HomeMy WebLinkAboutLP-11/24/2015 LAND PRESERVATION COMMITTEE MEETING Minutes & Discussion Notes from Meeting held Tuesday, November 24, 2015 at 7:00 p.m. Town Hall Annex Executive Board Room Members Present: Anne Murray Sam McCullough Peggy Dickerson Maureen Cullinane Lillian Ball Eric Keil Members Absent: John Sepenoski, Chairman Also present: Melissa Spiro, Land Preservation Coordinator Melanie Doroski, Land Preservation Secretary Bob Ghosio, Town Board Liaison Luke McKay, PLT Project Manager Commencement:  The meeting began at 7:06 p.m. with six LPC members present. Adoption of Meeting Minutes:  Acceptance of LPC meeting minutes from November 10, 2015. MOTION made by Sam McCullough, seconded by Erik Keil, to accept the 11/10/2015 LPC meeting minutes. Motion carried: 4/0/2 (LPC members Maureen Cullinane & Anne Murray abstained as they were not present for the 11/10/2015 LPC meeting. Land Preservation Applications and Inquiries:  SCTM #1000-73.-1-1 and 73.-2-4 (THE VINES) Update re: status of purchase offer Land Preservation Coordinator Melissa Spiro spoke with Town Board during its executive session concerning status of purchase offer and contract details. Town Board favorable to moving forward with project. Mary C. Wilson, Esq. will be handling this project due to LPC Special Counsel Lisa Kombrink’s firm’s conflict of interest with landowner. Mary Wilson suggested several changes that landowner’s agent found unacceptable. Melissa reviewed suggested changes with LPC. MOTION made by Eric Keil, seconded by Anne Murray, to agree to The Vines proposed 15 months from landowner’s signing on offer commitment letter timeframe to complete project. Motion carried: 6/0  SCTM #1000-14.-2-29.2, 29.3 & 29.4 and 19.-2-2, 3 & 12.2 (ORIENT POINT LLC aka Pappas/Vasilas) Update re: status of purchase offer Land Preservation Coordinator Melissa Spiro, together with Planning staff Mark Terry and Aly Sabatino, met with one of the landowners, Peter Vasilas, regarding a proposed conservation subdivision and sale of development rights easement to the Town. Melissa Spiro will order appraisal as directed by LPC motion approved at 11/10/2015 LPC meeting after meeting again with Peter Vasilas to review project.  SCTM #1000-59.-3-28.5 (PINDAR VINEYARDS, LLC / Southold) Review of PDR application Land Preservation Coordinator Melissa Spiro met with Alex Damianos on 11/20/2015 regarding a proposed sale of a development rights easement to the Town on property owned by Pindar Vineyards, LLC (SCTM #1000-59.-3-28.5), reserving a 2.5 acre area in the southeast corner. LPC application was submitted by Alex Damianos, as managing agent for Pindar Vineyards, LLC. MOTION made by Sam McCullough, seconded by Eric Keil, to direct Land Preservation Coordinator Melissa Spiro to commission an appraisal for the value of a development rights easement on property owned by Pindar Vineyards, LLC (SCTM #1000-59.-3-28.5) provided confirmation is received that Alex Damianos has the authority to negotiate a sale of a development rights easement for the corporation. Motion carried: 6/0  PROJECT STATUS UPDATES \[executive session where applicable\] EXECUTIVE SESSION. The LPC members entered into Land Preservation Coordinator Melissa Spiro presented status updates on new and pending projects. END OF EXECUTIVE SESSION SCTM #1000-69.-1-8 (ZEBROSKI) Status report Land Preservation Coordinator Melissa Spiro and Peconic Land Trust Vice President Timothy Caufield met with landowner Bill Zebroski on 11/20/2015 to discuss a possible sale of a development rights easement to the Town. Applications & Inquiries for Uses or Structures on Preserved Property None Stewardship and Management:  STEWARDSHIP UPDATE FROM MELISSA SPIRO SCTM #1000-45.-5-3.2 (SILL PROPERTY – Pipes Cove area) Status of Life Estate Julia L. Sill passed away on November 14, 2015 at the age of 105. Her subsequent death terminates a Life Estate she reserved upon her property that she sold and conveyed to the Town of Southold for open space purposes by deed dated February 16, 2011, and recorded in the Suffolk County Clerk’s office on 3/10/2011 (Liber 12653, page 623). Under the terms of the Life Estate, the premises shall be vacated by the heirs and legal representatives of the life tenant within sixty (60) days from the date of death of Julia L. Sill. A memo dated 11/24/2015 from Land Preservation Coordinator Melissa Spiro to William Duffy, Southold Town Attorney, was sent requesting information on how the Town should now proceed. General Land Preservation Items:  DRAFT SUFFOLK COUNTY AGRICULTURAL AND FARMLAND PROTECTION PLAN – 2015 Review draft Drafted comments to Suffolk County Agricultural and Farmland Protection Plan – 2015 were reviewed by LPC members and revision made. Comments will be sent to Sarah Lansdale and Lauretta Fischer at the Suffolk County Planning Department.  FINANCIAL UPDATE \[executive session where applicable\] Not discussed. Next Regular Meeting:  Tuesday, December 8, 2015. The next regular meeting will be on Adjournment:  The meeting was adjourned at 7:48 p.m. by the six attending LPC members.
