Findings of Property Facts: Created in 1948 (Captain Kidd Estates) by
Town Board Approval. Merger in effect since purchase by current owner
7/17/85, L9851, p.453; also reference deed 12/82, L9300, p.313.
Reasons of Denial:
1. Applicant made no attempt to place vacant merged lot in separate
ownership as did prior owners (Martens).
2. In 1985 at the time the applicants purchased the unimproved (vacant
File map lot #126) it was not a buildable lot under the Zoning Code.
3. Common ownership of both lots has existed for twelve years.
4. Applicant did not demonstrate economic hardship in this case.
5. Elevation and contours are severe and potential flooding could result
in water damage to existing home (Applicant's Home) on file map #131.

NOTICE IS HEREBY GIVEN, pursuant to Section 267 of the Town Law
and the Code of the Town of Southold, the following applications will be
held for public hearings by the SOUTHOLD TOWN BOARD OF APPEALS, at
the Southold Town Hall, 53095 Main Road, Southold, New York 11971,
on THURSDAY, DECEMBER 12, 1996, as noted below:
1. 7:15 p.m. Appl. No. 4438 - GIUSEPPE & LAURIE COMO.
This is an application for a Variance based upon the November 1996 Action
of Disapproval by the Building Inspector under Article III, Section 100-33C,
in which applicant applied for a building permit to locate accessory
building, and that yard area has been designated a second front yard.

6. 7:40 p.m. Appl. No. 4440 - ADLYN SYVERSON. Variance
based upon the October 7, 1996 Action of Disapproval of the Building
Inspector wherein applicant has requested a permit to build extension to
dwelling at 420 Private Road #17, off Camp Mineola Road, Mattituck, NY;
Parcel #1000-123-6-17 (now 17.1). Under Article XXIV, Section 100-244B
proposed construction will have an insufficient westerly side setback and

Section 100-239.4B for a proposed deck addition within 75 feet of bulkhead,

Town of Southold in making this review determination:
1. Copies of my recent tax bill for both (all) lots.
2. Copies of deeds dated prior to June 30, 1983 for all. Lots.
3. Copies of current deeds of the parcels under review.
4. Copy of the current County Tax Map for my neighborhood.
5. $150.00 application check which is not refundable if
this waiver is denied.
I understand that if an unfavorable waiver action is issued by the
Town of Southold, that I reserve the right to file for a
subdivision and, if necessary, area variances under the usual

REASONS WHY WAIVER OF MERGER SHOULD BE GRANTED;
COSTAS CAVIRIS AND MARX CAVIRrs, HIS WIFE, 1800 Captain Kidd
Drive, Mattituck, New York axe the owners of a house located at
1800 Captain Kidd Drive, Msttit_uck SCTX4 lgop-106-2-40, and
adjoining rear lot located at control Drive, X*ttituck SCTM# 1000-
106-2-3:. The properties are on a subdivision map approved by the
Town Board on 11/3/48 filed as map ,",1672, Map of Captain Kidd
Estates. These properties have been issued separate tax bills and
believed to be saparate. Inquiries to the building department for
a buildi-ig permit to build a new house on the lot for Mr. and Kra.
Caviris's son disclosed that the properties had merged becau449 the
two properties had been held in common ownership after July i,
1983.
SCTM# 1000-106-2-40:
Thw property is improved with a single family house,
individual septic and well. Mr. and Mrs. Caviris purchased the
property from Wilhem Martens on December 29, 1982 (Deed attached).
The Town issued a separate tax bill for this property.
SCTM# 1G00-106-2-35:
The 100 foot x 120 foot vacant lot was purchased by Mr. Costas
Caviris and Mrs. Mary Caviris, his wife from William Martens and
Margarita Martens on July 17, 1985 Which dead was recorded at Liber
9851 Page 453. The Caviris's attorney did not protect them against
the merger of these properties, believing that a lot on a filed
subdivision would be pirotected. The Town hag issued a separate tax
bill for this property.
The Suffolk County Tax Map shows these parcels as separate
properties, the properties were created prior to one acre zoning.
The Caviris Family had alway's intended to keep the properties
separate.
The waiver will not result in a significant increase in the
density of the neighborhood, the Kapta'n Kidd, development is
substantially developed, the properties are all 100 x 120 feet in
size, and the development of the vacant lot will face Central
Drive. Thus, the waiver would roe,:ognite a lot that is consistent
with the size of the lots in the nolghborhadd.
The waiver will avoid aconomic hardship, the lot is planned
for their son to build his house, the Caviris''s are getting older
and need their son closer to them.
