimming pool would not affect this neighborhood as it would be
built in the "side yard" area.

AREA VARIANCE
- Town Law Amendments 5267b-3 Effective July 1, 1992:
AREA VARSAtjcE is authorization by the ZBA for the use of land in an ;Wanner
which is not allowed by the dimensional or topographical requirements of the
applicable zoning code regulation. 5267(1) of Town Law.
The new Statute no longer includes the term "practical difficulty" or.any
particular test, and new provides that ZBAs consider two. basic things:
1. the benefit to the applicant if the variance is granted; and
2. the datriment to the health, safaty and general welfare of
the neighborhood or camminitl that would occur if the variance were to
be granted.
In balancing the interests above, ZBAs must also consider the Eollowing fire
factors for an AREA VARIMCE:
1. whether an undesirable change will be produced in the character of
the neighborhood or a detriment to nearby properties, if granted;
2. whether the benefit sought by the applicant can be achieved by some
method, feasible for the applicant to pursue, other than an area var=ante;
3. whether the area variance is substantial;
4. whether the variance will have an adverse effect or impact on the
physical or environmental conditions in the neighborhood or district; and
S. whether the alleged difficulty was self -cr=ated, which consideration
shall he relevant to the ZBA's decision but shall not preclud4 the granting
of an area variance.
Also, as part of the "balancing concept," the new statute provides that:
6. the ZBA shall grant the minimum variance that it shall deem necessary
and adequate, and at the same time preserve and protect the character of the
neighborhood and the health, safety and welfare of the community.

variance application falls under the Type I1 classification as
established by law. Further, this Department may not be an
involved agency under SEQRA {Section 617.13(a) as amended

Although this action is classified as Type II for this

and 617.2(jj)}, this determination shall have no affect upon any

REASON FOR APPEAL,:Continued
1. STRICT APPLICATION `OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSHIP because the Building Inspector has determined the southerly side of the
existing residence is defined as a side yard area under. the Zoning Ordinance of the
Town of Southold. The Appellant has received approval from the Southold Town Trustees
and the NYS Department of Environmental Conservation to construct.a pool in this area
as shown on Exhibits'4 and 5.
It is submitted that allowing a swimming pool on the southerly side yard area of
the residence would not produce an undesirable change in the character of the
neighborhood nor will a detriment to nearby properties be created by,the granting
of this side yard.variance. This request for a side yard -variance is technical in
nature becaus-e.of- the location of the house in relationship to Middle Farms•.Pond and
the right-of-way granting ingress and egress to the property, there will be no change,
much less�an adverse effect or impact on,the physical or environmental conditions in
the neighborhood. i
Due to the Building Inspector's interpretation of the side yard area under the
Zoning Ordinance., and the approvals ofthe Southold Town Trustees and the'NYS Department
of Environmental Conservation, the alleged difficulty was not self-created. Since the
property is 2.06+ acres and this particular side yard is approximately 210 feet, this
requested variance is not substantial. The relief sought by the Appellant cannot be
achieved by any other method than the granting of a side yard variance from the Zoning
Board of Appeals because to locate the swimming pool in the rear yard area would be a
violation of the permits of the DEC and Trustees, and to locate it in the front yard
area could affect the aestheics of this property.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because as it is submitted this is the only
property in this neighborhood'_.where`,.�the,:position of. _the .house creates a_.".side. yard"
which in rea1ty..is,,:the;rerar yard living space in relationship with Middle Farms Pond.
3. The Variance would observe the spirit of the Ordinance and WOULD 'NOT CHANGE THE
CHARACTER.OF THE DISTRICT because this particular area is residential and the
installation of a swimming pool would not affect this neighborhood.as it would be
built in the "side yard" area.

GENERAL CONDITIONS
Inspections
1. The permitted site or facility, including relevant records, is subject to in-
spection at reasonable hours and intervals by an authorized representative of
the Department of Environmental Conservation (the Department) to determine
whether the permittee is complying with this permit and the ECL. Such represen-
tative may order the work suspended pursuant to ECL 71-0301 and SAPA 401(3). A
copy of this permit, including all referenced maps, drawings and special
conditions, must be available for inspection by the Department at all times at
the project site. Failure to produce a copy, of the permit upon request by a
Department representative is a violation of this permit.
Permit Changes and Renewals
2. The Department reserves the right to modify, suspend or revoke this permit when:
a) the scope of the permitted activity is exceeded or a violation of any
condition of the permit or provisions of the ECL and pertinent regula-
tions is found:
b) the permit was obtained by misrepresentation or failure to disclose
relevant facts;
c) new material information is discovered; or
d), environmental conditions, relevant technology, or applicable law or
regulation have materially changed since the permit was issued. .
3. The permittee must submit a separate written application to the Department for
renewal, modification or transfer of this permit. Such application must include
any forms, fees or supplemental information the Department requires. Any
renewal, modification or transfer granted by the Department must be. in writing.
4. The permittee must submit a renewal application at least:
a) 180 days before expiration of permits for State Pollutant Discharge
Elimination System (SPDES), Hazardous Waste Management Facilities
(HWMF), major Air Pollution Control (APC) and Solid Waste Management
Facilities (SWMF); and
b) 30 days before expiration of all other permit types.
5. Unless expressly provided for by the Department, issuance of this permit does
not modify, supersede or rescind any order or determination perviously issued by
the Department or any of the terms, conditions or requirements contained in such
order or determination.
Other Legal Obligations of Permittee
6. The permittee has accepted expressly, by the execution of the application, the
full legal responsibility for all damages, direct or indirect, of whatever
nature and by whomever suffered, arising out of the project described in this
permit and has agreed to indemnify and save harmless the State from suits,
actions, damages and costs of every name and description resulting from this
project.
7. This permit does not convey to the permittee any right to trespass upon the
lands or interfere with the riparian rights of others in order to perform the
permitted work nor does it authorize the impairment of any rights, title, or
interest in real or personal property held or vested in a person not a party to
the permit.
8. The permittee is responsible for obtaining any other permits, approvals, lands,
easements and rights-of-way that may be required for this project.

revocation of this permit, the structure, fill, excavation, or other
modification of the watercourse hereby authorized shall not be com-
pleted, the owners, shall, without expense to the State, and to such
extent and in such time and manner as the Department of Environmental
Conservation may require, remove all or any portion of the uncompleted
structure or fill and restore to its former condition the navigable
and flood capacity of (fie watercourse. No claim shall be made against
the State of New York on account of any such removal or alteration.

bility of obtaining any other permission, consent or approval from
the U.S. Army Corps of Engineers, U.S. Coast Guard, New York Stale
Office of General Services or local government which may be required.
12 All necessary precautions shall he taken to preclude contamination
of any wetland or waterway by suspended solids, sediments, fuels,
solvents, lubricants, epoxy coatings, paints, concrete, leachate or any
13. Any material dredged in the prosecution of the work herein permitted
shall be removed evenly, without leaving large refuse piles, ridges across
the bed of a waterway or floodplain or deep holes that may have a
tendency to cause damage to navigable channels or to the banks of
a waterway.
14. There shall be no unreasonable interference with navigation by the work
herein authorized.
15 If upon the expiration or revocation of this permit, the project hereby
authorized has not been completed, the applicant shall, without expense
to the State, and to such extent and in such time and manner as the
Department of Environmental Conservation may require, remove all or
any portion of the uncompleted structure or fill and restore the site
to its former condition. No claim shall be made against the State of
New York on account of any such removal or alteration.
16. If granted under 6 NYCRR Part 608, the NYS Department of Environ-
mental Conservation hereby certifies that the subject project will not
contravene effluent limitations or other limitations or standards under
Sections 301, 302, 303, 306 and 307 of the Clean Water Act of 1977
(PL 95-117) provided that all of the conditions listed herein are met.
17. All activities authorized by this permit must be in strict conformance
with the approved plans submitted by the applicant or his agent as part
of the permit application.

SPECIAL CONDITIONS
1. Construction activities in the wetland/adjacent area/water
body are prohibited during the period March 15 through
September 15.
2. Prior 'to commencement of any construction activities, a
continuous row of straw bales shall be staked end to end along
the existing fence shown on the approved plans. The bales
shall be maintained, repaired and replaced as often as
necessary to ensure proper function, until all disturbed areas
are permanently vegetated. The average useful life of a bale
is approximately 3-4 months. Sediments trapped by the bales
shall be removed to an approved upland location before the
bales themselves are removed.
3. All fill shall consist of clean soil, sand and/or gravel that
is free of the following substances: asphalt, slag, flyash,
broken concrete, demolition debris, garbage, household refuse,
tires, woody materials including tree or landscape debris, and
metal objects. The introduction of materials toxic to aquatic
life is expressly prohibited. No clearing of vegetation
within 100' of pond.

SPECIAL CONDITIONS
For Article 24 Freshwater Wetland
4. Any demolition debris, excess construction materials, and/or
excess excavated materials shall be immediately and completely
disposed of on an approved upland site more than 100 feet from
any regulated freshwater wetland. These materials shall be
suitably stabilized so as not to re-enter any water body,
wetland, or wetland adjacent area.
5. Use of wood treated with pentachlorophenol or creosote is
prohibited. Standard pressure treated dumber is treated with
CCA and its use is permitted.
6. The permittee shall incorporate the following language as a
notice covenant to the deed:
"Regulated freshwater wetlands associated with Middle Farms
Pond are located on the southern portions of the properties of
Suzanne Cameron -Schutz and her heirs, assigns or successors.
This property is subject to the provisions of Environmental
Conservation Law (ECL). Article 24, and the conduct of
regulated activities may occur only pursuant to ECL Article 24
if prior approval is given by the New York State Department of
Environmental Conservation (NYSDEC) or its successor(s).
Regulated activities include, but are not limited to clearing
of vegetation; application of chemicals; excavation; grading
and filling; and erection of any structure(s)."
This deed covenant shall be recorded with the Clerk of Suffolk
County within 90 days of the issuance of this permit.. A copy
of the covenanted deed or other acceptable proof of record,
along with the number assigned to this permit, shall be. sent
within one calendar year of the issuance of..this permit to:
NYSDEC, Regional Manager BEP, SUNY Bldg. 40, Stony Brook, New
York 11790-2356.

SUPPLb ENTARY SPECIAL CONDITIONS
The following conditions apply to all Tidal Wetlands; Freshwater
Wetlands; Coastal Erosion Management; and Wild, scenic, and
Recreational Rivers Permits:
A. A 'copy of this permit, including all*conditions and
approved plans, shall be available at the project site
whenever authorized work is in progress. The permit
sign enclosed with the permit shall 'be protected from
the weather and posted in a conspicuous location at the
work site until all authorized work has been completed.
B. The permittee shall require that any contractor,
project engineer, or other person responsible. for the
overall supervision of this project reads, understands,
and complies with this permit and all its general,
special, and supplementary special conditions. Any'
failure to comply precisely with all of the terms and
conditions of this permit, unless- authorized in
writing, shall be treated as a violation of the
Environmental Conservation Law. If any of the permit
conditions are unclear, the permittee shall contact the
Division of Regulatory Affairs at the address on page.

C. If project design modifications become necessaryy
permit issuance, the permittee shall submit the after
appropriate plan changes for approval by the Regional
Permit Administrator prior to undertaking any such
modifications. The permittee is advised that
substantial modification may require submission of a

D. At least 48 hours prior to commencement of the project,
the permittee and contractor shall sign and return the
top portion of the enclosed notification form
certifying that they are fully aware of and understand
all terms and conditions of this permit. Within 30
days of completion of the permitted work, the bottom
portion of that form shall also be signed and returned,
along with photographs of the completed work and, if
required, a survey.
E. For projects involving activities to be undertaken in .
phases over a period of more than one year, the
permittee shall notify the Regional Permit
Administrator in writing at least 48 hours prior to
recommencing work in subsequent years.
F. The granting of this permit does not relieve the permittee
of the responsibility of obtaining a grant, easement, or
other necessary approval from the Division of Land
Utilization, Office of General Services, Tower Building,
Empire State Plaza, Albany, NY 12242 (516) 474-2195, which
