Rich III, Vice Chairman Members of the Planning Board Southold gown Clerk Date: June 9, 2016 Re: Request for Comments for Change of Zone ADF Ventures SCTM#1000-48.-2-44.2 At the request of the Town Board, the Planning Board has reviewed the proposal for a Change of Zone of SCTM#1000-48.-2-44.2 in Greenport from Light Industrial (LI)to Residential 40 (R-40) and supports the request. The subject lot is currently vacant and wooded. To the north(across Corwin Street) and to the east the properties are improved with single family residences and zoned Residential 40 (R-40 and R-2 (Village of Greenport Zoning)). To the south is the Long Island Railroad, then single family residences in the R-40 Zoning District. To the west the parcel is improved and zoned Light Industrial. The lot is a small area of Light Industrial (LI) Zoning embedded within a residential neighborhood which abuts Seventh Street. The industrial zoning of the lot can be attributed to its proximity to the Long Island Railroad and historical need to have access to this transportation mode. Prior to the LI Zoning,the property was zoned C-Light Industrial Zoning and prior to that, residential use. The subject lot was created for residential use per Town Laserfiche records "Map Showing Properties of the Greenport Milling Co. at Greenport,New York" dated October 19, 1918,prepared by Halsey and Van Tuyl (Figure 1). The zoning history in Town records shown below indicates that zoning of the parcel changed from Residential to C-light Industrial in 1988. The basis of the change is unknown. Map Zoning/Use 1. 1956 Suffolk County Approved Building Zone Map Residential 2. 1957 Zoning Map Residential 3. 1971 Zoning Map Residential 4. 1988 Zoning Map C-Light Industrial 5. 1989 Zoning Map LI-Light Industrial 6. 1994 Zoning Map LI-Light Industrial The transition from residential use to C-Light Industrial,then LI did not seem justified due to the parcel size which cannot support the LI zoning district purpose or the setbacks needed to accommodate light industrial uses. The purpose of the LI district substantiates this observation stating: The purpose of the Light Industrial (H)District is to provide an opportunity for business and industrial uses on smaller lots than would be appropriate for the LIO Light Industrial Park/Planned Office Park District. i Southold'Town Planning Board Page 13 June 9, 2016 f The smaller lot size in the purpose refers to a lot with a minimum area of 40,000 square feet (decrease from 120,000 square feet in the Light Industrial Office zoning district). The parcel equals 9,541 square feet in size and is substantially less than the required minimum lot size for both the R-40 and the LI zoning districts. Nevertheless, the lot is a single and separate lot. Impacts on the Neighborhood Unit The Planning Board recognizes that when the parcels were zoned for industrial uses, the railroad was an available transportation mode to move supplies and goods to and from the location. Accessibility to the railroad is not achievable today. Rather,the transport of supplies and goods are through local (collector streets) via vehicles. The impacts to the neighborhood from vehicle trips are a concern with any future light industrial use that could locate on the parcel. Similarly,the significant setback variances necessary for a light industrial use were not contemplated when the lot was created. The Planning Board is concerned about the impact to the community character from a proposed light industrial use in the zoning district. The adjacent buildout of SCTM#1000-48-2-44.3 (East End Marine/Lewis Marine)to the west of the lot is intense and received six (1537, 3013, 3014, 3080 4154, 5109) Zoning Board of Appeals decisions. In 1982 testimony indicates that the building and portions of this lot were used for a grain, coal, and oil distributing plant. The western portion of the property contained four residential dwelling units prior to redevelopment. In 2002 a Site Plan for Lewis Marine Supply was approved by the Planning Board that complied with the ZBA variances. Development of this parcel forced encroachments of the landscaped,parking islands intolhe Town's right-of- way. The Lewis Marine Supply/East End Marine site, at 1.5 acres, signifies that the area necessary to conduct light industrial uses is deficient on this parcel due to size and configuration and that the variances issued have resulted in intense build out of the lots; discordant with the neighboring, residential uses. The continuance of this development pattern onto a lot(the subject parcel)that is six times smaller does not meet Town goals to preserve the quality of life of area residents. Changing the zone on SCTM#1000-48.-2-44.2 from LI to R-40 (Residential Use) for the subject parcel is more conforming with the character of the neighborhood and removes the potential impacts associated with LI uses. Due to the proximity of residential uses to the parcel,the neighborhood character, street design and the small size of the parcel,the Planning Board supports the change of zone. Note that the residential structure, as proposed, may need to apply for variances. Thank you for this opportunity to review the action, and please feel free to call this office with any questions. I have a memorandum from the Planning Office, at the request of the Town Board, the Planning Board has reviewed the request for a change of zone for SCTM # 1000-48.- 2-44.2 in Greenport from LI to R-40 and they support the request. I have a letter here from the Suffolk County Department of Economic Development and Planning, signed by the chief planner, Andrew Freleng, that there is, determining that there is no apparent significant county- wide or inter-community impact. A decision of local determination should not be construed as either an approval or disapproval. I also have from the Planning Board, the state environmental quality review, a negative declaration, also a determination of non-significance. The purpose of the LI district substantiates this observation stating The purpose of the Light Industrial (LI) District is to provide an opportunity for business and industrial uses on smaller lots than would be appropriate for the LIO Light Industrial Park/Planned Office Park District. The smaller lot size in the purpose refers to a lot with a minimum area of 40,000 square feet (decrease from 120,000 square feet in the Light Industrial Office zoning district). The parcel equals 9,541 sq. ft. in size and is substantially less than the required minimum lot size for both the R-40 and the LI zoning districts. Nevertheless, the lot is a single and separate lot. Similarly, the significant setback variances necessary for a light industrial use were not contemplated when the lot was created. Due to the setback requirements, the adjacent buildout of SCTM #1000- 48-2-44.3 (East End Marine/Lewis Marine) to the west of the lot is intense and received six (1537, 3013, 3014, 3080 4154, 5109) Zoning Board of Appeals decisions. The small lot size of 9,541 square feet is not able to accommodate the significant LI setbacks. No adverse impact on land is expected to occur as a result of the action. Impact of Water 1. Water Supply Public water is available to future development of the parcel. Water consumption will be assessed to future development proposals. 2. Sanitary Disposal Future development will be required to install an on-site sub-surface sanitary system. The petitioners file includes a 4 bedroom single family residence site plan. In 1978, the Long Island Regional Planning Board published the Long Island Comprehensive Waste Treatment Management Plan (208 Study). The 208 Study identified eight (8) Hydrogeologic Zones in Nassau and Suffolk Counties. These zones were distinguished based upon differences in underlying groundwater flow patterns and water quality. The subject site is located within SCDHS Groundwater Management Zone IV, which according to Article VI of the Suffolk County Sanitary Code, has an allowable flow of 600 gallons per day (gpd) per acre in areas served by public water. The allowable flow for the overall .22 acre site is 132 gpd. Any proposed future development would be required to meet the maximum allowable flow permitted. 3. Ground or Surface Water Quality or Quantity No moderate to large impacts to ground water quality or quantity is expected to occur. No freshwater wetlands or marine wetlands are located on the property. SEQRA Negative Declaration 5— July 12. 2016 4. Flooding The parcel is not located within a mapped FEMA Flood Zone. No impact to floodways is expected to occur. Impact on Air No substantial adverse change in existing air quality is expected to occur. Due to size of the parcel and location between Corwin Boulevard and the Long Island Rail Road easement and tracks, the presence of animals is expected to be low, therefore, the potential occurrence of rare or threatened plants or animals on site or within the vicinity of the site is also low. No significant removal or destruction of large quantities of vegetation will occur as a result of this action. Correspondingly, no substantial interference with the movement of any resident or migratory fish or wildlife species nor impacts on a significant habitat area will occur as a result of this action. Impact on Agricultural Land Resources SEQRA Negative Declaration - Page 16—July 12, 2016 The parcel is not currently in agricultural production, therefore, no adverse impacts to agricultural lands or soils will occur, Impact on Aesthetic Resources The parcel is located in an existing neighborhood of single family dwellings to the north, east and south. A LI zoned property improved with warehouses is located to the west. Due to the parcel size the future build out is restricted and is expected to be consistent with residential neighborhood architecture. No substantial adverse impacts to aesthetic resources are expected to occur. Impact on Historical and Archeological Resources The parcel is not included within the Arch eo-sensitive Area (MAPINFO GIS -Arch eo-sensitive Layer), however, due to past site improvements; the parcel is improved with three buildings, sanitary systems. The parcel is not SPLIA listed. The action will not impact important historical or archaeological resources. Impact on Open S ace and Recreation No significant impacts to public open space or recreational areas will occur as a result of this action. Impact on Critical Areas The proposed action is not located within a New York Department of Environmental Conservation Critical Environmental Area. The proposed local law has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided to this department as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the LWRP Policy Standards and therefore is CONSISTENT with the LWRP. This determination is based on the following: The subject lot was legally created for residential use per Town Laserfiche records"Map Showing Properties of the Greenport Milling Co. at Greenport, New York" dated October 19, 1918. The action furthers Policy 1. Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development. The proposed change of zone on SCTM#1000-48.-2-44.2 from Light Industrial (LI) to R-40 (Residential Use) fosters a pattern of development that enhances the community character of the neighborhood by removing the potential impacts associated with future LI uses on the parcel. The proposal would also minimizes adverse effects on development by acknowledging the proximity of residential uses to the parcel, the neighborhood character, narrow street design that surrounds the parcel not designed for large, high volume vehicle use, the small size of the parcel (9,541 sq. ft.) and the significant setback requirements of the LI zoning district(that cannot be met) in this instance. Pursuant to Chapter 268, the Town Board shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. The subject lot is currently vacant and wooded. To the north(across Corwin Street) and to the east the properties are improved with single family residences and zoned Residential 40 (R-40 and R-2 (Village of Greenport Zoning)). To the south is the Long Island Railroad,then single family residences in the R-40 Zoning District. To the west the parcel is improved and zoned Light Industrial. The lot is a small area of Light Industrial (LI) Zoning embedded within a residential neighborhood which abuts Seventh Street. The industrial zoning of the lot can be attributed to its proximity to the Long Island Railroad and historical need to have access to this transportation mode. Prior to the LI Zoning, the property was zoned C-Light Industrial Zoning and prior to that, residential use. The subject lot was created for residential use per Town Laserfiche records "Map Showing Properties of the Greenport Milling Co. at Greenport,New York" dated October 19, 1918,prepared by Halsey and Van Tuyl (Figure 1). The lot is comprised of Lots 50 and 51 in the subdivision(circle). The purpose of the LI district substantiates this observation stating: The purpose of the Light Industrial (LI) District is to provide an opportunity for business and industrial uses on smaller lots than would be appropriate for the LIO Light Industrial Park/Planned Office Park District. Southold Town Planning Board a c, � 3 June 9, 2016 The smaller lot size in the purpose refers to a lot with a minimum area of 40,000 square feet (decrease from 120,000 square feet in the Light Industrial Office zoning district). The parcel equals 9,541 square feet in size and is substantially less than the required minimum lot size for both the R-40 and the LI zoning districts. Nevertheless, the lot is a single and separate lot. Impacts on the Neighborhood Unit The Planning Board recognizes that when the parcels were zoned for industrial uses, the railroad was an available transportation mode to move supplies and goods to and from the location. Accessibility to the railroad is not achievable today. Rather,the transport of supplies and goods are through local (collector streets) via vehicles. The impacts to the neighborhood from vehicle trips are a concern with any future light industrial use that could locate on the parcel. Similarly, the significant setback variances necessary for a light industrial use were not contemplated when the lot was created. The Planning Board is concerned about the impact to the community character from a proposed light industrial use in the zoning district. The adjacent buildout of SCTM#1000-48-2-44.3 (East End Marine/Lewis Marine)to the west of the lot is intense and received six (1537, 3013, 3014, 3080 4154, 5109) Zoning Board of Appeals decisions. In 1982 testimony indicates that the building and portions of this lot were used for a grain, coal, and oil distributing plant. The western portion of the property contained four residential dwelling units prior to redevelopment. In 2002 a Site Plan for Lewis Marine Supply was approved by the Planning Board that complied with the ZBA variances. Development of this parcel forced encroachments of the landscaped, parking islands into the Town's right-of- way. The Lewis Marine Supply/East End Marine site, at 1.5 acres, signifies that the area necessary to conduct light industrial uses is deficient on this parcel due to size and configuration and that the variances issued have resulted in intense build out of the lots; discordant with the neighboring, residential uses. The continuance of this development pattern onto a lot(the subject parcel)that is six times smaller does not meet Town goals to preserve the quality of life of area residents. Changing the zone on SCTM#1000-48.-2-44.2 from LI to R-40 (Residential Use) for the subject parcel is more conforming with the character of the neighborhood and removes the potential impacts associated with LI uses. Due to the proximity of residential uses to the parcel, the neighborhood character, street design and the small size of the parcel, the Planning Board supports the change of zone. The application is nearly complete, however, a crucial element is missing from the plan. The surrounding zoning districts are not shown, nor is the proposed new zone shown on the plan. The zoning district boundaries and the proposed new zoning district boundary must be shown on the 500' Radius Area Map. This map incorrectly states that the sqbject parcel is surrounded by residential zoning. The parcel adjacent is in the Light Industrial Zone. To the north(across Corwin Street) and to the east the properties are improved with single family residences and zoned Residential 40 (R-40 and R-2 (Village of Greenport Zoning)). To the south is the Long Island Railroad, then single family residences in the R-40 zoning district. To the west the parcel is improved and zoned Light Industrial. The lot is located within a small area of Light Industrial (LI) zoning embedded within a residential neighborhood. The industrial zoning of the lot can be attributed to its proximity to the Long Island Railroad and historical need to have access to this transportation mode.
