No. 4474 - SUZANNE CAMERON SCHUTZ PARCEL 1000-8-1-2 STREET & LOCALITY: Private Road off East End Road, at Middle Farms, Fishers Island DATE OF PUBLIC HEARING: May 7, 1997 PROPERTY DESCRIPTION: This property is located in an R-120 Residential Zone District, being situate at the southerly end of a private right-of-way, at Middle Farms, Fishers Island, New York. This lot is a waterfront lot with frontage along Middle Farms Pond, and contains a total area of 101,930+- sq. ft. The November 12, 1996 survey shows the property is improved with a single-family, two-story dwelling and private dock area for the residents' uses. BASIS OF APPEAL: Building Inspector's Action of Disapproval dated September 16, 1996 reads as follows: under Article XXIII, Section 100-239.4B, "proposed deck addition to dwelling will have less than the required 75 feet setback from the bulkhead; 40 ft. indicated. Action required by the Zoning Board of Appeals...." AREA VARIANCE RELIEF REQUESTED BY APPLICANT: To locate accessory swimmingpool in a yard other than the required rear yard or required front yard on this waterfront parcel, as shown on the November 12, 1996 Chandler, Palmer & Ding site plan map at more than 100 feet from all property lines, except that the distance proposed to the bulkhead at its closest (corner) point is 85 feet (63+- feet to patio). REASONS FOR BOARD ACTION, DESCRIBED BELOW: (1) The granting of the area variance will not produce an undesirable change in character of neighborhood or a detriment to nearby properties because the location is situated at the center of the lot, it is wooded and not visable off-site. (2) The benefit sought by the applicant cannot be achieved by some method, feasible for applicant to pursue, other than an area variance because the topography of the land, and requirements of the Town 0• Page 2 - May 7, 1997 Appl. #4474 - Suzanne Cameron Schutz Southold Town Board of Appeals Trustees and the wetlands ordinance; also the land falls off on three sides from the pool - it is a hillside. (3) The requested area variance is not substantial because there is more than adequate lot area which does not affect neighboring properties. (4) The proposed variance will not have an adverse effect or imps on the physical or environmental conditions in the neighborhood or district because the N.Y.S. Department of Environmental Conservation and Town Trustees (environmental agencies) have reviewed this project. (5) The situation has not been self-created because this is a new project in the most practical location considering all circumstances relative to the property and its improvements. (6) This action is the minimum that the Board deems necessary and adequate and at the same time preserves and protects the character of the neighborhood, and the health, safety, welfare of the community. RESOLUTION/ACTION: On motion by Member Doyen, seconded by Member Dinizio, it was RESOLVED, to GRANT the relief as applied. REASON FOR APPEAL ( ) A Variance to Section 280A Subsection 3 ( X) A Variance to the Zoning Ordinance ( 1 is requested for the reason that construction of a swimming pool on the southerly side of the residence, which has been designated as the side yard area under the Zoning Ordinance of the Town of Southold, will require an area variance." REASON FOR APPEAL Continued T. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sory HARDSHIP because the Building Inspector has determined the southerly side of the existing residence is defined as a side yard area under the Zoning Ordinance of the Town of Southold. The Appellant has received approval from the Southold Town Trustees and the NYS Department of Environmental Conservation to construct a pool in this area as shown on Exhibits 4 and 5. It is submitted that allowing a swimming pool on the southerly side yard area of the residence would not produce an undesirable change in the character of the neighborhood nor will a detriment to nearby properties be created by the granting of this side yard variance. This request for aside yard variance is technical in nature becauseof the location of the house in relationship to Middle Farms.Poud and the right-of-way granting ingress and egress to the property, there will be no change, much less an adverse effect or impact on the physical or environmental conditions in the neighborhood. Due to the Building Inspector's interpretation of the side yard area under the Zoning Ordinance, and the approvals of the Southold Town Trustees and the NYS Department of Environmental Conservation, the alleged difficulty was not self-created. Since the property is 2.06+ acres and this particular side yard is approximately 210 feet, this requested variance is not substantial. The relief sought by the Appellant cannot be achieved by any other method than the granting of a side yard variance from the Zoning Board of Appeals because to locate the swimming pool in the rear yard area would be a violation of the permits of the DEC and Trustees, and to locate it in the front yard area could affect the aestheies of this property. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because as it is submitted this is the only property in this neighborhood ',where _the.position of the house creates a_"side yard" which in reality is'the�rear yard living space in relationship with Middle Farms Pond 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because this particular area is residential and the installation of a swimming pool would not affect this neighborhood as it would be built in the "side yard" area. AREA VARIANCE - Town Law Amendments 5267b-3 Effective July 1, 1992: AREA VARSAtjcE is authorization by the ZBA for the use of land in an ;Wanner which is not allowed by the dimensional or topographical requirements of the applicable zoning code regulation. 5267(1) of Town Law. The Appellant has received approval from the Southold Town Trustees and the NYS Department of Environmental Conservation to construct.a pool in this area as shown on Exhibits'4 and 5. It is submitted that allowing a swimming pool on the southerly side yard area of the residence would not produce an undesirable change in the character of the neighborhood nor will a detriment to nearby properties be created by,the granting of this side yard.variance. This request for a side yard -variance is technical in nature becaus-e.of- the location of the house in relationship to Middle Farms•.Pond and the right-of-way granting ingress and egress to the property, there will be no change, much less�an adverse effect or impact on,the physical or environmental conditions in the neighborhood. i Due to the Building Inspector's interpretation of the side yard area under the Zoning Ordinance., and the approvals ofthe Southold Town Trustees and the'NYS Department of Environmental Conservation, the alleged difficulty was not self-created. Since the property is 2.06+ acres and this particular side yard is approximately 210 feet, this requested variance is not substantial. The relief sought by the Appellant cannot be achieved by any other method than the granting of a side yard variance from the Zoning Board of Appeals because to locate the swimming pool in the rear yard area would be a violation of the permits of the DEC and Trustees, and to locate it in the front yard area could affect the aestheics of this property. 2. The permitted site or facility, including relevant records, is subject to in- spection at reasonable hours and intervals by an authorized representative of the Department of Environmental Conservation (the Department) to determine whether the permittee is complying with this permit and the ECL. Such represen- tative may order the work suspended pursuant to ECL 71-0301 and SAPA 401(3). A copy of this permit, including all referenced maps, drawings and special conditions, must be available for inspection by the Department at all times at the project site. Failure to produce a copy, of the permit upon request by a Department representative is a violation of this permit. Permit Changes and Renewals 2. The Department reserves the right to modify, suspend or revoke this permit when: a) the scope of the permitted activity is exceeded or a violation of any condition of the permit or provisions of the ECL and pertinent regula- tions is found: b) the permit was obtained by misrepresentation or failure to disclose relevant facts; c) new material information is discovered; or d), environmental conditions, relevant technology, or applicable law or regulation have materially changed since the permit was issued. . 3. The permittee must submit a separate written application to the Department for renewal, modification or transfer of this permit. Such application must include any forms, fees or supplemental information the Department requires. Any renewal, modification or transfer granted by the Department must be. in writing. 4. The permittee must submit a renewal application at least: a) 180 days before expiration of permits for State Pollutant Discharge Elimination System (SPDES), Hazardous Waste Management Facilities (HWMF), major Air Pollution Control (APC) and Solid Waste Management Facilities (SWMF); and b) 30 days before expiration of all other permit types. 5. Unless expressly provided for by the Department, issuance of this permit does not modify, supersede or rescind any order or determination perviously issued by the Department or any of the terms, conditions or requirements contained in such order or determination. Other Legal Obligations of Permittee 6. The permittee has accepted expressly, by the execution of the application, the full legal responsibility for all damages, direct or indirect, of whatever nature and by whomever suffered, arising out of the project described in this permit and has agreed to indemnify and save harmless the State from suits, actions, damages and costs of every name and description resulting from this project. 7. Any material dredged in the prosecution of the work herein permitted shall be removed evenly, without leaving large refuse piles, ridges across the bed of a waterway or floodplain or deep holes that may have a tendency to cause damage to navigable channels or to the banks of a waterway. 14. There shall be no unreasonable interference with navigation by the work herein authorized. 15 If upon the expiration or revocation of this permit, the project hereby authorized has not been completed, the applicant shall, without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore the site to its former condition. No claim shall be made against the State of New York on account of any such removal or alteration. 16. If granted under 6 NYCRR Part 608, the NYS Department of Environ- mental Conservation hereby certifies that the subject project will not contravene effluent limitations or other limitations or standards under Sections 301, 302, 303, 306 and 307 of the Clean Water Act of 1977 (PL 95-117) provided that all of the conditions listed herein are met. 17. All activities authorized by this permit must be in strict conformance with the approved plans submitted by the applicant or his agent as part of the permit application. Such approved plans were prepared by Richard Strouse cin '11/12/96, last revised _ on 12/2/96 SPECIAL CONDITIONS 1. Construction activities in the wetland/adjacent area/water body are prohibited during the period March 15 through September 15. 2. Prior 'to commencement of any construction activities, a continuous row of straw bales shall be staked end to end along the existing fence shown on the approved plans. The bales shall be maintained, repaired and replaced as often as necessary to ensure proper function, until all disturbed areas are permanently vegetated. The average useful life of a bale is approximately 3-4 months. Sediments trapped by the bales shall be removed to an approved upland location before the bales themselves are removed. 3. All fill shall consist of clean soil, sand and/or gravel that is free of the following substances: asphalt, slag, flyash, broken concrete, demolition debris, garbage, household refuse, tires, woody materials including tree or landscape debris, and metal objects. The introduction of materials toxic to aquatic life is expressly prohibited. No clearing of vegetation within 100' of pond. Any demolition debris, excess construction materials, and/or excess excavated materials shall be immediately and completely disposed of on an approved upland site more than 100 feet from any regulated freshwater wetland. These materials shall be suitably stabilized so as not to re-enter any water body, wetland, or wetland adjacent area. 5. Use of wood treated with pentachlorophenol or creosote is prohibited. Standard pressure treated dumber is treated with CCA and its use is permitted. 6. The permittee shall incorporate the following language as a notice covenant to the deed: "Regulated freshwater wetlands associated with Middle Farms Pond are located on the southern portions of the properties of Suzanne Cameron -Schutz and her heirs, assigns or successors. This property is subject to the provisions of Environmental Conservation Law (ECL). Article 24, and the conduct of regulated activities may occur only pursuant to ECL Article 24 if prior approval is given by the New York State Department of Environmental Conservation (NYSDEC) or its successor(s). Regulated activities include, but are not limited to clearing of vegetation; application of chemicals; excavation; grading and filling; and erection of any structure(s)." This deed covenant shall be recorded with the Clerk of Suffolk County within 90 days of the issuance of this permit..
