Box 1179 Southold, New York 11971 Fax(516)765-1823 Telephone (516) 765-1809 FINDINGS, DELIBERATIONS AND DETERMINATION REGULAR MEETING OF OCTOBER 9, 1997 Appl. #4492 - WALTER KLEIN PARCEL 1000-43-1-8 STREET & LOCALITY: 3235 Manhanset Avenue, Greenport DATES OF PUBLIC HEARINGS: July 10, 1997; August 14, 1997; September 25, 1997 (final hearing). FINDINGS (PROPERTY FACTS): DESCRIPTION: This property is located in an R-40 Residential Zone District, being situate along the north side of Manhanset Avenue, Greenport, and along the west side of a private right-of-way referred to as "Gull Pond Road." This lot contains a total area of 6,821.29 sq. ft. and is improved with a 1-1/2 story frame, single- family dwelling with sunroom, the "as built" deck in question, and "as built" accessory frame garage also in question. BASIS OF APPEAL: Building Inspector's Action of Disapproval dated May 28, 1997, which reads as follows: "...under Article III -A, Section 100-30A.4 Accessory structures are to be located in the required rear yard and have a maximum height of 18 feet, or 17.5 feet confirmed by applicant ( - also see memo of Ed. Forrester). Under Article IIIA, Section 100-30A.3 of the Bulk and Parking Schedule, "as built" structures exceed the maximum allowable lot coverage of 20% (at) approx. 24.25% or by 292 sq. ft. Deck addition "as built" at 8.3 feet from setback ROW is in violation of 15 ft. minimum setback established by ZBA Appeals ruling of June 12, 1975, #2045. Under Article IIIA, Section 100-30A.3 normal required setback from ROW is 35 feet...." AREA VARIANCE RELIEF REQUESTED BY APPLICANT: 1. "As built" 576 sq. ft. accessory work -shop garage building, substantially located in a front area facing a private right-of-way to the east, with an "as built" nonconforming setback at 2.4 feet. The height of this garage is confirmed by applicant's attorney to meet the maximum 18 ft. height requirement (average mean height code definition) . 2. "As built" deck addition to existing dwelling. Applicant modified plan for consideration by removing 157 square feet of deck area, located on the north and east of the sun room. The removal of the deck area, as indicated on the revised survey dated Septem- ber 17, 1997 prepared by Joseph A. Ingegno, will reduce the existing lot coverage from approx. 24.24 feet percent to not greater � s Page 2, - October 9, 1997 Appl. #4492: 1000-43-1-8 (W. Klein) Southold Town Board of Appeals than 21 percent (exclusive of driveway and allowable 30 sq. ft. step areas). The revised plan will also increase from 8 ft. 3 inches to 11 ft. 3 inches the setback of the remaining 6 ft. by 27 ft. 8 inch deck to the right-of-way. REASONS FOR BOARD ACTION, DESCRIBED BELOW: (1) In considering this application, the board finds that the revised plans submitted by the applicant and relief requested therein are the minimum necessary and adequate and at the same time will preserve and protect the character of the neighborhood, and the health, safety and welfare of the community. (2) The granting of the area variance will not produce an undesirable change in character of neighborhood or a detriment to nearby properties because the accessory garage has existed for more than 15 years in its present location with no apparent ill affects on the existing R.O.W. or surrounding properties. Removal of approximately 50% of the existing deck area will decrease the degree of nonconformity in relation to both lot coverage and setback from the right-of-way. (3) The benefit sought by the applicant cannot be achieved by some method, feasible for applicant to pursue, other than an area variance because the size of the lot is extremely small, 6821 square feet in area, and there is insufficient land area in the required rear yard to locate the accessory garage. A cost estimate submitted by Artco Corp. to remove the garage was in excess of $10,000. Such expense is unwarranted because the existing location of the garage is of minimal significance. (4) The requested area variance is substantial, however, the applicant's revised plans reduce the degree of existing nonconformity in lot coverage and deck setback to the right-of-way. (5) The proposed variance will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because the revised plan will be an improvement that will reduce the degree of nonconformity. (6) The situation has been self-created because the prior owner(s) failed to comply with the terms and conditions set forth in the Board of Appeals ruling #2045 dated June 12, 1975, and subsequent ruling #2781 dated March 5, 1981. RESOLUTION/ACTION: On motion by Member Tortora, seconded by Chairman Goehringer, it was RESOLVED, to GRANT the application as amended, SUBJECT TO THE FOLLOWING CONDITIONS: 1. The deck area comprised of 157 sq. ft. on the north and east sides of the sun room shall be removed within 90 days, all in Page 3 - October 9, 1997 Appl. #4492: 1000-43-1-8 (W. Klein) Southold Town Board of Appeals accordance with the revised survey dated September 17, 1997, prepared by Joseph A. Ingengo, Surveyor. No building permit, certificate of occupancy or other town entitlement shall be issued until this condition has been met. 2. The garage shall only be used as a non -habitable accessory structure. In no event shall it be connected to the principal single-family residence, nor shall it be occupied or used as a separate dwelling. 3. The garage shall not be expanded or replaced unless it is moved to a conforming area. 4. Access to the private right-of-way shall remain open at all times and there shall be no parking of vehicles within the right-of-way. 5. Grant of this variance supersedes all prior decisions of the Board of Appeals. 6. These conditions shall be permanently attached to the certificate of occupancy (C.O.), a copy of which shall be provided to the Board of Appeals within six months. The deck is a minimum encroachment needed for access from the rear door. The garage was used by a world famous guitar maker and is a cultural Toren ZBI (ConRnue an other side) landmark. The removal of the garage would be not only a financial hardship to -the present owner', but a destruction of a cultural landmark for Southold Town. Reason for Appeal Continued Zoning Board of Appeals re: Walter Klein Pursuant to Town Law section 267b-3 the Southold Town Zoning Board of Appeals is to analyze and assess the personal benefits anticipated by the applicant against the potentially deleterious effects that a grant of the relief requested would have on the health, safety and welfare of the effected neighborhood or community. In performing this balancing test, the Zoning Board is charged with the responsibility to consider the five factors enumerated in Town Law Section 267b -3(b). The variance should be granted for the following reasons: 1. No undesirable change will be produced in the character of the neighborhood or a detriment to nearby properties, if the variance is granted. The property is very small, triangular shaped and is burdened by a right of way. The residence was located on the parcel pursuant to a variance (Appeal No. 2045) which stated that "the house shall be located no closer than 10 feet to the westerly side line, and no closer than 15 feet to the easterly side line." The house complies with the ZEA decisions but the deck is set back 8.3 from the easterly property line and results in a lot coverage of 24.25% or -292 sq. ft. over the required lot coverage. The property is not level and the deck extends from the year door access which is approximately two feet above grade to the front yard which is at grade. The decking is used as a platform and walkway, and is in character with the rustic style of the house and seasonal dwellings. 2. With regard to the Garage, the garage was built pursuant to a building permit by the prior owner, James D'Aquisto. The survey did not disclose a right of way, therefore the building permit was revoked. A subsequent zoning appeal by D'Aquisto (Appeal No. 2781) was denied on March 5,1981. The garage has remained on the property in violation to date. The setback of the garage is burdened by a front yard setback on a very small parcel. The lot is only 6,821 sq. ft. Pursuant to Section 100-33, if the right of way were not there the set back required would be only three (3) feet in a lot which is less than 20,000 sq. ft., therefore only a .6 foot variance would be required. The garage can not be out back, to demolish this structure would be unreasonable and a financial hardship. The previous owner, D'Aquisto became a world famous guitar maker who used the garage as his studio. Anything associated with D'Aquisto is prized. This structure will become a cultural landmark in the music world, the garage already attracts visitors to the property. The benefit sought by the applicant can not be achieved by some method, feasible for the applicant to pursue, other than an area variance. 3. The area variance is substantial because of the front yard setback requirement of 35 feet, however, the garage has no impact on the adjacent property or the right of way. Construction of a new garage located 35 feet from the right of way would result in a violation of the westerly sideyard. Moreover, a large utility pole is located east of the garage, within the legal right of way, which creates a physical barrier and obstructs the right of way. The application of the balancing test weighs in favor of the grant of the variance. 4. The variance will have no adverse effect or impact on the physical or environmental conditions in the neighborhood or district. This property is well screened with overgrown vegetation. The properties in this neighborhood are routinely the subject of variances because of the small lot sizes, the purpose of this appeal is to maintain this property with the as built structures. 5. The alleged difficulty was not self-created. when the Kleins became aware of the zoning problem they were prohibited from seeking a variance prior to the purchase of the house. The D'Aquisto Estate was selling the property "as is" and the Kleins were forced to choose to go forward with the sale or risk loss of their down payment. They chose to go forward and hope that the ZBA would appreciate their situation. 6. The variance requested is the minimum variance practicable given the personal benefits anticipated by the applicant. FINDINGS (PROPERTY FACTS) : DESCRIPTION: This property is located in an R-40 Residential Zone District, being situate along the north side of Manhanset Avenue, Greenport, and along the west side of a private right-of-way referred to as "Gull Pond Road." This lot contains a total area of 6,821.29 sq. ft. and is improved with a 1-1/2 story frame, single- family dwelling with sunroom, the "as built" deck in question, and "as built" accessory frame garage also in question. BASIS OF APPEAL: Building Inspector's Action of Disapproval dated May 28, 1997, which reads as follows: "...under Article III -A, Section 100-30A.4 Accessory structures are to be located in the required rear yard and have a maximum height of 18 feet, or 17.5 feet confirmed by applicant ( - also see memo of Ed. Forrester) . Under Article IIIA, Section 100-30A.3 of the Bulk and Parking Schedule, "as built" structures exceed the maximum allowable lot coverage of 200 (at) approx. 24.25% or by 292 sq. ft. Deck addition "as built" at 8.3 feet from setback ROW is in violation of 15 ft. minimum setback established by ZBA Appeals ruling of June 12, 1975, #2045.. Under Article IIIA, Section 100-30A.3 normal required setback from ROW is 35 feet...." AREA VARIANCE RELIEF REQUESTED BY APPLICANT: 1. "As built" 576 sq. ft. accessory work -shop garage building, substantially located in a front area facing a private right-of-way to the east, with an "as built" nonconforming setback at 2.4 feet. The height of this garage is confirmed by applicant's attorney to meet the maximum 18 ft. height requirement (average mean height code definition) . 2. "As built" deck addition to existing dwelling. Applicant modified plan for consideration by removing 157 square feet of deck area, located on the north and east of the sun room. The removal of the deck area, as indicated on the revised survey dated Septem- ber 17, 1997 prepared by Joseph A. Ingegno, will reduce the existing lot coverage from approx. 24.24 feet percent to not greater Page 2 - October 9, 1997 Appl. #4492: 1000-43-1-8 (W. Klein) Southold Town Board of Appeals than 21 percent (exclusive of driveway and allowable 30 sq. ft. step areas) . The revised plan will also increase from 8 ft. 3 inches to 11 ft. 3 inches the setback of the remaining 6 ft. by 27 ft. 8 inch deck to the right-of-way. REASONS FOR BOARD ACTION, DESCRIBED BELOW: (1) In considering this application, the board finds that the revised plans submitted by the applicant and relief requested therein are the minimum necessary and adequate and at the same time will preserve and protect the character of the neighborhood, and the health, safety and welfare of the community: (2) The granting of the area variance will not produce an undesirable change in character of neighborhood or a detriment to nearby properties because the accessory garage has existed for more than 15 years in its present location with no apparent ill affects on the existing R.O.W. or surrounding properties. Removal of approximately 50% of the existing deck area will decrease the degree of nonconformity in relation to both lot coverage and setback from the right-of-way. (3) The benefit sought by the applicant cannot be achieved by some method, feasible for applicant to pursue, other than an area variance because the size of the lot is extremely small, 6821 square feet in area, and there is insufficient land area in the required rear yard to locate the accessory garage. A cost estimate submitted by Artco Corp. to remove the garage was in excess of $10,000. Such expense is unwarranted because the existing location of the garage is of minimal significance. (4) The requested area variance is substantial, however, the applicant's revised plans reduce the degree of existing nonconformity in lot coverage and deck setback to the right-of-way. (5) The proposed variance will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because the revised plan will be an improvement that will reduce the degree of nonconformity. (6) The situation has been self-created because the prior owner(s) failed to comply with the terms and conditions set forth in the Board of Appeals ruling #2045 dated June 12, 1975, and subsequent ruling 42781 dated March 5, 1981. RESOLUTION/ACTION: On motion by Member Tortora, seconded by Chairman Goehringer, it was RESOLVED, to GRANT the application as amended, SUBJECT TO THE FOLLOWING CONDITIONS: 1. In no event shall it be connected to the principal single-family residence, nor shall it be occupied or used as a separate dwelling. 3. The garage shall not be expanded or replaced unless it is moved to a conforming area. 4. Access to the private right-of-way shall remain open at all times and there shall be no parking of vehicles within the right-of-way. 5. Grant of this variance supersedes all prior decisions of the Board of Appeals. G . I would like to state for the record that forcing the owners to remove that workshop would be a travesty against all good judgement and artistic sensibility. James D'Aquisto is considered by many (including us, and we are experts in this field) to be the finest archtop (jazz) guitar builder of all time. He will be (and to many already is) revered at the same exalted level, in his own art, as are Leonardo DaVinci, Michaelangelo, Stradivarius, Picasso, Van Gogh, and others in their genres. Mr. D'Aquisto's total life output was only around 350 instruments,. His illness prevented him from making more pieces than that. All of his late work, which is considered his best work, was made in that workshop, work which presently sells in the range of sixty thousand to one hundred thousand dollars apiece and prices rise continually. His influence on modern guitar making is far reaching. He was willing, in that workshop, to take risks and create designs whose influence will be felt for centuries. To force the present owners to destroy that workshop would be to lose for all eternity 'Lhe site of. a potential futare--useua. to =.e of America's greatest artists and craftspersops. I observed a wood frame structure comprised of one large room with a loft above. The structure is insulated with the exception of the double doors. The structure has an electrical panel with approximately 100 amp service. The is no permanent heat. I observed two LP tanks on the north side of the structure that I was told supply fuel to the main dwelling only. This space is not arranged for, nor do I believe is capable of, being a habitable space. In addition, the median height of the structure is below 18 feet. Application of Robert New York for a 56 however, they encouraged D'Aquisto and spread the word about the fine instru- ments he was creating. By 1967 the orders for guitars were steady. D'Aquisto worked steadily for six. years, in which time the family expanded to include Michelle and James II, the fifth and sixth children. During his time in Huntington, D'Aquisto had taken on a new partner for the string business. He relocated to Farmingdale, also on Long Island, in 1973, to manufacture his own strings. He was in Farmingdale for four years before moving to Greenport. Though Greenport offered the peaceful atmosphere D'Aquisto desired, the town was initially reluctant to allow him to build Part II D'Aquisto a little shop behind his new home; so he was forced to drive to Farmingdale to work on the instruments. Soonthe town of Greenport assented to D'Aquisto's request for a shop, and as of this writing (in 1990) he is creating instruments in that location. Amidst all of the business and artistic pressures D'Aquisto was forced to bear in his early days as a solitary guitar maker, another more serious and long-lasting problem appeared: he began experiencing symptoms of epilepsy. Mrs. D'Aquisto: His sickness has b en a terrible cloud. As he gets older it se ms to take him a few days longer to "ca e back." He had a very bad concussion when he was nine, another one in a car accident when he was about 20, and another accident on the Long Island Railroad. It bothers me a lot now. It makes me sad and worrisome. D'Aquisto is astonishingly optimistic about his health. D'Aquisto: I actually think it has helped me a great deal. After a seizure I need to recover and I have a lot of time to think, which can be good or bad. At times I think of the things that are unjust, such as living under a standard where many do not recognize ability, and many with no ability wind up rich! I always thought it was the people that couldn't do anything that invented money. But I also get excited to get back to work, and I come back with even more drive and enthusiasm, and usually some new ideas to try on the guitars. They are something I can leave behind and a way that I can help make the world a bit .better. M 2. Thus, as D'Aquisto began experimenting with the bridge, tailpiece, carving, brac- ing, neck angles, etc., he began to change his instruments. A general description of the creation of a D'Aquisto guitar involves a number of procedures. The top and back are carved to their exact shapes (thicker in the center and thinner towards the edge). The sides are bent on an electric bending iron and placed in a mold. Then the neck and tail blocks and kerfed linings are installed, along with the side braces. The s -holes (or an oval hole, or elliptical holes) are jig- sawed out of the top, which is placed on 59 thesides in the mold (held by two'brads situafed'at each block). Then the contour of the blocks and linings is traced onto the underside of the top, the same procedure being followed with the back. D'Aquisto braces the top with an X -brace, the angle of the scissor being incumbent on the tone the instrument is to produce. The gluing edges of the brace are affixed to the top with Titebond glue. Once the top and back are glued to the sides and the binding ledges have been cut, the binding is glued to the edge. The binding material is either black -and -white cellulose plastic or wood, depending on the model. The neck is fashioned from domestic maple and the headpiece is veneered with D'Aquisto bending the sides for a flat -top instrument, 1987.
