No. 4475 - MARY FISCHETTI PARCEL 1000-87-3-4 STREET & LOCALITY: 3760 Minnehaha Boulevard, Southold DATE OF PUBLIC HEARING(S): May 19, 1997 - June 19, 1997. FINDINGS (PROPERTY FACTS): DESCRIPTION: This property is located in an R-40 Residential Zone District, being situate on the north side of Minnehaha Boulevard with 85.0 ft. road frontage and 75.91 ft. frontage along Corey Creek (new channel). This lot contains a total area of 9,874 sq. ft. and is improved with a one-story frame house with attached garage and porch, as depicted on a photocopy of sketched survey map BASIS OF APPEAL: Building Inspector's Action of Disapproval dated February 21, 1997, which states that under Article XXIV, Section 100-244B, proposed addition to existing dwelling will have a 'educed side yard setback at less than the required 10 feet and less t'.an the required total of both side yards of 25 feet. AREA VARIANCE RELIEF REQUESTED BY APPLICANT: To to ate 11 ft. by 20 ft. addition at the easterly side leaving a reduced s aback at nine (9) feet at its closets point. Total sideyards ara also proposed to be reduced from 23 ft. to 12 ft. (9 ft. plus existing 3 ft. at the westerly side yard). REASONS FOR BOARD ACTION, DESCRIBED BELOW: (A former side yard reduction by town variance approval is of record.) (1) The granting of the area variance will produce an undesirable change in character of neighborhood or a detriment to nearby properties because it is closing-in both side yards. (2) The benefit sought by the applicant can be achieved by some method, feasible for applicant to pursue, other than an area variance because a smaller addition is possible, or building up (above the existing footprint). (3) The requested area variance is substantial representing approximately 530 of the code requirements. (5) The situation has been self-created. RESOLUTION/ACTION: On motion by Member Dinizio, seconded by Member Ostermann, it was RESOLVED, to DENY the relief requested, *without prejudice. VOTE OF THE BOARD: AYES: Members Doyen, Dinizio, Tortora, Ostermann and Goehringer. (Member Goehringer noted that he would be willing to give alternative relief.) STRICT APPLICATION OF THE ORDINANCE would produce practical dlitfib `os or unneces- sary HARDSHIP because It would eliminate the construction of the addition. Section 100-244 which designates side yards for Nonconforming lots has the same minimum side yard for lots up to 39,999. With this lot being 9,874 square feet and with a width of 75 feet the strict enforcement of this section would limit the use of this lot. NOTE: The placement of the addition was also governed by the 75 foot buffer from the wetlands. Also because of the configuration of the house on the lot, only the front corner of the proposed addition encroaches. 2. The hardship created is UNIQUE and is not shared by all properties alike in the Immediate vicinity of this property and in this use district because Of the unusual size and configuration of the property 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CFIARACTER OF THE DISTRICT because Many of the properties in this area were constructed prior to zoning with many homes with nonconforming side yards. With this new addition the resulting final relationship with the adjacent property will not change the character of the area.
