SLIFKIN & MARGARET SLIFKIN SCTM#: 1000-103-3-11 —2520 BEEBE DRIVE, CUTCHOGUE Dear Mrs. Moore: We are in receipt of your September 15, 2015 letter withdrawing your application for a wetland permit on behalf of Robert and Margaret Slifkin. Field inspections performed as a result of your application for an administrative wetland permit and certificate of compliance for this site have revealed that at least 32' of catwalk exist over Trustee underwater lands that were never permitted. Accordingly, unless the seaward end of the catwalk is shortened with the attached ramp and floats moved 32' landward within thirty(30)days, the Board will refer this matter to the Bay Constable. Additional landward extension of the catwalk that may have been constructed with DEC permits when not in the jurisdiction of the Trustees could be considered by the Board for"upgrade" to be included in an omnibus wetland permit application with the possibility that thru-flow decking might be required for the catwalk. Slifkin & Margaret Slifkin Dear President Bredemeyer: We are withdrawing our application for a wetland permit. The Board is wrongfully refusing to issue a certificate of compliance for existing ' "permitted floats" which were constructed between 1977 and 1979 with Trustee, Army Corp., Department of State, and NYSDEC approvals. 1 The Trustees' actions have caused my client financial loss and damages because a purchaser required a certificate of compliance. The Board's actions are arbitrary and capricious, illegal, and unconstitutional. If my client surrenders to the Board's demands, replacing the two landward floats with a new catwalk, the owner faces the unnecessary expense, time and uncertainty to get permits from the Army Corp., Department of State and NYSDEC. The modifications to the existing dock eliminates functional floats to construct a new catwalk. The full length of the catwalk (landward of the 55') over the wetlands to the upland (grass) pre-dates the Board's jurisdiction. The exiting catwalk dimensions have not changed since the catwalk was constructed in 1977 when the Trustees did not regulate catwalks over the wetlands. At that time the Trustees only regulated marine structures in the water or marsh. urs, atricia C. SCTM# 103-3-11 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with the Policy Standards (Policy 6.3) and therefore is INCONSISTENT with LWRP. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The application references a 1979 permit for the dock structure, however, no permit was found. Before issuing a permit for a dock structure, the Trustees shall consider whether the dock will have any of the following harmful effects: (2] Whether the dock will unduly interfere with the public use of waterways for swimming, boating, fishing, shellfishing, waterskiing and other water-dependant activities; The dock extends much further into the water body than surrounding structures affecting the public use of the waterbody. Further, Chapter 275 requires that the determination of the length of the dock must include the dimensions of the vessel. The dimensions of a vessel are not specified. At the discretion of the Board of Trustees, any operations proposed in critical environmental areas (§ 275-2) may be subject to more stringent requirements than detailed in this section. [11] Whether the cumulative impacts of a residential and commercial dock will change the waterway or the environment and whether alternate design, construction, and location of the dock will minimize cumulative impacts; and The continued construction of dock structures within a Significant Fish and Wildlife Habitat/Critical Environmental Area will affect the public use of the area and degrade the ecological quality of the area through introduction of contaminants, disruption of marine life habits etc .... Correspondingly, physical and functional loss to wildlife has been found to occur through the loss and/or impairment of habitat, disruption of habits and migration patterns (structure and activity) and introduction of harmful contaminants. The most common contaminant associated with docks is wood preservatives impregnated into the wood used to prolong the life of a dock. Three trace metals; arsenic, chromium and copper are the most common. These three metals have the greatest potential to increase in estuarine environments from docks (Sanger and Holland 2002). [12] Whether adequate facilities are available to boat owners and/or operators for fueling, discharge of waste and rubbish, electrical service and water service. No such facilities are proposed or discussed 9.3 Preserve the public interest in and use of lands and waters held in public trust by the state and the Town of Southold. A. Limit grants, leases, easements, permits or lesser interest in lands underwater in accordance with an assessment of potential adverse impacts of the proposed use, structure, or facility on public interest in public lands under water. 3. Obstruction of navigable waters and underwater/ands is limited: b. to the minimum necessary for access to navigable waters. The minimum is determined by evaluating the following factors: (vi) whether or not alternative means to gain access are available. The applicant presently enjoys access to the waterbody via the opportunity for a mooring. Due to the shallow water depths and environmental sensitivity of the area, the seasonal mooring of vessels are more appropriate in this area. In the event the action is approved, it is recommended that 1. That a significant non-disturbance buffer be established to mitigate the local impacts from the dock structure to public surface waters and bottomlands. 2. The dock be shortened to comply with the existing "pier line". 3. Open grate decking be required. 4. Floats are required to be removed in the winter months. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
