I kindly request a postponement of a week or two as it would not be possible for either me or my wife to attend. Needless to say, I was very upset about the thought of a tennis court on this absolutely beautiful road. The thought of a tennis court and overhead lights is anathema to me. I am sure I speak for many of my neighbors on Star Road. Although I am speakiselg as a private citizen, I am also the secretary of the Stars Road Beach Association, many of whom are members of this Road. I am sure that the association would not look favorably to this tennis court. However, as we have not been able to discuss the matter with our members, I cannot yet speak on the Association's behalf. RUTKOWSKI Notary Public,State of New York No. 49$2528 Qualified in Suffolk County, o0 3 Commission Expires June 3. 4Ir A011 Reason for Appeal Continued Zoning Board of Appeals re : Martem Management Pursuant to Town Law section 267b-3 the Southold Town Zoning Board of Appeals is to analyze and assess the personal benefits anticipated by the applicant against the potentially deleterious effects that a grant of the relief requested would have on the health, safety and welfare of the effected neighborhood or community. In performing this balancing test, the Zoning Board is charged with the responsibility to consider the five factors enumerated in Town Law Section 267b-3 (b) . The variance should be granted for the following reasons : background: A previous zoning application was submitted to the Zoning Board to place a tennis court on the adjacent residential property. The Zoning Board suggested the more suitable location would be on the same parcel as the residence. The applicant obtained an abandonment of the private road and can locate the tennis court on the same parcel as the house. 1 . No undesirable change will be produced in the character of the neighborhood or a detriment to nearby properties, if the variance is granted. The accessory private tennis Court is a customary accessory use to the residence and the only suitable location is in the area proposed. The applicant owns the adjacent affected properties . 2 . The benefit sought by the applicant can not be achieved by some method, feasible for the applicant to pursue, other than an area variance. The only alternative to the proposed location is to place the tennis court on one of the adjacent residential parcels . However, the ZBA prefers not to grant variances for accessory uses without a principle use . The building department determined that the lot coverage would exceed 20% (320) . A tennis Court often results in excess lot coverage because it is included in the definition of "building area" , however, it is an open space without 1111 affecting light and air. The subject property has had to place all the accessory structures (pool and tennis court) on the same parcel because the ZBA does not wish to grant accessory uses on the adjacent parcels . The applicant' s family also owns lot 23 , lot 21, and lot 23 of High Point at East Marion. 3 . The area variance is not substantial . The application of the balancing test weighs in favor of the grant of the variance . The applicant maintains the adjacent residential parcels as open undeveloped parcels, therefore, not affecting any neighbors . The lot coverage is not substantial given that the residence itself is modest in size but the tennis court (60 ' x 120 ' ) is a large area of lot coverage . 4 . The variance will have no adverse effect or impact on the physical or environmental conditions in the neighborhood or district . The lot is residential with customary accessory residential uses . Had the road been opened it would have been blacktopped from end to end, the tennis court results in less environmental impact . 5 . The alleged difficulty was not self-created. The applicant preferred to place the tennis court on an adjacent vacant parcel (see previous appeal) . The applicant does not wish to fully develop the adjacent lots with residences just to build an accessory tennis court . The applicant acquired the road and it was abandoned. Therefore, the tennis court is in the appropriate location. 6 . The variance requested is the minimum variance practicable given the personal benefits anticipated by the applicant . The applicant has made every effort to abide by the ZBA' s recommendations . It is not logical to require a property owner to build a house just so that owner can build the desired tennis court . We should encourage owners to keep properties undeveloped for as long as possible . Bulk Schedule requires a maximum lot coverage of 20 percent. Total lot coverage, following the proposed construction,would be+1- y-two (32)percent. Member Horning: Then we've got a separate parcel for the principal dwelling to go on it. Pat Moore: My only concern is that title-wise on a unnamed street, there may be rights of others. Chairman: Yes, but he owns both properties on both sides. Mrs. Moore: But I don't know if that road — once you have a street, yes, presumably if you own both sides it may be possible but I'm not sure if a title company would— Maybe put the tennis court and then he doesn't care about that. Chairman: Put it at the end of the street so that no one has any right to that street, and abandon that road t that point. That's what you do. Mrs. Moore: I'll offer that. Chairman: And you know what, that's a great option. He's the only person that could do that because he owns the latter part of that street. I don't even know the purpose of that street. Mrs. Moore: Am I going to have a problem with the accessory in the side yard? Chairman: If he merges — whatever he has a problem with, whatever comes before this Board, I'll grant it. All right. I don't care if the Building Department thinks it is upside down or around the scope. Member Horning: It's a lesser problem. Member Collins: You could have difficulty with some of your board members. Member Collins: There's another gentleman out in that neighborhood with a problem with lot coverage for a tennis court, we're waiting on that one. Mrs. Moore, you said we've seen applications for tennis courts and what not of a similar thing, and I've been on the board for four years and we haven't. And the case I remember most clearly is this garage, Michael Rand up on Bight Road in Orient. I remember it because I just sort of know the people. We were very firm. He had the same kind of argument. Not quite the same because he wanted a garage, and we were very quite clear on it. And we had another one in Orient were an accessory was built on the assumption, and the belief was Building Department had the lots merged, and the owner came along ten years later and said, "Oh, I didn't merge them." And we said, yes you did. Because he was able to build the fact, the fact that it appeared merged at that time and the Building Department proceeded on that basis, and that's what did it. And he couldn't, we certainly were not going to let him unmerge. So we have looked at this, and I understand your feeling about the equities and the reasonableness and what the law says, and the Chairman is right, we have not talked to Counsel about it. MRS. MOORE: Well, we'll recess this for now. Until I have a chance to. CHAIRMAN: What do you think of my idea of the abandoned road. MEMBER COLLINS: I'd love for you to find a case. MRS. MOORE: I have trouble with that survey visualizing where it might fit. So. CHAIRMAN: Regardless if it doesn't fit totally on the road we would rather have some side yards anyway, so let it intrude into his property that he has the house on. At the same time you are almost sterilizing a lot by pushing a house all the way to the other corner. Which is going to make it a much nicer lot without that situation. MEMBER HORNING: You're compromising the placement of the future building. MRS. MOORE: I mean if he finds the tennis court was not condusive, if it didn't look nice it is easy enough to take out, so.
