DESCRIPTION: Property is located in an R-40 District. The lot is
situated on the south side of New Suffolk Avenue with water
frontage on Deep Hole Creek. It contains a nonconforming lot area
of 6,776 sq. ft. and is improved with a single-family dwelling,
attached deck, and a shed.
BASIS OF APPEAL: Notice of Disapproval issued by the Building
Inspector dated Januray 3, 1997, which reads as follows: under
Article IIIA, Section 100-30A.3 "proposed construction will exceed
the 20 percent lot coverage of all structures in a R-40 Zone."
Existing lot coverage is 21 percent and the proposed addition will
increase the total lot coverago to 24 percent (see map drawing
submitted for consideration).
RELIEF REQUESTED: To convert first floor bedroom into a one -care
garage by construction of a two-story 200 square -foot addition to the
existing structure on the easterly side, according to site plan
prepared by Donald G. Feiler, Architect dated 11/25/96 and 8/7/96.
(Note: The ZBA staff has eliecked with Town Trustees office
2/27/97 as requested by Member Tortora, and it is noted that
applicant's proposed addition and property was inspected by the
Town Trustees under the wetlands ordinance and is expected to be a
non -jurisdiction project) .
REASONS/ FINDINGS FOR APPROVAL:
This is a nonconforming lot with total rea of 6,776 sq. ft.
Existing lot coverage if 210.
Proposed addition will increase lot coverage to 240.
Grant of variance will not produce undesirable change in character
of neighborhood which consists of many similar -sized lots.
Benefit cannot be achieved without a variance because of
nonconforming lot size, as well as width and depth. The proposed
location of the addition is reasonable.
Relief requested is not substantial, approximately three percent
(30), when weighed against the limited size of the property.
The garage addition will provide for offstreet parking of vehicles.

No adverse effect will result from the proposed construction, which
was recently inspected by the Southold Town Trustees and
determined out of their jurisdiction.
On motion by Member Villa, seconded by Member Tortora, it was
RESOLVED, to GRANT the relief requested under Appl. #4457 with
the FOLLOWING CONDITION: The proposed addition shall not be
protrude into the front yard area.

CHAIRMAN: I have a copy of a sketch of a survey indicating the house
in its present position, existing deck, two retaining walls - actually
one bulkhead and one retaining wall. The sketched in area, which is
basically crosshatched, indicates the proposed addition which will exceed
the lot coverage at approximately 24%. Mr. Feiler, how are you tonight,
sir? It's such a pleasure to see you again.
MR. FEILER (Architect) : I'm Don Feiler - I'm an architect from
Mattituck. I'm here with Mr. And Mrs.' Minoque to talk about their
proposed addition. It's a plan for an existing house. They're hoping to
square off an irregular L shape and add a. new second floor. The set
back existing on the east side is about 25 feet and the new addition
would bring our set back to 22 feet - 15 in the side yard.' We're not
getting any closer to New Suffolk Avenue. The existing house is 1,070
square feet and that's 210 lot coverage or in addition 200 square feet to
the first floor. That would be 240 lot coverage. The existing house,
one-story with two bedrooms in the front. of the house, one of the
bedrooms we're going to convert to a garage and that's going to allow us
to get parking a little bit further away from New Suffolk Avenue. We're
also going to be able to get the front door on the front of the house
facing New Suffolk Avenue, set lback from the middle of the house on
the side. We're also adding a second floor which will be the same size as
the first floor. It's actually a little bit bigger than the first floor,
overhanging the front porch. It's a covered entry area.
CHAIRMAN: Very good.
MR. FEILER (Architect) : It's not a substantial addition. It doesn't seem
to have an adverse impact on the neighborhood. The Town Trustees
have already approved the proposed project. It's a small addition. It's a
small house. Unfortunately, it's a small lot. That's why we're here.
CHAIRMAN: Having been a resident of Mattituck since about 1948, I am
perfectly aware that this house has been around for many, many, many
years. These people have done a bang-up job in fixing it. up. It really
looks very nice. I don't have any particular objection to this
application. We'll now go to Mr. Villa.

MEMBER VILLA: There's going to be an over -hang on the front of it?
MR. FEILER (Architect): The plot plan shows what is, in effect, the
second floor and the first floor would be smaller than that so at the
front the entry door will be set back about 4 feet.
MEMBER VILLA: 13 feet is showing the over -hang that you are
proposing?
MR. FEILER (Architect) : 13 feet is on the western part of the corner so
it's a little bit further than that - probably 15 feet or so. It's not
closer than the 13 feet. There's no projection from the house. The
second floor will be straight across as 'the straight line shows on the
front of the house. :
MEMBER VILLA: Right.
MR. FEILER (Architect) : The entry is recessed from that straight line.
MEMBER .VILLA: Thirteen feet is going to be the line?
MR. FEILER (Architect) : That's existing.
MEMBER VILLA: Yes, that's existing. It's not going to be infringed on?
MR. FEILER (Architect) : No.
