Marinakis Use Variance Dear Mrs. Moore: You will recall that at the public hearing held on August 16, 2001, you indicated that steps would be taken to abandon the adjacent paper street and to apply with an amendment, after showing a different map to the Building Department for review, etc. A different map was suggested to possibly locate the tennis court on the applicant's "house lot"—as an alternative to requesting the above "use variance." As an update to the August 16, 2001 hearing and file information,would you please confirm whether or not you are withdrawing the pending variance application, and possibly apply for a different tennis court location on the house lot in a future submission — after obtaining a determination regarding abandonment of the paper street. (Notary Public) ZBA App 08/00 Reason for Appeal Continued Zoning Board of Appeals re: Artemios Marinakis Pursuant to Town Law section 267b-3 the Southold Town Zoning Board of Appeals is to analyze and assess the personal benefits anticipated by the applicant against the potentially deleterious effects that a grant of the relief requested would have on the health, safety and welfare of the effected neighborhood or community. In performing this balancing test, the Zoning Board is charged with the responsibility to consider the five factors enumerated in Town Law Section 267b-3 (b) . The variance should be granted for the following reasons : 1 . No undesirable change will be produced in the character of the neighborhood or a detriment to nearby properties, if the variance is granted. A tennis court and 6 . 5 foot fence around the Tennis court is to be constructed on applicant' s property with room for a house to be constructed at a later date. Mr. Marinakis and his family own the adjacent property (lot 21 and 22) and wishes to enjoy a tennis court on this parcel without the need to add another house, at this time, to the neighborhood. The tennis court will be accessory to his residential use . 2 . The benefit sought by the applicant can not be achieved by some method, feasible for the applicant to pursue, other than an area variance . The tennis court would be permissible if the property contained, a residence . No residence is planned at this time since he or a member of his family are the adjacent owners . 3 . The area variance is not substantial The application of the balancing test weighs in favor of the grant of the variance. A private tennis court and required fence is customary and accessory to a residential neighborhood. 4 . The variance will have no adverse effect or impact on the physical or environmental conditions in the neighborhood or district . r 5 . The alleged difficulty was not self-created. The code has been interpreted to prevent a permitted and customary accessory use on the same property as the principal use. The code interpretation does not address the applicant placing the accessory use on an adjacent property. 6 . The variance requested is the minimum variance practicable given the personal benefits anticipated by the applicant . A tennis court will preserve the less intensive use to the property then the construction of a house with a tennis court .
