FINDINGS (PROPERTY FACTS):
DESCRIPTION: This property is located in an R-40 Residential Zone
District, being situate on the southerly (s/e) side of Peconic Bay
Boulevard 99.58 feet of road frontage and 102.45 of frontage along
Great Peconic Bay (as bulkheaded), and lot depth of 317.9 ft along
the westerly side property line. This lot contains a total area of
approximately 31,790 sq. ft. and is improved with a 1-1/2 story
existing dwelling, two-story building in the front yard, and
accessory garage in the front yard, all as shown on the May 5, 1997
survey map.
BASIS OF APPEAL: Building Inspector's Action of Disapproval dated
March 10, 1997, which reads as follows: under Article XXIV,
Section 244-B "proposed construction will not have sufficient side
yard setback. A 15 -ft. side yard is required...."
AREA VARIANCE RELIEF REQUESTED BY APPLICANT: To locate
deck (and shower as exists) addition, all at 13 ft. at the closest
points (extending along the shower extension which exists also at 13
ft. setback) at the easterly side yard.
REASONS FOR BOARD ACTION, DESCRIBED BELOW:
(1) The granting of the area variance will not produce an
undesirable change in character of neighborhood or a detriment to
nearby properties because most lots are narrow and substandard in
width;
(2) The benefit sought by the applicant cannot be achieved by some
method, feasible for applicant to pursue, other than an area variance
because the house has existed for 90+- years with a small kitchen,
which needs enlargement. No other area is available.
(3) The relief requested is not substantial.

(4) The situation has not been self-created because of the age of
the dwelling and the establishes footprint location which lends to
the difficulties in this project.
(8) This action is the minimum that the Board deems necessary and
adequate and at the same time preserves and protects the character
of the neighborhood, and the health, safety, welfare of the
community.
RESOLUTION/ACTION: On motion by Member Dinizio, seconded by
Chairman Goehringer, it was
RESOLVED, to GRANT the relief as applied.

Dear Linda:
I have spoken to Mr. Osler regarding the location of the existing two story house
at the northern part of his property and the 5 foot (by scale) offset dimension to
the east property line as shown on the survey. Mr. Osler informs me that this
building was originally built on grade, and that sometime in the 1970's they lifted
and moved it onto a new concrete block foundation approximately 5 feet west of
its original location. The survey work was never updated, which would explain
the discrepancy of 10 foot actual and 5 foot scaled offset dimensions.
I have inspected and measured the building offset, which 'is 9'-6" to the split rail
fence along the east property line. The fence measures approximately 1 foot
west of the concrete monument at the northeast corner of the property. This
confirms the 10 foot building offset.
I have revised the Plot Plan to show the correct building. location. I hope this
helps clear up this issue.

This Notice is issued pursuant to Part 617 of t -he
implementing regulations pertaining to Article 8 of the N.Y.S.
Environmental Quality Review Act of the Environmental
Conservation Law and Local Law 744-4 of the Town of Southold.
An Environmental Assessment (Shorty Form has been
submitted; however, Section 617.13 of 'o NYCR. Part 616, and
Section 8-0113 of the Environmental Conservation Law, this
variance application falls under the Type I1 classification as
established by law. Further, this Department may not be an
involved agency under SEQRA ¢Section 617.13(a) as amended
February 14, 1990}..
Although this action is classified as Type II for this
variance application under SEQRA {specifically 617.13, 616.3(j),
and 617.2(jj)), this determination shall have no affect upon any
other agency's interest or SEQRAA determination as an involved
agency.
