That the said Board of Trustees and-the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant-to this permit, and the said Permittee will,at his or her own expense, defend any and all such suits initiated by third parties,and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized,or if,in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation,the said Permittee,will be required,upon due notice,to remove or alter this work project herein stated without expenses,to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit,which may be subject to revoke upon failure to obtain same. 10. No right to trespass or interfere with riparian rights. McGUIRE REVOCABLE TRUST 1675 WELLS ROAD, PECONIC SCTM# 1000-86-2-1.4 Dear Mr. Herrmann: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, December 16, 2015 regarding the above matter: WHEREAS, En-Consultants on behalf of EILEEN T. McGUIRE REVOCABLE TRUST applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated November 16, 2015, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed'application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Polices 6.3 and 9.3 of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: that a vessel no longer than 20 ft. in length be permitted at the dock, which reduces the likelihood of a vessel with a head, a smaller vessel reduces the likelihood of damage to underwater lands, the total dock length including vessel does not exceed one-third of the total width of the water body, and the project meets the requirements of the U.S. Army Corps.of Engineers; and 2 -� WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on December 16, 2015, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees approve the application of EILEEN T. McGUIRE REVOCABLE TRUST to construct an elevated fixed timber dock, using open-grate decking consisting of a 4'x100' fixed timber catwalk that includes a 4'x12' fixed ramp at,landward end, and a 4'x12' fixed "T" section with a ladder attached to seaward end of catwalk for an overall length of 104'; and to clear and maintain a 4' wide access path from road to proposed dock; and with the condition that a vessel no longer than 20' in length will be permitted at said dock; and as depicted on the site plan prepared by En-Consultants dated November 12, 2015, and stamped approved on December 16, 2015. Permit to construct and complete project will expire two years from the date the permit is signed. McGUIRE REVOCABLE TRUST requests a Wetland Permit to construct an elevated fixed timber dock, using open-grate decking consisting of a 4'x100' fixed timber catwalk that includes a 4'x12' fixed ramp at landward end, and a 4'x12' fixed "T" section with a ladder attached to seaward end of catwalk for an overall length of 104'; and to clear and maintain a 4' wide access path from road to proposed dock. SCTM# 1000-86-2-1.4 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my determination that the proposed actions are INCONSISTENT with the below listed LWRP policy and therefore are INCONSISTENT with the LWRP: 6.3 Protect and restore tidal and freshwater wetlands. The applicant has not demonstrated that the following dock standards pursuant to § 275-11. Construction and operation standards have been met. (d) Review and approval of dock applications. Before issuing a permit for a dock structure, the Trustees shall consider whether the dock will have any of the following harmful effects: [1] Whether the dock will impair navigation or be located in areas of high vessel traffic or vessel congestion; The proposed dock extension would extend into the public and impede access of the public along the nearshore of the waterbody. The propose dock extends seaward of the parcel boundary. Alternatives such as a seasonal mooring in areas with adequate water depth is a better option. Another alternative would be a small catwalk over marsh vegetation to the waters edge to gain access to public waters. Further the proposal may not meet Chapter 275 standards which state: In determining the permitted length of a proposed residential dock, the Board shall seek to maintain lengths consistent with the other docks(i.e.,pier line) in the waterway. It is unknown if the proposed dock would conform to the existing "pier line". An analysis of existing, adjacent dock lengths in relation to the proposed dock has not been provided. [2] Whether the dock will unduly interfere with the public use of waterways for swimming, boating, fishing, shellfishing, waterskiing and other water-dependent activities; ,Permanent, private dock structures extending into public waters decreases the public use of bottomlands and the nearshore area. (5] Whether the dock will cause degradation of surface water quality and natural resources; Richmond Creek is a New York State Significant Coastal Fish and Wildlife Habitat and New York State Department of Environmental Conversation Critical Environmental Area. Waterfowl species observed overwintering in the Richmond Creek area include Canada goose, American black duck, mallard, oldsquaw, bufflehead, red-breasted merganser, surf scoter, and common goldeneye. Richmond Creek is also a productive habitat for finfish, shellfish and crustaceans, including blue claw crabs, clams and scallops. The creek is one of the top two creeks for crabbing in the Town and is also important for clamming (NYSDEC). Crabbing occurs along the nearshore area where the dock is proposed. (11] Whether the cumulative impacts of a residential and commercial dock will change the waterway or the environment and whether alternate design, construction, and location of the dock will minimize cumulative impacts, and Any activity that would substantially degrade the water quality of Richmond Creek would adversely affect the biological productivity of this area. All species of fish and wildlife are affected by water pollution, such as chemical contamination (including food chain effects as a result of bioaccumulation), oil spills, sedimentation, excessive turbidity, stormwater runoff, ;and waste disposal (including boat wastes). The vessel type and whether there is a head located on the vessel is unknown. �, The alternative use of seasonal moorings in areas of low biological productivity and with adequate water depths is a better option to accommodate vessels requiring greater water depths. [12] Whether adequate facilities are available to boat owners and/or operators for fueling, discharge of waste and rubbish, electrical service and water service. See concerns above. 9.3 Preserve the public interest in and use of lands and waters held in public trust by the state and the Town of Southold. A. In order to mitigate any potential impact of the project on the adjacent tidal wetland area and Town waters,the proposed dock structure would be constructed entirely with open-grate decking and 4"x 4"posts over the vegetated marsh;would be elevated a minimum of 3.5'above the grade of intertidal marsh;and has been designed with the minimal scope necessary to reach a useable water depth of 18 inches at mean lower low water. As such,the dock would extend seaward of mean lower low water well less than one-third the width of the waterway at mean low tide(40 feet or 10%)and would thus have no impact whatsoever on navigation or other public and recreational use of Richmond Creek;and further consistent with§275-11(C)(2),the dock would be located no closer than 15 feet from the extended property line. Overall,the proposal is consistent in nature with various other fixed dockage structures the Board has approved on Richmond Creek. Without such a structure,the same location on the site could still be used for access,but watercraft would have to be dragged through the marsh,which together with the associated foot traffic would create the potential for loss of wetland vegetation along the shoreline. In order to mitigate any potential impact of the project on the adjacent tidal wetland area and Town waters,the proposed dock structure would be constructed entirely with open-grate decking and 4"x 4"posts over the vegetated marsh;would be elevated a minimum of 3.5' above the grade of intertidal marsh; and has been designed with the minimal scope necessary to reach a useable water depth of 18 inches at mean lower low water. As such,the dock would extend seaward of mean lower low water well less than one-third the width of the waterway at mean low tide(40 feet or 10%)and would thus have no impact whatsoever on navigation or other public and recreational use of Richmond Creek; and further consistent with §275-11(C)(2),the dock would be located no closer than 15 feet from the extended property line. Overall,the proposal is consistent in nature with various other fixed dockage structures the Board has approved on Richmond Creek. For all of these reasons,the dock would be consistent with the rules and regulations of the Town Wetlands Law, Chapter 275, and the New York State Tidal Wetlands Act,Article 25; and would not cause a"fragmentation of ecological communities,"result in the physical loss, degradation, or functional loss of ecological components, or otherwise adversely impact the adjacent wetland ecosystem.
