This application must be filled in by typewriter or ink and submitted to the Building Department with the following:
A. For new building or new use:
1. Final survey of property with accurate location of all buildings, property lines, streets,and unusual natural or
topographic features.
2. Final Approval from Health Dept. of water supply and sewerage-disposal (S-9 form).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used in system contains less than 2/10 of 1% lead.
5. Commercial building, industrial building, multiple residences and similar buildings and installations, a certificate
of Code Compliance from architect or engineer responsible for the building.
6. Submit Planning Board Approval of completed site plan requirements.
B. For existing buildings (prior to April 9, 1957) non-conforming uses,or buildings and "pre-existing" land uses:
1. Accurate survey of property showing all property lines, streets, building and unusual natural or topographic
features.
2. A properly completed application and consent to inspect signed by the applicant. If a Certificate of Occupancy is

For a Variance to the New York State PETITION NO. 2013-0244
Uniform Fire Prevention & Building Code
Upon the application of Ronald &Theresa Furman, filed pursuant to 19 NYCRR 1205 on May 23,
2013 and upon all other papers in this matter, the Department makes the following determination.
NATURE OF GRIEVANCE AND RELIEF SOUGHT
The petition pertains to the installation of an In-ground swimming pool for a one-family dwelling,
located at 1455 Meadow Beach Lane, Mattituck, Town of Southold, County of Suffolk, State of New York
Relief is requested from-
19 NYCRR Part 1220, The 2010 Residential Code of New York State, Section AG105.3 Section 8.2,
which requires, in part, that all gates shall be self latching, with the latch handle located within the pool
enclosure (i.e., on the pool side of the enclosure) and at least 40 inches above grade In addition if the
latch handle is located less than 54 inches from the bottom of the gate, the latch handle shall be located
at least 3 inches below the top of the gate [The Petitioner request permission to permit latch handles for
two pedestrian gates as a part of a pool enclosure, located 54 inches above the bottom of the gate, to be
located on the outside of the pool enclosure.]
FINDINGS OF FACT
1. An in-ground swimming pool was installed at the subject premises. In doing so, an enclosure was
provided around the pool with two pedestrian access gates.
2. The two pedestrian access gates swing outward from the pool and have latch handles that are
located at least 54,inches above the bottom of the gate However the latch handles have been
located on the outside of the gate.

3. The previous, 2003 and 2007, Residential Codes of New York State allowed the latch handle to be
placed on the outside of the pool enclosure as long as the handle was located a minimum of 54
inches above the bottom of the gate. The current 2010 Residential Code of New York State requires
that even if the latch handle is 54 inches above the bottom of the gate that it must be located on the
pool side of the enclosure.
4. The provisions for barriers around swimming pools are to protect young children. Less than 5 years
of age, according to the International Residential Code Commentary.
5. The 2006 International Residential Code, on which the 2010 New York State Residential Code is
based, allows a latch that is 54 inches above the bottom of the gate to be located on the outside of
the enclosure.
6. The commentary for the International Codes states that the "54 inch latch height requirement limits
the potential for small children to reach and activate the latch." If the latch is located lower than 54
inches then the Code requires that the latch be located 3 inches below the gate on the inside of the
enclosure
7. Section 303.2, Part 8 ,of the current, 2010, Property Maintenance Code of New York State has
retained the language about pool latches that was in the previous Residential Codes of New York
State and still allows a latch that is located 54 inches above the gate to be located on the outside of
the enclosure.
8. Based on the above findings, it is the assumption that the 54 inch height of the latch above the
bottom of the gate is adequate to protect the children that the Code has identified from reaching the
latch and gaining entrance to the swimming pool regardless on which side of the enclosure the latch
is located.
9 On some gate configurations, it may be possible to reverse the latch to be in compliance with the
current Code requirements However in this instance the enclosure and the gates would have to be
completely reconfigured or replaced to reverse the latch. The Petitioner has stated that this would
both physically and financially impractical.
10 The Petitioner has proposed that the pool enclosure and pedestrian gates will be in compliance with
all other applicable provisions of Appendix G of the Residential Code of New York State
Petition#2013-0244

11. The local code enforcement official has been consulted in this matter and does not object to the
granting of a routine variance under the provisions of 19 NYCRR 1205.
CONCLUSIONS OF LAW
Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would be
unnecessary in light of the fact that the latches as configured will be a minimum of 54 inches above the
bottom of the gate and should be out of reach of the children that the Code provisions are trying to protect
and would ensure the achievement of the Code's intended objectives more efficiently, effectively or
economically such that granting a variance would not substantially adversely affect the Uniform Code's
provision for health, safety and security.
DETERMINATION
WHEREFORE IT IS DETERMINED that the application for a variance from 19 NYCRR Part 1220,
Section AG105.3 section 8.2, to permit latch handles for pedestrian gates as a part of a pool enclosure,
located 54 inches above the bottom of the gates, to be located on the outside of the pool enclosure;
hereby PROPOSED TO BE GRANTED with the following condition.
1. That the latch handles be located a minimum of 54 inches above the bottom of the pedestrian gates
2. That the pool enclosure and pedestrian gates will be in compliance with all other applicable
provisions of Appendix G of the Residential Code of New York State
This DECISION is issued under 19 NYCRR 1205.6. Unless objected to by the petitioner in
writing received by the Department, the decision shall become FINAL after fifteen days of receipt of the
decision by the parties
This decision is limited to the specific building and application before it, as contained within the
petition, and should not be interpreted to give implied approval of any general plans or specifications
presented in support of this application

1. Regulated Activities Authorized By This Permit This permit authorizes only those regulated
activities I stnrctures identified under the section Description of Authorized Activity.NYSDEC does not
issue after-the-fact or as-built permits.This permit does not authorize activities,or legitimize the •
existence of structures,which would have required a permit but for which no permit or other
authorization has been granted NYSDEC.
2. Notice of Commencement At least 48 hours prior to commencement of the project,the permittee
and contractor shall sign and return the top portion of the enclosed notification form certifying that they
are fully aware of and understand all terms and conditions of this permit. Within 30 days of completion
of project,the bottom portion of the form must also be signed and returned,along with photographs of
the completed work.

3. Conformance With Plans All activities authorized by this permit must be in strict conformance
with the approved plans submitted by the applicant or applicant's agent as part of the permit application.
Such approved plans were prepared by Nathan Taft Corwin III last revised on 1/6/11,and stamped
"NYSDEC Approved"on 3/16/11.

4. Post Permit Sign The permit sign enclosed with this permit shall be posted in a conspicuous
location on the worksite and adequately protected from the weather.
5. Failure to Meet Permit Conditions Failure of the permittee to meet all the conditions of this permit
is a violation of this permit and grounds for an order to immediately cease the permitted activity at the
project site.
6. Accessory Structures Must Be At Least 75 Feet Landward Of The Wetland Boundary This
permit authorizes the construction of new accessory structures located in the adjacent area at the
prescribed minimum setback only.Structures located in tidal wetlands,or structures in the adjacent area
but located less than 75 feet from the wetland boundary,are not authorized.
7. Development Restrictions New accessory structure construction projects authorized by this permit
must meet all of the applicable development restrictions of 6 NYCRR Part 661.6(axl),(4)and(7)):
-The 75 foot minimum wetland setback requirement for all principal structures and all non-water-
dependent structures exceeding 100 square feet in area.
-The 20%maximum adjacent area coverage limitation for impervious structures and surfaces.
-The 75 foot minimum wetland setback requirement for all hard surface driveways,roads,parking areas
and similar impervious surfaces exceeding 500 square feet in area.
8. Storage of Equipment,Materials The storage of construction equipment and materials shall be
confined within the project work area and/or upland areas greater than 50 linear feet from the tidal
wetland boundary.
9. Concrete Leachate Detling construction,no wet or fresh concrete or leachate shall be allowed to
escape into any wetlands or waters of New York State,nor shall washings from ready-mixed concrete
trucks,mixers,or other devices be allowed to enter any wetland or waters. Only watertight or
waterproof forms shall be used. Wet concrete shall not be poured to displace water within the forms.
10. Area of Disturbance for Structures Disturbance to the natural vegetation or topography greater
than 25 feet seaward of the approved structure is prohibited.
11. Contain Exposed,Stockpiled Soils All disturbed areas where soil will be temporarily exposed or
stockpiled for longer than 48 hours shall be contained by a continuous line of staked haybales/silt
curtains(or other NYSDEC approved devices)placed on the seaward side between the fill and the
wetland or protected buffer area. Tarps are authorized to supplement these approved methods.
12. Vegetate All Disturbed Areas The permittee shall revegetate all exposed faces and disturbed areas
to prevent soil erosion prior to the project completion or expiration date of this permit,whichever comes
first.

13. Clean Fill Only All fill shall consist of clean sand,gravel,or soil(not asphalt,slag,flyash,broken
concrete or demolition debris).
14. No Disturbance to Vegetated Tidal Wetlands There shall be no disturbance to vegetated tidal
wetlands or protected buffer areas as a result of the permitted activities.
15. No Construction Debris in Wetland or Adjacent Area Any debris or excess material from
construction of this project shall be completely removed'from the adjacent area(upland)and removed to
an approved upland area for disposal_ No debris is permitted in wetlands and/or protected buffer areas.
16. Precautions Against Contamination of Waters All necessary precautions shall be taken to
preclude contamination of any wetland or waterway by suspended solids,sediments,fuels,solvents,
lubricants,epoxy coatings,paints,concrete,leachate or any other environmentally deleterious materials
associated with the project.
17. State May Require Site Restoration If upon the expiration or revocation of this permit,the
project hereby authorized has not been completed,the applicant shall,without expense to the State,and
to such extent and in such time and manner as the Department of Environmental Conservation may.
require,remove all or any portion of the uncompleted structure or fill and restore the site to its former
condition. No claim shall be made against the State of New York on account of any such removal or
alteration.
1s. State May Order Removal or Alterationof Work If future()Mations by the State of New York
require an alteration in the position of the structure or work herein authorized,or if,in the opinion of the
Department of Environmental Conservation it shall cause unreasonable obstruction to the free navigation
of said waters or flood flows or endanger the health,safety or welfare of the people of the State, or cause
lossor destruction of the natural resources of the State,the owner may be ordered by the Department to
remove or alter the structural work,obstructions,or hazards caused thereby without expense to the State,
and if,upon the expiration or revocation of this permit,the structure,fill,excavation,or other
modification of the watercourse hereby authorized shall not be completed,the owners,shall,without
expense to the State,and to such extent and in such time and manner as the Department of
Environmental Conservation may require,remove all or any portion of the uncompleted structure or fill
and restore to its former condition the travigable and flciod capacity of the waternourse. No claft shall
be made against the State ofNew York on account of any such removal or alteration.
19. State Not Liable for Damage The State of New York shall in no case be liable for any damage or
injury to the structure or work herein authorized which may be caused by or result from future operations
undertaken by the State for the conservation or improvement of navigation,or for other purposes,and no
claim or right to compensation shall accrue from any such damage.

GENERAL CONDITIONS-Apply to ALL Authorized Permits:
1. Facility Inspection by The Department The permitted site or facility,including relevant records,is
subject to inspection at reasonable hours and intervals by an authorized representative of the Department
of Environmental Conservation(the Department)to determine whether the puttee is complying with
this permit and the ECL. Such representative"may order the work suspended pursuant to ECL 71-0301
and SAPA 401(3).
The permittee shall provide a person to accompany the Department's representative during an inspection
to the permit area when requested by the Department.
A copy of this permit,including all referenced maps,drawings and special conditions,must be available
for inspection by the Department at all times at the project site or facility. Failure to produce a copy of
the permit upon request by a Department representative is aviolation of this permit.
2. Relationship of this Permit to Other Department Orders and Determinations Unless expressly
provided for by the Department,issuance of this permit does not modify,supersede or rescind any order
or determination previously issued by the Department or any of the terms,conditions or requirements
contained in such order or determination.
3. Applications Pais Permit Renewals,Modifli l ations or Transfers The permittee wrist submit a
separate written application to the Department for permit renewal,modification or transfer of this
permit.•Such application must include any forms or supplemental information the Department requires.
Any renewal,modification or transfer granted by the Department must be in writing. Submission of
applications for permit renewal,modification or transfer are to be submitted to:

4. Submission of Renewal•Application The permittee must submit a renewal application at least 30
days before permit expiration for the following permit authorizations:Tidal Wetlands.
S. Permit Modifications,Suspensions and Revocations by the Department The Department
reserves the right to modify,suspend or revoke this permit. The grounds for modification,suspension or
revocation include:
a. materially false or inaccurate statements in the permit application or supporting papers;
b. failure by the pennittee to comply with any terms or conditions of the permit;
c. exceeding the scope of the project as described in the permit application;
d. newly discovered material information or a material'change in environmental conditions,relevant
technology or applicable law or regulations since the issuance of the existing permit;

e. noncompliance with previously issued permit conditions,orders of the commissioner,any
provisions of the Environmental Conservation Law or regulations of the Department related to

6. Permit Transfer Permits are transferrable unless specifically prohibited by statute,regulation or
another permit condition. Applications for permit transfer should be submitted prior to actual transfer of
ownership.
NOTIFICATION OF OTHER PERMITTEE OBLIGATIONS
Item A:Permittee Accepts Legal Responsibility and Agrees to Indemnification
The permittee,excepting state or federal agencies,expressly agrees to indemnify and hold harmless the
Department of Environmental Conservation of the State of New York,its representatives,employees,
and agents("DEC")for all claims,suits,actions,and damages,to the extent attributable to the
permittee's acts or omissions in connection with the permittee's undertaking of activities in connection
with,or operation and maintenance of,the facility or facilities authorized by the permit whether in
compliance or not in compliance with the terms and conditions of the permit. This indemnification does
not extend to any claims,suits,actions,or damages to the extent attributable to DEC's own negligent or
intentional acts or omissions,or to any claims,suits,or actions naming the DEC and arising under
Article 78 of the New Yoh Cyil Practice laws and Rules or any citizen,suit or civil rights provision
under federal or state laws.

The permittee is responsible for informing its independent contractors,employees,agents and assigns of
