RELIEF REQUESTED BY APPLICANT: Approval of Waiver under
Seclion 100-26 for a single nonconformiug Io~ identified as
1000-123-6-12.5.
BASIS OF APPEAl,: Building Inspector's Action of l)isapproval dated
July 10, 1997, which reads as follows: "under Article II, Section
100-2,1A(1), the 1,1,113 SCl. ft. lot created by deed on August 21,
1978 does not conform to the minimum lot size set forth in Bulk
Schedule AA as of ~he date of lot creation, the required lot size is
40,000 sq. ft. for lots created after December 2, 1971. Under
Article XXIV, Section 100-244B the required lot line setback
pequiremeuls are a minimum of 35 feet front yard, 35 ft. rear yard,
si(lc yard al 10 fi. with both sides equal to 25 ft. Survey shows
ibc property (sic) dwelling at 10 ft. with both sides equal to 25
fl. Survey shows the property dwelling does not have the required
fron! yard and rear yard lot line setbacks .... "
REASONS FOR BOARD ACTION~ DESCRIBED BELOW:
The subject lot 1000-123-6-12.5 is vacant land and consists of a lot
size of 14,000 square feet and adjoins improved lots of si~nilar size
to the south (1000-123-6-12.4) and to Ibc noplb (12.3).
The subject lei (12.5) and southerly adjoining lot (12.4) have been
held in single and separate ownership since prior to 1983 as
confirmed by the tille insurance company's search submitted under
this application.
This subject lot 12.5 was crealed by minor subdivision approval of
the Southold Town Plauning Board cud signed by the Chairman
September 15, 1969.

recognized under subdivision (2), and that no merger has occurred
as of July 1, 1983 or thereafter.

NOTICE IS HEREBY GIVEN, pursuant to Section 267 of the Town
Law and the Code of the Town of Southold, the following applications
will be held for public hearings by the SOUTHOLD TOWN BOARD OF
APPEALS, at the Southold Town Main Road, Southold, New
York 11971, oil TllURS6AY SEPTEMBER 11, 1997 at the times noted
below (or as soon thereafter as possible):
6:45 p.m. Appi. No. 4356 - MARTIN KOSMYNKA. This is an application
for a Variance, bused upou the Building Inspector's Action of

the Town Building Inspector (copy attached).
The zoning of my parcel is presently: Residential
The size requirement for this zone is: 40,000.00 square feet
per parcel. County Tax Map Parcel Nos: 1000 123 - 6 - 12.5
I (we), Eleanor Corwin , as owners of the
contiguous lots shown on the attached deeds, request a review
determination by the Board of Appeals to determine whether or not
these parcels qualify for a "waiver" under the merger provisions of
Article II, Section 100-26 of the Southold Town Zoning Code.
I hereby submit all of the following documents for reliance by the
Town of Southold in making this review determination:
1. Copies of my recent tax bill for both (all) lots.
2. Copies of deeds dated prior to June 30, 1983 for all lots.
3. Copies of current deeds of the parcels under review.
4. Copy of the current County Tax Map for my neighborhood.
5. $150.00 application check which is not refundable if
this waiver is denied.
I understand that if an unfavorable waiver action is issued by the
Town of Southold, that I reserve the right to file for a
subdivision and, if necessary, area variances under the usual
procedure. By making this application, I hold the Town of Southold
free and harmless from any and all claims and liability resulting
from the issuance of a waiver.

SUBJECT: Request to Return Monies Re: Lot Creation Reviews
As you may know, there have been a few situations where applicant receives
a notice of disapproval and proceeds to go through a ZBA process - but
finding with research that there was town approval for that lot.
Would you, as the department head of the Building Department, agree to
joining with the ZBA to refund a portion (of $150.00) applicable to the "lot
creation" reviews? Half would be appreciated in the amount of $75.00 from
the Building Department, and remaining $75.00 from the ZBA budget.
If you approve in behalf of the Building Department, would you sign the
bottom line. We will then proceed to request a check be issued to Mrs.
Grattan. Thank you.

NOTICE OF PUBLIC HEARING
58-1. Providing notice of public hearings.
(HISTORY: Adopted by the Town Board of the Town of
Southold 129-27-1995 as L.L. No. 25-1995. Amendments
noted where applicable.]
§ 58-L Providing notice of public hearings.
Whenever the Code calls far a public hearing, this section
shall apply. Upon determining that an application is complete,
the board or commission reviewing the same shall lit a time
and place for a public hearing thereon. The board or commission
-viewing an application shall provide for the giving of notice:
By causing a notice giving the time, date, place and
nature of the bearing to be published in the official
newspaper within the period prescr:bed by taw.
B. By.A'quiring the applicant to ere- the sign provided by
the town, wnich shall be prominently displayed on the
promises facing each public or private street which the
property involved in the application abuts, giving notice
of the application, the nature of the approval sought
thereby and the time and place of the public hearing
.hereon. 'The sign shall be set bats noc more than ten
(10) feet from the property line. The sign shall be
displayed for a period of not !ess than seven (5) days
immediately preceding the date of the public hearing.

approval for a four-lot minor subdivision, map signed by John
Wickham dated 9-15-69. Please note that the first portion of the
two-fold Notice of Disapproval is affected since the Building
Department indicated the lot was not legally created. The search
shows the lot was held in single-and-separate ownership since 1983
(and before).
Attached is a copy of the PB's approved minor subdivision map.
A copy was furnished to the contract vendee, Mrs. Grattan, today.

FINDINGS OF FACT
PROPERTY FACTS/DESCRIPTION:
This property is located in as R-40 Low-Density Zone District, being
situate on the easterly side of Camp Mineola Road. This lot contains a
total area of 14,113 sq. ft. as depicted on the June 12, 1997 survey
map. This property is vacant land, and is shown as Lot r2 on the
June 11, 1969 Minor Subdivision Map for Lena F. Howell signed by the
Planning Board Chairman on September 15, 1969. By separate review,
this lot has been single and separate since 1983 pursuant to Sec. 100-25.
BASIS OF APPEAL: Building Inspector's Action of Disapproval dated
July 10, 1997 which, in part as it pertains to this application, reads
that under Article XXIV, Section 100-244B, proposed new dwelling will
have reduced front yard and rear yard setbacks.
AREA VARIANCE RELIEF RE UESTED BY APPLICANT: To locate new
dwelling with reduced front yard setbacks at 30 ft. and at 27 ft. at the
closest points, reduced rear yard setback at 25-26 ft. from a proposed
deck, and reduced rear setback for the most northerly portion of the
proposed dwelling with a 30 feet rear yard. Both side yard setbacks
are proposed to be conforming under the current code.
REASONS FOR BOARD ACTION DESCRIBED BELOW:

due to the small size of these properties.
(2) The benefit sought by the applicant cannot be achieved by some
method, feasible for applicant to pursue, other than an area variance
because applicant's property is substandard in size, 14,113 so. ft., and
only 72+ feet deep. Without variances, the applicant's house would be
restricted to a depth of 20 feet.
(3) The requested variance is not substantial in relation to the

setback, and the proposed 27 ft. front yard setback represent a 23%
reduction.
(4) The proposed variance will not have an adverse effect or impact
on the physical or environmental conditions in the neighborhood or
district because the variance granted is minimal.
(5) The difficulty has not been self-created because this 14,113 sq.
ft. lot was duly created by subdivision in 1969 prior to the more
stringent setback requirements of the existing zoning code.
(6) This action is the minimum that the Board deems necessary and
adequate and at the same time preserves and protects the character
of the neighborhood, and the health, safety, welfare of the
community.
RESOLUTION/ACTION: On motion by Member Tortora, seconded by
Chairman Goehringer, it was
RESOLVED, to DENY the relief as applied for a 26 ft. rear yard
setback, and be it further
RESOLVED, to GRANT ALTERNATIVE RELIEF for a 30 ft. rear yard
setback at its closest point, reducing either the building and/or the
deck addition to conform with the 30 ft. minimum 30 rear yard
setback, and allowing a 27 ft. front yard setback at its two closest
points (bay windows or step areas), SUBJECT TO THE CONDITION
that the deck not be enclosed.
