The subject property consists of 3.656 development rights intact acres and 22.4 development right sold acres. The property is improved with a winery tasting room, a storage building and a trailer for farm labor housing. All shown on the site plan dated July 16, 2015 prepared by Samuels and Steelman,Architects. BASIS OF APPLICATION: This is a,request pursuant to Section 280-146(D) seeking an Interpretation of whether Old North Road is a"major road"as contemplated in Town Code,Article III, Section 280- 13(A)(4)(c), which states that"winery structures shall be setback a minimum of 100 feet from a major road" [emphasis added]. RELIEF REQUESTED: The applicant requests that the ZBA make a determination that Old North Road is not a major road and therefore the setback should be the one required for principal buildings located in the AC Zone district, rather than 100 ft. as required in Section 280-13(A)(4)(c). The applicant maintains - that Old North Road is not a major road, but a mere secondary road. There is no definition for major road in the Code under,280 Zoning, Article I 280-4, entitled definitions. ADDITIONAL INFORMATION: Comments were requested from the Planning Board and in a memo dated November 30, 2015 the Planning Board stated they have no comment on the action. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on December 3,2015, at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: - - Page 2 of 3—January 7,2016 ZBA#6903—Old North Road Barn,LLC SCTM#1000-51-3-5 1. Definitions and Usages Article I, Chapter 280-4B.The term"MAJOR ROAD" is not defined in the Zoning Code,nor the Southold Town code generally.Pursuant to code section 280-4(B) any word or term not noted...shall be used with a meaning as defined in Webster's Third New International Dictionary of the English Language,unabridged(or latest edition). The Board found that the term"MAJOR ROAD" is not defined in the dictionary. The most related terms defined in the dictionary are 1. "ROAD, a long narrow stretch with a smoothed or paved surface, made for traveling by motor vehicle..."2. "STREET, a public thoroughfare, usually paved, in a village,town or city including the sidewalks", and 3. "MAJOR", prominent or significant in size or degree." 2. Review of the public hearing minutes on Town Law 13(A)(4)Wineries Use Regulations.In an attempt to discern the original intent of the Southold Town Board in adopting the current winery use regulations, specifically Section 13(A) (4)(c) "winery structures shall be set back a minimum of 100 feet from a major road,"the ZBA reviewed the transcript of the original public hearing prior to adoption of this code by the Southold Town Board.The comments were general and no specific intent could be determined as to why the 100 foot setback was established or how a major road was to be defined. 3. Review of relevant sections of the Southold Town Code.The Board reviewed past and current definitions within the town code submitted by the applicant's agent and researched by ZBA staff at the Board's request. Under the existing code,within the definitional section(240-3) of Chapter 240, entitled Subdivision of Land,the definition of a MAJOR ROAD is not included. However, the definition of the term STREET,ARTERIAL is relevant to this code interpretation.A STREET,ARTERIAL is defined as"A main street or highway carrying a high proportion of the traffic within the Town of Southold, and including State Route 25 and County Route 48."Also relevant are the definitions of STREET, COLLECTOR: "A street or highway which serves or is intended to serve as a major collector road within the Town and which provides access to State Road 25 and County Route 48 from local streets;"and STREET, LOCAL: "A local street or road which serves or is intended to serve as the primary means within neighborhoods and subdivisions and which is the main means of access to a collector or arterial."Additionally, under the prior zoning code of 1987, Subdivision of Land, Section A106-13, STREET,MAJOR was defined as: "A street or highway of great continuity which serves or is intended to serve as a major traffic artery within the town or county, or both, and is designated on the Town Plan as a main arterial highway, major thoroughfare, parkway or other equivalent term to identify those streets comprising the basic structure of the street plan." RESOLUTION OF THE BOARD: In considering all of the above factors motion was offered by Member Weisman(Chairperson), seconded by Member Goehringer, and duly carried,to Determine that: 1. there exists only two "Major Roads" within the Town of Southold, namely County Road 48 (AKA the North Road/Sound Avenue), and State Road 25 (AKA Main Road) 2. Old North Road is not a major road. It falls under the current code definition of"Street, Local" within the definitional section(240-3) of Chapter 240 3. Winery structures, located on properties which do not adjoin a Major Road, shall be set back at the principal front yard setback as cited in the applicable bulk schedule. NOTE: The Building Department's Notice of Disapproval states that site plan approval is required by the Planning Board for this application. If Old North Road is not deemed a major road, then a variance is not necessary and the applicant may proceed directly to site plan review. Section 280-13A(4)(c) requires that a winery be set back 100 feet from a"major road". "Major road" is not defined in the Town Code. Therefore, a reasonable interpretation based on colloquial usage and other sources must prevail. Testimony will be presented at the hearing that "locals", which is also not defined in the Code but to which the meaning of having lived in Southold Town for the greater part of one's life is ascribed, have always understood the term "major road" as referring to Co Rt. 48 (formerly Middle Road) and NYS Route 25. These are the thoroughfares that get travelers from one part of town to the other and in and out of Southold Town. With the possible exception of Sound Avenue, the Town roads, including Old North Road, are local roads which handle local traffic and do not rise to the level of"major roads". They service the neighborhoods of the Town. They do not service the entire town as do Co Rt. 48 and NYS Rt. 25. The Town Clerk's website, on the Street Maintenance link, shows Rts. 48 and 25 as the OD` primary roads. The town roads are all shown separately and less prominently. Two truck routes of NY 25 also exist. • County Route 48 (Suffolk County,New York) is a major west-east county road between Mattituck and north of Greenport. The NYSDOT once planned to upgrade the road into part of the Long Island Expressway. • Sound Avenue was a former segment of New York State Route 25A, which is unmarked, but still serves as an important thoroughfare from Wading River along the north shore into Mattituck. The Google Map site generates a map which shows only Rt. 25 and Rt. 48 highlighted when you search for Town Clerk, Zoning Board of Appeals, and other town offices. Once you start picking and choosing Town roads and side streets as `major roads", it becomes very difficult to decide which of them might be "major" as opposed to not major. The only obvious exception, Sound Avenue to the west of Ct. Rt. 48, is a continuation of a significant thoroughfare to get in and out of Southold Town as it connects directly to Co. Rt. 48 and 25A, and was formerly part of NYS Rte. 25A. The subject section of Old North Road is a very low traffic area with access only to residential/AC zoned property. Sound Avenue in Mattituck running from the westerly terminus of Route 48 to the Riverhead Town line, it the only Town Road which would also qualify as a"major road", and was at one time part of NYS Rte. 25A. i How often have we all heard the expression that we are in much better shape than the South Fork because we have "two major roads" on the North Fork? While the definitional sections of the Town Code provide little assistance, the fact that a winery must be set back further than the applicable front yard setback under the Bulk Schedule on"major roads" should indicate that this was intended to recognize a special type of road, and not many roads which may or may not be considered "major", putting the Town in a very subjective area in interpreting that provision. Therefore, request is made that the Zoning Board of Appeals reverse the Building Inspector's notice of disapproval as it pertains to the application of the term "major road"to this application, and interpret the term as not applicable to Old North Road.
