No. 4,193 - ANDREW and BERNICE LETTIERI PARCEL 1000-98-2-12.1 (combined 11 & 12, former lot numbers) Also referred to as lot numbers 29 and 30 on the Map of Arrowhead Cove filed with the County Clerk as Map No. 3810. STREET & LOCALITY: 1720 Arrowhead Lane, Peconic DATE OF PUBLIC BEARING: July 10, 1997 PROPERTY FACTS: DESCRIPTION: This property is a conforming lot located in an R-40 Zone District, being situate on the westerly side of Arrowhead Lane, Peconic. This lot contains a total area of 40,800 square feet, 255 ft. road frontage, and lot depth of 160 feet. BASIS OF APPEAL: Building Inspector's Action of Disapproval dated June 2, 1997 which reads as follows: under Article IIIA, Section 100-30A.3 of the Bulk and Parking Schedule in an R-40 Zone the proposed construction at 38 ft. 4 inches will have insufficient rear yard set back. The required rear yard setback is 50 ft. minimum. AREA VARIANCE RELIEF REQUESTED BY APPLICANT: To reduce rear yard setbacks relative to two sections of the proposed new dwelling to 38'4" from the rear of the house to the westerly property line at the southwesterly end and approximately 47 feet at the northwesterly end of the proposed dwelling as shown on House Plan No. 181OF dated 4/25/97 (preliminary date of 4/1/97) prepared for applicants by George H. Fisher. Also submitted for consideration is a survey amended October 8, 1997 prepared by Roderick VanTuyl, P. C. The proposed front yard setback is shown at 50 feet. REASONS FOR BOARD ACTION. DESCRIBED BELOW: (1) The granting of the area variance will not produce an undesirable chango in character of neighborhood or a detriment to nearby properties because the rear yard or westerly side abuts a vineyard which has a buffer zone of a wire fence and two rows of trees measuring approximately 20 ft. wide. The southerly and northerly setbacks exceed the minimum requirement of 35 feet. The front setback meets the 50 ft. requirement. L - Page 2 - July 10, 1997 Appl. #4493: 1000-98-2-12.1 (Lettieri) Southold Town Board of Appeals (2) The benefit sought by the applicant can be achieved by some method, feasible for applicant to pursue, other than an area variance, however, it would entail considerable revision in the proposed House Plan and would not produce the desired results for the applicants. (3) The requested area variance is not substantial. (4) The proposed variance will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because the proposed house Plan in relation to size of lot precludes any interference with neighboring properties. (5) The situation has been self-created. (6) This action is the minimum that the Board deems necessary and adequate and at the same time preserve and protect the character of the neighborhood, and the health, safety, welfare of the community. RESOLUTION/ACTION: On motion by Member Ostermann, seconded by Chairman Goehringer, it was RESOLVED, to GRANT the relief as applied. The new Statute no longer includes the term "practical difficulty" or -any particular test, and now provides that ZBAs consider two basic things: 1. the benefit -to the applicant if the variance is granted; and 2. the detriment to the health, safety and general welfare of the neighborhood or community that would occur if the variance were to be granted. In balancing the interests above, ZBAs must also consider the following five factors for an AREA VARIANCE: 1. whether an undesirable change will be produced in the character of the neighborhood or a detriment to nearby properties, if granted; 2. whether the benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an- area variance; 3. whether the area variance is substantial; 4. whether the variance will have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district; and 5. whether the alleged difficulty was self-created, which consideration shall be relevant to the MA's decision but -shall not preclud4'the granting of an area variance.
