No. 4488 - LAWRENCE PEARLSTEIN PARCEL 1000-54-4-23 STREET & LOCALITY: 2225 North Sea Drive, Southold DATE OF PUBLIC HEARING: June 19, 1997 FINDINGS OF FACTS PROPERTY DESCRIPTION: This property is located in an R-40 Low -Density Residential Zone District, situate 100 feet along North Sea Drive, with 100 ft. frontage along ordinary high water mark of the Long Island Sound. This lot contains a total area of 21,000 sq. ft. The February 15, 1996 survey map shows an existing one-story, single-family dwelling set back 41 feet from North Sea Drive and set back 20 feet at the southwesterly side property line. BASIS OF APPEAL: Building Inspector's Action of Disapproval dated May 22, 1997, which reads as follows: "Being a non -conforming lot of 21,000 sq. ft. in an R-40 Zone, the proposed construction does not meet the required front yard setback of 40 feet, Article XXIV, Section 100-244B. Action required by Zoning Board of Appeals." AREA VARIANCE RELIEF REQUESTED BY APPLICANT: To locate a 20 square foot portion of proposed addition to extend with a proposed front yard setback at 37 feet and 40 feet at its closest points to the front property line along North Sea Drive and the remaining side yard setback at a minimum of 25 feet, all as shown on the site plan map prepared by Garrett Strang, R.A. dated March 12, 1997. REASONS FOR BOARD ACTION. DESCRIBED BELOW: (1) The granting of the area variance will not produce an undesirable change in character of neighborhood or a detriment to nearby properties because only a small portion of the proposed addition and deck, 20 square feet, exceeds the 40 ft. setback requirement. (2) The benefit sought by the applicant cannot be achieved by some method, feasible for applicant to pursue, other than an area variance because the applicant's house is on a somewhat diagonal line to the street and the proposed addition follows the line of the house. Page 2 - June 19, 1997 Appl. #4488: 1000-54-4-23 (Pearlstein) Southold Town Board of Appeals (3) The requested area variance is not substantial representing only a 12 percent reduction in the 40 -foot required front yard setback. (4) The proposed variance will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because the variance request is minimal. (5) The situation has not been self-created because the applicant has located the addition to comply with other agency regulations. (6) This action is the minimum that the Board deems necessary and adequate and at the same time preserves and protects the character of the neighborhood, and the health, safety, welfare of the community. RESOLUTION/ ACTION: On motion by Member Tortora, seconded by Chairman Goehringer, it was RESOLVED, to GRANT the relief as applied. VOTE OF THE BOARD: AYES: Members Doyen, Goehringer, Dinizio, Tortora, and Ostermann.
