SCTM#1000-50-1-14 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions,without further steps under SEQRA. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: Subject property is a conforming 2.15 acre parcel located in the R40 Zone District. It is improved with a one story dwelling with attached garage. It has 300.73 feet along a 20' private right of way on the eastern property line, 243.01 feet along a 15' right of way on the northern property line, 311.97 feet along the western property line and 349.37 feet along the southern property line as shown on the survey dated May 29, 2012, revised July 8, 2015 prepared by John T. Metzger,LLS. BASIS OF APPLICATION: Request for variances from Article III Section 280-15 and 280-15D and the building inspector's Notice of Disapproval dated September 29. 2015, amended October 28, 2015 based on an application for a building permit to construct an accessory garage, at: 1) location other than the code required rear yard, 2)dormers at more than the maximum code allowable 40% of roof width. RELIEF REQUESTED: The applicant requests a variances to construct an accessory garage in the front yard where the code requires a rear yard location and roof dormers exceeding the maximum code allowable of 40%. AMENDED APPLICATION: During the hearing, the applicant was asked to bring the plan into more conformity with the code. The applicant on December 14, 2015 submitted a plan removing the proposed roof dormers, which removes one variance request and brings the plan into more conformity with the codes. ADDITIONAL INFORMATION: Several neighbors were at the public hearing with concerns. Page 2 of 3—December 17,2015 ZBA File#6897—Cocolaras SCTM#1000-50-1-14 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on December 3, 2015 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Granting the relief as amended will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Accessory garages are a common accessory to residential dwellings. The property has two front yards and the rear yard area is too small of an area for the proposed structure. Any other area on the property is sloped. The accessory garage will not be visible to surrounding properties. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant removed the original request for dormers which eliminated one variance request. The property is constrained by the two front yards and the proposed front yard location is the most suitable since it's the flattest area of land. 3. Town Law §267-b(3)(b)(3). The relief as amended herein is mathematically substantial, representing 100% relief from the code. However, the applicant eliminated one variance request. Due to two front yards the proposed location is the most practicable and the accessory garage will be screened with landscaping. 4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the relief as amended is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory garage while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Schneider, seconded by Member Weisman(Chairperson), and duly carried,to GRANT, the variance as AMENDED, and shown on the Architectural drawings labeled pages 1.1(2nd floorplan) 24X28 Legacy Garage, 1, floorplan, 2 frontview, 3 gableviewl, 4 backsideview, and 5 gableview2 all dated 8-6-2015 prepared by Sheds Unlimited. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1)year terms. On December 17,2015,variance relief was granted by the Zoning Board of Appeals which allowed for the location of an accessory garage in the front yard instead of the permitted rear yard, and to construct roof dormers exceeding the maximum code allowable of 40%. You explained that your expeditor reopened your case, and was working on resolving outstanding issues in order to obtain a Certificate of Occupancy. However, over several months,your expeditor had not responded to your requests and had left you in the dark. According to our records, site inspections that have been conducted resulted in numerous outstanding issues. Pursuant to the Code of the Town(280-146B) any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured within three(3)years from decision date. The Board may, upon written request, prior to the date of expiration, grant one-year extensions, not to exceed three consecutive years, all totaling six years. On October 6, 2022,the Board granted an extension of variance relief for one year to expire on October 23,2023, adding that failure to obtain a Certificate of Occupancy within this timeframe will require another application with a public hearing. During the Regular Meeting of September 5, 2024,Members of Zoning Board of Appeals reviewed and discussed your request. Since variance relief already exceeds more than the six-year time frame,this Board does not have any legal authority to grant additional extensions. You are advised to re-apply for variance relief with a new application and a public hearing. Mr.Connelly was charged with the responsibility of reopening my case and resolving the outstanding items that were necessary for approval toward this goal. Mr.Connelly successfully reopened my case,though that was the conclusion of his efforts. I paid for and was operating under the expectation that he was addressing and resolving these outstanding items that were required of me. Over the course of months,countless calls to his office,and texts, Mr.Connelly i went dark and to date has not responded. Communication from this body granting an extension was sent to Mr.Connelly with particulars as to the terms of the extension,this was not forwarded to me by Mr.Connelly. I was completely left in the dark. I realize ultimately this was my responsibility, regardless that he was retained as my agent to work with this body to resolve whatever was needed to obtain the C of 0. 1 became myopic in my approach to focusing on him and why he is not responding to me after taking my fee as opposed to circumventing him and going directly to this board to determine where we are with this matter. With all, I am requesting another extension to resolve these matters as I will personally be handling this in a most expeditious fashion. I am not asking for,nor will I need a 12-month extension. I believe I can have all these matters resolved within 3 months. My hopes are that this body will be empathetic with my situation,and that my request will be granted. Peter Cocolaras ZBA file 6697 property location: 1095 Hyatt Road Southold New York sctm#1000-50-1-14 we are respectfully requesting an extension on the above file number, 1 understand this is a longer time expired than normally accepted by the board except this was an extreme circumstance in which this was not finished out. Mr. Cocoloras purchased the garage from a company in Pennsylvania in which built it there and delivered here, Mr. Cocolaras had all his inspections or so he thought only to come to find out there were a few things not originally done by the company, such as some washers and bolts, hand rail, verification of height and strapping cert in which the Pennsylvania company was unaware of or thought not to need, all minor things that hold up a final CO as we all know, unfortunately while navigating through that process the Cocolaras's lost their expecting Twin boys and suffered every parents nightmare, with a young child at home and trying to maintain their sanity through tremendous grief Mr. Cocolaras had to take a mental break from the everyday struggles of the world. It was not until recently he started on this process again to ensure his family is not left with lingering legal burdens if he was to no longer be here. It is with this sad information I pray the board grants the extension without another hearing already approved by the board so the Cocolaras's can continue to legalize their property. It is with your approval we can renew the permit and have the final inspection done to get this grief stricken family their certificate of occupancy so they can do the other things they wish to for their again growing family.
